Murdock Avenue Dear Resident: It has come to the City's attention that you are conducting a rummage /garage sale use at your property on an ongoing/regular basis. Please be advised that per the City's Zoning Ordinance, commercial activities in a residential zoning district are prohibited uses. However, the Zoning Ordinance allows rummage /garage sales if the activity does not exceed 4 days in duration and occur more than once every 4 months. Any sales activity which exceeds the above referenced guidelines is in violation of the City's Zoning Ordinance and is prohibited. Also be advised that section 134.71 of the Wisconsin State Statutes requires a business that deals in the resale of any used articles must obtain and hold a current second -hand dealers license. Application for a second -hand dealers license can be made through the City Clerk's office. But bear in mind that issuance of a second -hand dealers license does not alleviate a property owner of the responsibility to comply with all other applicable city codes such as the above referenced Zoning Code. In consideration of the above mentioned sections of the Oshkosh Municipal Code, and Wisconsin Statutes, we ask you to review your current activities to make sure they comply with the required ordinances and laws.
