HomeMy WebLinkAboutMinutes PLAN COMMISSION MINUTES JUNE 6, 2000 PRESENT: Lurton Blassingame, Donald Pressley, Achim Reschenberg, James Smith, and Lee Bettes, Chairman Pro-Temp EXCUSED: Melanie Bloechl, David Borsuk, Steven Gehling, Donald Krueger, John Ruppenthal, and Scott Saunders STAFF: Jackson Kinney, Director of Community Development, John Bluemke; Principal Planner, and Vickie Rand; Recording Secretary Mr. Blassingame nominated Mr. Bettes to chair the meeting. Seconded by Smith. Unanimous. The meeting was called to order by Chairman Pro-Temp Bettes. Roll call was taken and a quorum declared present. The minutes of May 16, 2000 were approved as mailed. Mr. Smith congratulated the Community Development staff for their work in securing a $200,000.00 EPA Grant. I: STREET NAME CHANGE: CHERRY PARK AVENUE TO CHERRY PARK COURT Ronald Leichtfuss, petitioner, requests the Plan Commission review and approve changing a street name from Cherry Park Avenue to Cherry Park Court. The street serves a plat known as Cherry Park Estates, which plat is generally located on the west side of USH 45, south of Johnson Avenue and north of Welle Drive. The Plan Commission on May 16, 2000 approved the Final Plat for Cherry Park Estates. There was no discussion on this item. Motion by Smith to approve changing a street name from Cherry Park Avenue to Cherry Park Court. Seconded by Reschenberg. Motion carried 5-0. II: CONDITIONAL USE PERMIT: 21 W. NEW YORK AVENUE Terry Laib, applicant, for City of Oshkosh, owner, requests the Plan Commission review and approve a Conditional Use Permit (CUP) for conversion of the former City Fire Station property located at 21 W. New York Avenue to a mixed commercial/residential use. The Common Council previously approved rezoning of the property from R-2 Two Family Residence District to C-1 Neighborhood Commercial District. Plan Commission Minutes Page 2 June 6, 2000 Mr. Smith asked why no buffer was provided on the east side of the property. Mr. Bluemke stated the adjacent property was a commercial use, therefore, no buffer was needed. Chester Ward, 14 New York Avenue, asked how long the parking was going to extend on the south side of the lot. Mr. Bluemke used the map as displayed to point out the single space that would be designated for handicapped parking, and noted there wouldn't be a need for on street parking, as there would be a parking lot on the east side of the site. Rick Schroeder, 581 N. Main Street, stated he was representing Terry Laib, and was the architect for the property. He stated he was available to answer any questions the Commission might have. He went on to note the project was a good fit for the area. He stated the two handicapped apartments on the first floor were a welcome addition to the area. Mr. Reschenberg asked if the handicapped parking area would be paved. Mr. Bluemke stated that was a requirement of the Zoning Ordinance. Mr. Schroeder stated the area was paved now, and pavement beyond the handicapped parking area would be removed to provide landscaping. Motion by Pressley for approval of a Conditional Use Permit for the mixed commercial/residential use to be found consistent with standards set forth in Section 30- 11(D) of the Zoning Ordinance. Seconded by Blassingame. Motion carried 5-0. III: CONDITIONAL USE PERMIT: 1331 ALGOMA BOULEVARD Bradley Larsen, applicant, for City of Oshkosh, owner, requests the Plan Commission review and approve a Conditional Use Permit (CUP) to allow for the construction of a temporary structure on the museum grounds at 1331 Algoma Boulevard. Brad Larsen, Oshkosh Public Museum Director, 1331 Algoma Blvd., stated they compared the costs of leasing space and putting up a temporary building, and found that constructing a temporary building would be most cost efficient way to go. Mr. Larsen stated there are thousands of items that need to be moved out of the Annex building into the temporary storage building before the renovation can begin. He stated the job is scheduled to be completed by the end of 2002 or early 2003, at which time the items would be moved back into the Annex. Mr. Bettes asked how the Commission could be confident this would only be a temporary structure. Mr. Larsen stated they have no intention of constructing a permanent structure. He also noted the Annex hasn't been updated since 1908, and assured the Commission the temporary structure would be taken down in 2003. Mr. Bluemke stated a condition was included in the Staff Report whereby the structure would be removed and the lawn be restored by December 31, 2003. Mr. Smith asked it the current zoning wouldn't allow the structure to remain on the property. Mr. Bettes stated if the structure were to be constructed as a permanent structure, other aspects of the design would have to be reviewed to ensure it would be harmonious with the neighborhood. Motion by Pressley for approval of a Conditional Use Permit for a temporary structure at 1331 Algoma Boulevard to be found consistent with the standards of Section 30-11 (D) of the Zoning Ordinance and be approved with the condition the structure be removed and the lawn be restored by December 31, 2003. Plan Commission Minutes Page 3 June 6, 2000 IV: CONDITIONAL USE PERMIT: 3870 JACKSON STREET Kirk Zastrow, petitioner, for Community Church, owner, requests the Plan Commission review and approve a Conditional Use Permit (CUP) to allow for a day care/pre-school at 3870 Jackson Street. Mr. Smith asked what the difference was between a day care and a pre-school. Lisa Martin, 621 Bowen, stated a day care was designed for children 5 weeks to 3 years old, and a pre-school was designed to provide a more educational structure for children 3 to 5 years old. Motion by Pressley for approval of a Conditional Use Permit for a day care/pre-school at 3870 Jackson Street to be found consistent with the standards of Section 30-11 (D) of the Zoning Ordinance and be approved with the condition a solid wood fence or evergreen shrub border at least 5' high be installed and maintained along the rear lot line from the parking lot north to Summerview Drive. Seconded by Smith. Motion carried 5-0. V: CONDITIONAL USE PERMIT: 223 N. MAIN Jeff Robl, petitioner, for Robl Properties LLC, owner, requests the Plan Commission review and approve a Conditional Use Permit (CUP) to allow for a mixed commercial/residential structure at 223 N. Main Street. Mr. Bluemke introduced the item stating that a new parking lot is being constructed within 300 feet of the proposed structure, which could provide parking for the tenants. He explained this parking availability would bring the proposed development into compliance with the City of Oshkosh Zoning Ordinance. Jeff Robl, 114 W. Custer, questioned the parking arrangement for the project. But he stated he would have no problem paying for the four parking spaces and entering into a lease agreement with the City of Oshkosh, however, he wasn't guaranteed the parking spaces would be available. Mr. Robl stated he had talked to the City Transit Department and was told they weren't sure of the mix of parking for the new lot on High Street. He asked for advice on how to secure parking so he could proceed with the development. Mr. Bluemke stated that City Transit had told him that's it's possible 50% of the parking lot on High Avenue may be utilized by monthly permits, and that the City would be happy to work with him to provide parking stalls for his tenants. Mr. Bluemke stated the Conditional Use Permit would be good for one year, which would give them time to secure parking. Mr. Robl asked how flexible the parking requirement of being within 300 feet of the structure was. Mr. Bluemke stated the ordinance is very specific and the 300-foot law was very firm. Mr. Robl stated he didn't know if he would proceed with the purchase of the property at this time. Mr. Bluemke recommended that if that were the case, he should discuss it with his attorney. Discussion followed regarding whether any other parking was available within 300' of the subject property other than the surface parking lot replacing the ramp on high street, and the number of parking stalls that will be available in the new parking lot. Mr. Bluemke reminded the Commission they had to make a recommendation for the Common Council, and reiterated the 300' parking requirement was in the City's Zoning Ordinance. He stated all he could do at this point was to assure Mr. Robl that the City will work with him to obtain a parking agreement between himself and the Oshkosh City Attorney and Department of Community Development. Motion by Reschenberg to approve a Conditional Use Permit for second floor dwelling units at 223 N. Main Street to be found consistent with the standards of Section 30-11 (D) of the Zoning Ordinance and be approved with the condition the apartments will not receive occupancy permits until a written agreement to assure the retention of parking is approved by the City Attorney and the Department of Community Development and properly recorded with the Winnebago County Register of Deeds. Seconded by Smith. Motion carried 5-0. OTHER BUSINESS I.JULY PLAN COMMISSION MEETING DATES Mr. Bluemke stated the first meeting of July would fall on the 4th of July Holiday, and asked if the Plan Commission would like to reschedule for another day during that week. Discussion followed and a consensus was made to hold only one meeting on July 18th, which is the regular date scheduled for the Plan Commission meeting on the third Tuesday of the month. Motion by Blassingame to hold one meeting in July, on July 18th, 2000. Seconded by Reschenberg. Motion carried 5-0. There being no further business, the meeting adjourned.
