• PURPOSE: AUTHORIZE JURISDICTIONAL OFFERS FOR THE MAIN
STREET RECONSTRUCTION PROJECT ($5,200.00)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Common Council of the City of Oshkosh has determined it is
necessary to acquire certain land for the right -of -way purposes and to obtain temporary
easements for the Main Street reconstruction project pursuant to authority granted
under Section 32.05, 32.06, 32.07, and 62.22, Wisconsin Statutes.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to issue
Jurisdictional Offers in the amount shown to each property owner on the following
properties:
• Parcel 2: $2,500.00: Nashco Hospitality Group LLC;
permanent and temporary easement
Parcel 3: $1,500.00: U.S. Bank, NA f /k/a Firstar Bank Wisconsin
f /k/a Firstar Bank Oshkosh, National Association
f /k/a First Wisconsin National Bank Oshkosh,
4/5 interest and MOD Corporation 1/5 interest;
permanent and temporary easement.
Parcel 6: $900.00: M &I Marshall & Ilsley Bank f /k/a M &I Central
State Bank f /k/a Valley Bank of Oshkosh f /k/a The
American Bank of Oshkosh Inc. f /k/a The New Ameri-
can Bank; permanent and temporary easement.
Parcel 46: $300.00: James Kiser & Gloria Kiser Revocable Trust
U /A; permanent easement at 694 North Main Street.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Approval of Jurisdictional Offers for the Main Street Reconstruction Project
BACKGROUND
The Wisconsin Department of Transportation (WisDOT) has scheduled the reconstruction of Main Street from
the Fox River to Irving Avenue in 2010. This project required the acquisition of eight permanent easements
required to facilitate handicap ramp construction and other temporary easements (which facilitate the
reconstruction of the public sidewalk or private driveways) at various locations.
ANALYSIS
Our ROW acquisition consultant has reached agreements with several of the property owners regarding the
permanent easements. The owners of three parcels have indicated.that they are not willing to agree to sell the
required easement rights or are having difficulty getting their paperwork signed per the WisDOT timetable. The
following information pertains to these properties:

FISCAL IMPACT
The State /Municipal Agreement for this project established allocation of costs as 75 % WisDOT /25% City for the
acquisitions of Parcel 3 and Parcel 6. The City is responsible for 100% of the acquisition cost of Parcel 46.
Funding for the City portion is included in the Capital Improvement Program and the total costs for all
acquisitions are within the budget limits.
RECOMMENDATION
I recommend approval of the jurisdictional offers. This will allow for the acquisition of the required ROW to meet
the bid schedule of the WisDOT.
