monument style ground signs are hereby approved as part of the planned development

BACKGROUND /SUBJECT PROPERTY
The subject property and development is identified as Riverfront Landing that will include the
new Morton Pharmacy, Accu -Com, and mixed -use structure for which site and development
plans have been approved by Council. The previous approval did not include ground signage.
Due to the significant sizes and prominent locations of the signs in the development, the
developer is required to obtain site and development approval.
ANALYSIS
The petitioner is requesting approval for two internally- illuminated monument signs located
along the west side of Jackson Street between Pearl Avenue and Marion Road. The signs are
similarly styled and will serve the new mixed use commercial building located at the corner of
Jackson Street and Pearl Avenue, as well as one sign near the Morton Pharmacy building located
at the corner of Jackson Street and Marion Road. The ground sign serving the Morton Pharmacy
site includes a 40 square foot per side message center sign.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved this request at its November 3, 2009 meeting.

GENERAL INFORMATION

Green Bay Sign and Design has submitted a site plan and elevations for two monument -style signs
to be located along the west side of Jackson Street, north of Marion Road. One sign will be a multi-
tenant sign that will include Morton Pharmacy mid block at the driveway entrance to the
development and the other a ground sign at the corner of Marion Road and Jackson Street that will
be exclusively for Morton Pharmacy and including an electronic message center.
Applicable Ordinance Provisions
Criteria for Planned Development Overlay Districts are located in Section 30 -33 of the Zoning
Ordinance.
Property Location and Type
The subject property is located in the Phase II Marion Road Redevelopment Area. The Phase 11 area
is comprised of approximately 13 acres of former industrial lands with roughly half having river
frontage. The Marion Road Redevelopment Area is located between UWO on the west and the
central business district on the east. The Phase II area is generally abutted on the east by two older
industrial uses, Mercury Marine and Lamico as well as by a new apartment project, Morgan
Crossing, also developed as part of the Phase II redevelopment plan.

ANALYSIS
The petitioner is requesting approval for two internally - illuminated monument signs located along
the west side of Jackson Street between Pearl Avenue and Marion Road. The signs are similarly
styled and will serve the new mixed use commercial building located at the corner of Jackson Street
and Pearl Avenue and the Morton Pharmacy building located at the Corner of Jackson Street and
Marion Road. Both buildings will be breaking ground within the next few weeks. The ground sign
serving the Morton Pharmacy site includes a 40 square foot per side message center sign.
SIGN #1 — MULTI- TENANT SIGN
The first sign is proposed to be a shared multi- tenant monument sign for both Morton Pharmacy and
the future tenants of the mixed use commercial building. The provided elevation shows the
pharmacy taking the top spot with space for up to five additional tenants below. The sign is sized at
21 feet tall, 14 feet, nine inches wide and approximately 310 square feet in area per side (620 square
feet total). Per the submitted site plan, the sign is to be located approximately midway between
Pearl Avenue and Marion Road, 15 feet off the Jackson Street right -of -way.
SIGN 42 — MORTON PHARMACY SIGN
The second ground sign will be exclusive to the Morton Pharmacy building. The elevation shows it
to be 13 feet, seven inches tall, 14 feet, six inches wide and approximately 197 square feet in area
per side (394 square feet total). In addition to the identifying portion of the sign, plans show a full
color electronic message center below the Morton Pharmacy logo. The message center is sized at 3
feet, four inches tall by twelve feet wide, and 40 square feet in area per side (80 square feet total).
The sign is to be placed near the southeast corner of the property, approximately 10 feet off the
Jackson Street right -of -way, 50 feet from the Marion Road right -of -way, and is outside the vision
triangle.
Both signs have similar architectural features and are designed to look as part of the overall
development, which is being identified as "Riverfront Landing ". In terms of scale and mass the
overall project sign, while large and tall (21 feet high, 310 square feet per side), will not overwhelm
the development as a whole, as it is acting as the main project sign for the site. The concern for
staff is that the sign does not include a message center sign. Based on previous experience,
individual tenants may be requesting such EMC signage creating a hodgepodge signage look within
the "planned development ".
The proposed ground sign for the Morton building is 13 feet in overall height and includes a
message center sign. The sign appears to be at the maximum height possible to fit in with a one -
story building, especially with the atrium structure included. However, staff has concerns with the
proliferation of message center signs in larger planned developments and feels that a centrally
located message center sign to be included in the overall project sign is a better overall fit for the
long term health of this center as it provides the ability of others in the development to advertise on
the sign, which in turn will reduce the need for each business in the development to have their own

message center signs. Relocation of the message center from the Morton sign to the overall center
sign will also reduce the overall height of the sign bringing it more into scale with the proposed
building.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the request to place and
construct the signage as proposed with the following conditions:
1. Removal of the message center sign from the Morton only ground sign. The height of the
sign will correspondingly be dropped to match removal of this sign.
2. Message center sign shall be incorporated into the overall project sign and made reasonably
available to all tenants in the development with use plan to be approved by the Department
of Community Development. The corresponding height of the sign shall not be increased to
incorporate the message center sign.
The Plan Commission approved of the request to place and construct the signage as proposed with
no conditions. The following is the Plan Commission's discussion on this item.
Mr. Burich presented the item and reviewed the site and surrounding area, the land use map,
locations of the proposed signs, and illustrations of said signs. He also reviewed the previously
approved site plan for the development and commented that he did not have any issues with the
proposed signage in general however he did have concerns regarding the electronic message center
to be located on the Morton Pharmacy sign. He further stated that his concerns were that electronic
message center would be for the use of Morton Pharmacy only and could generate other requests
from tenants in the development for electronic message center signs for their businesses. Staff
would like to see the electronic message center relocated to the multi- tenant sign for use by other
businesses in the development.
Mr. Bowen questioned if electronic message center signs were prohibited per code.
Mr. Burich responded that these types of signs were not prohibited but were restricted to only one
per parcel.
Mr. Thorns inquired if staff had discussed the need of the electronic message center for other tenants
in the development and questioned how it would work for multiple businesses. He also questioned
if the signage meets all code requirements.
Mr. Burich replied that the signage meets all code requirements and the necessity of other users
would be a question more appropriate for the petitioner to answer.
Mr. Borsuk asked if the electronic message would be crawling or static with one constant message
or a continuous scrolling message.
Mr. Buck responded that the petitioner could answer that question more effectively; however staff
feels that some scrolling messages could cause distractions to drivers but they are not prohibited;
only flashing signs are prohibited by code.
Mr. Borsuk commented that he felt that the code requirements for these types of signs should be re --
evaluated.

Steve Morton, Morton Pharmacy, 200 City Center, stated that the electronic message center is
difficult to function with multiple users and the message center was intended for Morton
Pharmacy's needs only. Multiple tenants advertising on one message center can be confusing for
citizens as they are not sure which business it belongs with. He further commented that their
present location in City Center is 10,000 square feet and they would be expanding to 14,000 square
feet to include grocery items; however these types of items require advertising to promote sales. As
an example, he discussed the flu clinics they recently sponsored at two locations with advertising in
both the newspaper and on a LED board and they found the LED board to be much more successful.
He also stated that they were planning on utilizing a static message, not scrolling, and that there has
been no request from other tenants to have a message center for their business.
Mr. Thorns then asked Andy Dumke, developer for the site, if he would have an issue with other
tenants wanting to share the electronic message center.
Andy Dumke, 2030 Menominee Drive, stated that he has no interest in using the electronic message
center for other tenants within the development.
Mr. Morton stated that he felt moving the message center to the other sign would be confusing for
citizens.
Mr. McHugh questioned if the two signs proposed today would be the only signage for the site as he
did not want to see it proliferated with signage.
Mr. Burich responded that these two signs were the only ones being proposed for the development
and the intent was that the main sign would serve the multi- tenant use with the second sign serving
Morton Pharmacy only.
Mr. Thorns proposed to amend the request by removing the conditions regarding relocating the
electronic message center sign to the multi - tenant sign to allow Morton Pharmacy to have exclusive
use of the electronic sign.
Mr. Bowen stated that he would be supportive of such an amendment as he did not have an issue
with the electronic message center signage providing that there would not be multiple ones at this
location.
Mr. Borsuk agreed as well providing that no additional signage will be requested for this
development.
Ms. Propp questioned if staff seen an issue with amending the request as stated.
Mr. Burich responded that the request to centralize the electronic message center sign for the site
would allow everyone to benefit from one sign only to reduce the need for each business in the
development to have their own message center signs creating a hodgepodge signage look within the
planned development. He further stated that there would be no down side to amending the request
to allow the message center for Morton Pharmacy only providing that no other tenants would be
requesting one in the future.
Mr. Fojtik commented that Steve Morton was taking a risk by moving his business and the message
center was a nice way to advertise his establishment.

Mr. Thorns stated that he would not support any additional requests for electronic message centers
within the development.
Mr. Borsuk commented that the placement of the electronic message center should be reviewed by
the Transit Advisory Board.
Mr. Burich replied that all items that come before the Plan Commission are reviewed at an inter-
departmental meeting which includes Transit, Police, and the Fire Departments prior to staff reports
being prepared.
Motion by Thoms to approve the planned development for two signs located on the west side
of Jackson Street north of Marion Road in the Marion Road/Pearl Avenue redevelopment
area with no conditions.
Seconded by Borsuk. Motion carried 7 -0.

A NARRATIVE of the proposed conditional use/Development Plan including:
