The decision of the Board was filed in the Planning Services Office of the Department of Community Development on November 13, 1997. Per Section 30- 6(C)(3) and (4) of the City of Oshkosh Zoning Ordinance, your variance will expire on May 23, 1998 unless you have obtained a permit for the activity allowed by the variance. If you fail to get a permit by this date, you must reapply for a variance if you intend to go ahead with the activity allowed by the variance. Building permits may be obtained from the Inspection Services Division in Room 205 at the Oshkosh City Hall between 7:30 8:30 AM and 12:30 1:30 PM, Monday thru Friday, or call (920) 236 -5050 for an appointment. Motion by Roehlig to approve a variance for a six (6) foot five (5) inch setback. Seconded by Husman. Motion denied (2 -3). (Dahl, Roehlig, Krueger) Regarding Finding of the Facts, Mr. Roehlig stated there were other altematives to the present building plans, and he couldn't see any hardship. Mr. Schorse stated the steps could have been replaced without a variance. II. 1360 WHEATFIELD WAY Tim and Deanna Paris, applicants /owners, request a variance for a thirteen (13) foot rear yard setback whereas section 30 -17 (B) (2) (d) (ii) of the City of Oshkosh Zoning Ordinance requires a twenty -five (25) foot rear yard setback. Deanna Paris, 1360 Wheatfield Way, stated the lot was irregular. She also explained the house was built with sliding glass doors which angled towards the narrow end of the lot. She feels the deck adds to the appearance of the house and the lot. She also noted the lot behind theirs has a 6' fence on the border. She stated they added the deck where they felt it was the best possible place for the house design and the lot. Joyce Goers asked if they had designed the house. Deanna Paris replied they had not. Chairman Krueger proceeded to review the house and setbacks from all angles, and concluded a deck could not be built without a violation. Mr. Husman stated the house had met all setbacks, but there is limited ability to build a deck. Mr. Roehlig noted that the builder should have not included patio doors in an inappropriate place. Motion by Roehlig to approve a variance for a thirteen (13) foot rear yard setback. Seconded by Goers. Motion carried 6 -0. Regarding Finding of the Fact. Mr. Roehlig pointed out there were no alternatives. Mr. Husman stated the hardship was not self created. III. 3317 LOGAN DRIVE Dominium Wisconsin Five, LP, applicant/owner, is requesting a variance for a nine (9) foot six (6) inch side yard setback whereas Section 30 -21 (B) (5) (b) (ii) of the City of Oshkosh Zoning Ordinance requires a ten (10) foot side yard setback, and a variance for a twenty -four (24) foot five (5) inch rear yard setback whereas Section 30 -21 (B) (5) (d) of the Ordinance requires a twenty -five (25) foot rear yard setback, and a twenty -four (24) foot nine (9) inch front yard setback whereas Section 30 -21 (B) (5) (c) of the City of Oshkosh Zoning Ordinance requires a twenty -five (25) foot front yard setback. Paul Marzynski, 2915 Niagara Lane, Minneapolis, MN stated they were trying to obtain a construction loan, and now they have a permanent lender who has noticed setback violations and will not proceed without having a variance granted. Mr. Roehlig asked if the discrepancy lied at the large end of the lot. Mr. Marzynski stated the comers of six (6) buildings at the large end fell into the setback area. STAFF REPORT BOARD OF ZONING APPEALS NOVEMBER 12, 1997 ITEM II: 1360 WHEATFIELD WAY Tim and Deanna Paris, Applicants/ Owners GENERAL DESCRIPTION AND BACKGROUND Tim and Deanna Paris, applicants /owners request a variance for a 13 foot rear yard setback whereas Section 30 -17(B) (3) (d) (ii) of the City of Oshkosh Zoning Ordinance requires a 25 foot rear yard setback. The general area is characterized by single family residential land uses and is zoned R -1 Single Family Residence District. The subject property is a single family home. ANALYSIS AND RECOMMENDATION In reviewing a variance request, the following questions should be addressed: Is there an unusual or unique characteristic about the subject property which creates a hardship? Is the hardship self created? Is the variance being requested the least possible needed to remove any hardship? Will granting of the variance have a considerable adverse impact on the neighboring properties? The applicants constructed a 12' x 20' deck that is attached to the rear of the house. The floor of the deck is about 24" above grade, and there is a railing around the deck. No permit was obtained for the deck construction. The subject lot is some what irregular in that one side is 114.50 feet while the other is 91 feet, and it appears the lot may be smaller than most other lots in the neighborhood. While somewhat limited, the applicant may have had alternatives which could have allowed for the construction of a deck that complied with the District Standards. Based on this information, staff recommends denial of the variance.
