HomeMy WebLinkAbout09-380OCTOBER 13, 2009 09 -380 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: ACCEPT CERTIFICATION OF AMENDMENT NO. 2 TO SOUTH SHORE REDEVELOPMENT AREA PLAN AND DIRECT THAT NO NEW CONSTRUCTION BE AUTHORIZED WITHOUT COMMON COUNCIL APPROVAL INITIATED BY: CITY ADMINISTRATION RECOMMENDED: Redevelopment Authority recommends approval. WHEREAS, the City of Oshkosh Common Council previously designated the boundaries of and approved the Project Plan for the South Shore Redevelopment Area, as amended; and WHEREAS, on September 22, 2009 the Common Council of the City of Oshkosh by resolution approved designating the boundaries of and approved Amendment #2 to the Project Plan for the South Shore Redevelopment Area; and WHEREAS, Amendment #2 to the Project Plan has been found to be feasible and in conformity with the Comprehensive Plan for the City of Oshkosh; and WHEREAS, the Redevelopment Authority for the City of Oshkosh has certified the Redevelopment Plan; and WHEREAS, Wisconsin Statutes requires the local legislative body upon certification of the plan by the redevelopment authority to direct that no new construction be permitted unless authorized by the local legislative body, including substantial remodeling or conversion or rebuilding, enlargement, or extension or major structural improvements on existing buildings, but not including ordinary maintenance or remodeling or changes necessary to continue the occupancy. NOW, THEREFORE, BE IT RESOLVED by the Common Council for the City of Oshkosh that the certification of Amendment #2 to the South Shore Redevelopment Area Plan is hereby accepted. BE IT FURTHER RESOLVED that no new construction may be authorized by any agencies, boards or commissions of the City in the area unless authorized by the Common Council, including substantial remodeling or conversion or rebuilding, enlargement, or extension or major structural improvements on existing buildings, but not including ordinary maintenance or remodeling or changes necessary to continue the occupancy. Lorenson, City Attorney DATE: October 8, 2009 RE: Resolution to Accept Certification of Amendment #2 to the South Shore Redevelopment Area Plan and Direct that no New Construction be Authorized without Common Council Approval BACKGROUND The South Shore Redevelopment Area was created in 2003 and expanded in 2005. In June, Jeld -Wen Corporation announced plans to close their Oshkosh operation in August of this year and it appears that all manufacturing activity at the Oregon Street site has ceased. Amendment No. 2 to the Project Plan provided for inclusion of the main Jeld -Wen plant site at 421 Oregon Street, six (6) adjoining residential properties and an approximate five (5) acre area on the northwest corner of the Jeld -Wen property in the redevelopment area and was approved by the Redevelopment Authority on September 16 and by the Common Council on September 22 of this year. In connection with this Amendment, a zone change will be brought forward to adjust the zoning from manufacturing to central commercial with a planned development overlay at the Council's October 27 meeting. ANALYSIS Wisconsin Statutes require that upon adoption of a Project Plan or an amendment thereto, the Redevelopment Authority certify the plan to the local legislative body. The Redevelopment Authority at its October 1, 2009 meeting certified Amendment #2 to the South Shore Redevelopment Area Plan. Statutes now require the Common Council to direct that no new construction may be authorized by any agencies, boards or commissions of the City in the area unless authorized by the Common Council, including substantial remodeling or conversion or rebuilding, enlargement, or extension or major structural improvements on existing buildings, but not including ordinary maintenance or remodeling or changes necessary to continue the occupancy. This certification co Memo re: South Shore Redevelopment: 10/8/09: P. 2 has the effect of allowing the RDA to exercise its powers of acquisition and assembly of lands within the District, as well as preventing new construction in the District without Common Council approval. As mentioned above, at its next meeting the Common Council will consider the rezoning of the properties in this area to C -3 Central City Commercial with a "PD" Planned Development Overlay District. If the proposed rezoning is approved, as a practical matter, the authorization by the Common Council for new construction will come through the Planned Development review process. FISCAL IMPACT There is no anticipated Fiscal Impact from the adoption of this Resolution at this time. RECOMMENDATION Staff recommends that the Common Council approve the Resolution as recommended by the Redevelopment Authority for the City of Oshkosh. Respectfully Sub fitted, n A. Rohloff City Manager REDEVELOPMENT AUTHORITY OF THE CITY OF OSHKOSH, WISCONSIN OCTOBER 1, 2009 . 09_27 RESOLUTION (CARRIED (o `0 LOST LAID OVER WITHDRAWN_. --) PURPOSE: CERTIFICATION OF AEA DMM ENT #2 TO SOUTH SHORE REDEVELOPMENT AREA WHEREAS, the City of Oshkosh Common Council previously designated the boundaries of and approved the Project Plan forthe South Shore Redevelopment Area, as amended, and WHEREAS, on September 22, 2009 the Common Council. of the City of Oshkosh by resolution approved designating the boundaries of, and approved Amendment #2 to the Project Plan for the South Shore Redevelopment Area; and WHEREAS, Amendment #2 to said Project Plan has been found to be feasible and . in conformity with the Comprehensive Plan for the City of Oshkosh; and WHEREAS, Section 66.1333(6)(e), of Wis. Stats., authorizes the Redevelopment Authority to certify the Redevelopment Plan to the Common Council where upon the Redevelopment Authority shall proceed with the powers granted to it by Section 66.1333(5), Wisconsin Statutes. NOW, THEREFORE, BE IT RESOLVED'by the Redevelopment Authority of the City of Oshkosh that Amendment #2 to the South Shore Redevelopment Area is certified to the Common Council of the City of Oshkosh. BE IT FURTHER RESOLVED per Section 66.1333(6)(e), Wis. Stats., that following acceptance of the certification by the Common Council that no new construction shall be authorized by any agencies, boards, or commissions of the City, in the redevelopment area, unless as authorized by the Common Council including substantial remodeling or conversion or rebuilding, enlargement or extension of major structural improvements on existing buildings, but not including ordinary maintenance or remodeling or changes necessary to continue the occupancy.
