HomeMy WebLinkAboutItem II PLAN COMMISSION STAFF REPORT NOVEMBER 3, 2009 ITEM II: PLANNED DEVELOPMENT APPROVAL AND CONDITIONAL USE PERMIT FOR A TEMPORARY PARKING LOT USE AT 608 ALGOMA BOULEVARD (LINCOLN ELEMENTARY SCHOOL) Note: This item was laid over from the October 2(/",2009 Plan Commission meeting for further staff review of the proposal and to address concerns with the University. The application has been altered to now request a development plan approval as well as a conditional use permit for the temporay use of the Lincoln School parking lot for University purposes. GENERAL INFORMATION Applicant: Owner: University of Wisconsin -Oshkosh Oshkosh Area School District Action(s) Requested: Development Plan approval and Conditional Use Permit for utilization of an existing off-street parking area at Lincoln Elementary School. Applicable Ordinance Provisions: Conditional Use Permit standards are found in Section 30-11 of the Zoning Ordinance and criteria and guidelines for the establishment and/or amendment of a Planned Development overlay district in Section 30-33. Background Information Property Location and Type: The Oshkosh Area School District indefinitely closed Lincoln Elementary School beginning the fall semester of2009. The property's future use is undecided at this time but it is important to note that the University of Wisconsin-Oshkosh has expressed interest in purchasing it to relocate essential campus services to the building and site. The 2.81 acre subject property is located directly adjacent to the current University campus at the northwest corner of Wisconsin Street and Algoma Boulevard. It is surrounded by a mix of single, two and multi-family residential uses (primarily student housing) including UW-O's Scott Hall dormitory to the west. The University of Wisconsin-Oshkosh is requesting a Conditional Use Permit to utilize Lincoln School's off-street parking area for resident and commuter parking on a temporary basis to help alleviate parking shortages in the University Campus for the 2009-2010 school season. The request also encompasses the approval of a Development Plan to convert the existing hard surface playground area to parking and provide 107 parking stalls. Historically, the University has had a significant parking shortage for students and staff. In recent years, UW-O has been very aggressive to address this situation by constructing a new parking ramp at the corner of High Avenue and Osceola Street, and constructing a new parking lot at vacated Woodland Avenue. When Lincoln School was closed, the University seized the opportunity to further deal with the parking shortage by utilizing the off-street parking area of the now vacant Lincoln Elementary School for resident parking. The University and Oshkosh Area School District (OASD) entered into a lease agreement for the use of Lincoln School hard surface playground and parking lot. In an attempt to maximize the parking availability from the schools 67 stall lot to 107 stalls, the University striped the playground area (with functional but substandard aisle and stall sizes) and added a four foot strip of gravel as part of an access lane. Subsequently, 104 of the new 107 stall lot (three stalls are retained for OASD maintenance vehicles) were leased to student residents and immediately occupied. The improvements were done without the understanding of parking lot dimensional standards required by Municipal Code, that a Conditional Use permit was needed for the use or that a zoning review was required. Staff does not have concerns with the proposed temporary use of the parking lot for the University and feels that the overnight/long-term nature of the parking arrangement will help to minimize any potential issues with the substandard aisles and stalls as the number of movements is typically far less than a regular commercial or multiple-family parking lots. Staff also believes the negative impact on the surrounding neighborhood will be negligible as the parking lot is preexisting with the only differences being an expansion in number of stalls and that cars will be parked overnight and weekends especially when weighed against the positive influences of assisting of the University's parking shortage, reducing the number of vehicles parked on-street, and alleviating the disruption to the University, student residents and city with not permitting the temporary use. use. PD UWO PARKING LOT 2 As conditions of both the PD and the Conditional Use, staff is recommending that the use of the parking facilities be discontinued at the end of the school term/lease agreement (August 31, 2010) and that all vehicles using the lot be licensed, registered, and in operable condition. Additionally, staff recommends that use of the lot be limited to UW-0 residents and OASD maintenance personnel parking only. The Department of Public Works, the Transit Department and the Police and Fire Departments reviewed the proposed request during the initial submittal and do not have any concerns. RECOMMENDATION/CONDITIONS Staff recommends a finding that the proposed planned development and conditional use permit request is consistent with Sections 30-11 (D) and 30-33(A)(l) of the Zoning Ordinance and be approved with the following conditions: 1) Use ofthe parking facilities is discontinued no later than August 31, 2010. 2) Base standard modification to permit substandard aisle and stall sizes within the lot, as proposed. 3) All vehicles utilizing the lot be licensed and registered and be in operable condition. 4) Parking be limited to UW-O residents and OASD maintenance personnel only. Existing Use of Property: The school has been closed by the Oshkosh School District starting with the fall semester 2009. Prior to closure, the property was used primarily as an elementary school with the parking lot as a secondary usage to support the school. The total acreage of the property is 2.41 acres (104,980 sq ft), which is comprised of approximately 48,000 sq ft of paving and private sidewalks, 18,000 sqft of building footprint and the remaining approximate 39,000, green space. Proposed Use of Property: The University ofVVI Oshkosh requests approval to use the existing parking lot for resident and commuter parking. The building is planned to remain closed until further action by the school district. The parking lot provides parking spaces for 107 cars -104 leased to the university and 3 reserved for school district maintenance staff Effects on Adjoining Properties: The proposed continued usage of the parking lot should have no negative impact on the adjoining properties or land uses. The lot will be primarily used for resident parking, those living in the residence halls. The traffic from computer usage will be less than a typical commuter lot, as most people who will park in this remote lot will typically be on campus for the entire day, minimizing the amount of traffic flow in and out of the lot. Traffic Generation: The traffic related to this facility should not be any worse than it was when used by the elementary school. The usage of this parking lot should help to reduce the amount of cars that will need to park on neighborhood streets.
