HomeMy WebLinkAbout09-404OCTOBER 27, 2009 09 -404 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE OFFICIAL MAPPING OF WEST 4TH AVENUE EXTENDED AND IOWA STREET EXTENDED AT THE IOWA STREET / WEST 4TH AVENUE / WEST 5TH AVENUE INTERSECTION INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT PLAN COMMISSION RECOMMENDATION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30 -68 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO THE OFFICIAL MAP. WHEREAS, a public hearing, after due and proper notice, was duly held before the Common Council of the City of Oshkosh concerning the adoption of this amendment to the Official Map of the City of Oshkosh, and the Plan Commission having duly recommended the adoption of this Ordinance. NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30 -68 of the Oshkosh Municipal Code pertaining to the Official Map of the City of Oshkosh and its extraterritorial jurisdiction shown, is hereby amended by deleting therefrom the present map sheet, and the substituting therefore an amended map sheet, thereby making revisions to the official map as described in the attached. SECTION 2. Immediately upon these amendments to the Official Map becoming effective, the City Clerk shall file a certificate with the Register of Deeds for Winnebago County showing that the City has amended its official map; and shall remove from the Official Map the obsolete map sheet and shall replace it with a copy of the map sheet attached hereto; the obsolete map sheet shall be retained by the City Clerk in a hard- bound folder and each sheet thereof marked to the effect that it was rescinded by action of the Common Council this date; the new sheet added to the Official Map shall be marked to the effect that the amended sheet was adopted by action of the Common Council of this date. OfHKO.fH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: October 22, 2009 RE: Approve Official Mapping of West 4 th Avenue Extended and Iowa Street Extended at the Iowa Street/West 4 th Avenue /West 5 th Avenue Intersection (Plan Commission recommends approval) BACKGROUND /SUBJECT PROPERTY This action relates to implementation of the South Shore Redevelopment by proposing to officially map street extensions in the area to help set the future development pattern for the area that will extend and connect the gridded street pattern in the area. The subject mapping area is located on the west end of the Jeld -Wen property that is paved storage, parking area, and greenspace. ANALYSIS The official mapping of Iowa Street between 4 th and 5 th Avenues is essentially recreating a section vacated by the City in 1954. The proposed right -of -way is 60 feet wide, 250.3 feet long and 15,000 square feet in area. Like Iowa Street, the mapping of 4 th Avenue between Iowa and Lewis Streets is recreating a section vacated in 1954. However, this mapping includes 13.5 feet of additional right -of -way along the north side of 4 th Avenue to provide space required for the riverwalk system. Overall, this segment is 73.5 feet wide, 311 feet long, and approximately 23,000 square feet. The official mapping action is important in that it ensures that no development or inappropriate improvements take place that would interfere with the future revitalization efforts and /or riverwalk development. Construction of these roads will provide better access and vehicle circulation to the former Boat Works property and the west side of the Jeld -Wen property when the said sites experience redevelopment /revitalization. Additionally, the official mapping action allows the City to begin pursuing property and /or easements. FISCAL IMPACT None at this time. The official mapping does not obligate the City to acquire the mapped lands but does identify the City's future intentions with regard to development in the area. RECOMMENDATION The Plan Commission approved this request at its October 6, 2009 meeting. Approved, City Manager ITEM: IiLLY MAP — W. 4 A IOWA STREET (W. 4 Plan Commission meeting of October 6, 2009 GENERAL INFORMATION Petitioner: City Administration Owners: Jeld -Wen Windows & Doors Action(s) Requested: Officially map public right -of -way for W. 4 Avenue from vacated Iowa Street to Lewis Street and Iowa Street from vacated W. 4 Avenue to W. 5th Avenue. Applicable Ordinance Provisions: N/A Background Information: The Comprehensive Plan identifies goals, objectives, and implementation actions that the City aims to achieve over a 20 -year planning period on both an overall citywide basis and a special area basis including the Fox River corridor and South Shore Redevelopment Plans. Relative to the City's Comprehensive Plan, specific goals relate directly to a Riverwalk Plan include providing facilities for pedestrian and bicycle circulation, maintaining /improving /increasing public access to the waterfront, encouraging redevelopment in the Central City to be oriented toward the lakefront and riverfront and continuing the revitalization efforts of downtown and the central city area. To these ends, the Fox River Corridor Riverwalk Plan and Design Guidelines were completed in late 2005 and found to be consistent with the Comprehensive Plan by the Plan Commission and adopted by the Common Council in January 2006. The adoption of this planning document directs the city to further the goals of the plan through multiple means including the official mapping of right -of -way to be used in conjunction with riverwalk uses. The Comprehensive Plan also recommends utilizing Special Area Plans, in this case, the South Shore Redevelopment Area as a guide to further revitalize central city areas south of the Fox River and along the S. Main Street Corridor. This plans mirrors the Riverwalk Plan with a recommendation to create pedestrian and bicycle trails along the Fox River and Lake Winnebago. The plan further calls for the redevelopment of underutilized, obsolete and blighted properties within the project area. The original plan was completed and adopted by the Common Council in 2003 with amendments in 2006 and 2009. The adoption of this plan directs the city to further the goals of the plan through multiple means including the official mapping of right -of -way to be use in conjunction with revitalization efforts and riverwalk uses. The Plan Commission approved of the official map action as requested. The following is the Plan Commission's discussion on this item. Plan Commission members decided to review and vote on both official mapping items as one item. Mr. Nau presented the items and reviewed the riverwalk mapping area and extensions of W. Fourth Avenue and Iowa Street. He also reviewed the site and surrounding area and covered the background of the riverwalk plans including the mapped area on the east side of Oregon Street which was previously officially mapped. He reviewed the Riverwalk Master Plan and stated that the official mapping ensures that no development or inappropriate improvements take place that would interfere with the future riverwalk development. Item - Official Map 0,4v/Iowa St 2 Mr. Nau also stated that the City had previously vacated W. Fourth Avenue and Iowa Street and reviewed the area to be mapped. He further stated that the rededication of these streets will provide for better access to properties such as the Jeld -Wen site and the Boat Works site which would be beneficial for redevelopment purposes. Mr. Borsuk questioned if the property owner was contacted and if this action would affect how the current owner, Jeld -Wen, will sell the property. Mr. Burich responded that Jeld -Wen was notified of the official mapping action and it would make anyone who is considering purchasing the property aware that the City has plans for the riverwalk in this area. Mr. Bowen inquired if this action would move forward the plans to eventually complete the riverwalk project. Mr. Burich replied that it protects the area from any development or inappropriate improvements that would interfere with the City's plans until such time that the riverwalk is constructed. Mr. Thoms asked if the official mapping would prevent someone interested in purchasing the land from developing in that area. Mr. Burich responded that it reserves the officially mapped area only and the City could vacate the area at a later date if necessary. Motion by Borsuk to approve the official mapping of the riverwalk on the south side of the Fox River from Oregon Street to vacated Iowa Street and the official mapping of W. Fourth Avenue (Iowa Street to Lewis Street) and Iowa Street (W. Fourth Avenue to W. Fifth Avenue) as requested. Seconded by Monte. Motion carried 7 -0.
