HomeMy WebLinkAbout09-364SEPTEMBER 22, 2009 09 -364 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT FOR INSTALLATION AND OPEARTION OF PAY AND DISPLAY STATIONS IN UWO CAMPUS AREA INITIATED BY: TRANSPORTATION DEPARTMENT WHEREAS, the City of Oshkosh and the University of Wisconsin- Oshkosh (UWO) recognize the need to provide and manage parking on City streets in the UWO campus area to mitigate the impacts of vehicular traffic resulting from University activities; WHEREAS, these parties recognize that short -term parking on City streets near the University is an effective tool for managing the impact of University - related parking on local streets while meeting the mobility and access needs of a variety of people; WHEREAS, these parties entered into an agreement on August 25, 2004 to support the installation of "pay and display" stations to improve parking enforcement and management on public streets in the University campus; and WHEREAS, terms of the original agreement have been satisfied such that the agreement needed to be re- negotiated in order to continue this cooperative approach to parking management; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached agreement between the City of Oshkosh and UWO for the installation and operation of pay and display stations in the UWO campus area is hereby approved and directed to enter into same. ( 0 OfHKOlH ON THE WATER City of Oshkosh - 926 Dempsey Tral (920) 232 -5342 sportation Department (920)232 -5343 fax MEMORANDUM TO: Mark Rohloff, City Manager FROM: Christopher Strong, P.E., Di rec of Transportatior Lynn Lorenson, City Attorne DATE: September 17, 2009 RE: EXPLANATION OF AGREEMENT FOR INSTALLATION AND OPERATION OF PAY AND DISPLAY STATIONS IN UWO CAMPUS AREA In August 2004, the City entered into an agreement with the University of Wisconsin - Oshkosh (UWO) with respect to "pay and display" systems. These systems were installed by the University with the goal of improving parking management on streets in the campus area. The purpose of the agreement was to address issues related to responsibilities, sharing of revenues and costs, and enforcement. The agreement's key features included the following: • UWO was responsible for purchasing and maintaining the pay and display systems. • The City and UWO would retain whatever revenue each party collected from enforcement of pay and display - related parking violations. • UWO would pay the City 25 percent of pay station revenue until such time as the capital cost of these systems was recovered. (The City has directed revenue from this agreement to the Parking Utility.) At that time, the agreement was to be opened for re- negotiation. UWO has tracked the revenue collected from these stations and has now recovered the capital cost of its initial investment. Therefore, City staff have met with UWO officials on several occasions to discuss modifications to the original agreement. City of Oshkosh — Department of Transportation Explanation of Revised Pay and Display Agreement Both parties believe that the original agreement has been successful in supporting parking management in the campus area. The agreement that is being submitted to the Council for approval differs from the original agreement in a few key ways. The agreement calculates net revenue based on a life -cycle view of the costs of the pay and display stations. The agreement establishes that UWO is solely responsible for one -time costs and revenues associated with the pay and display stations (i.e. purchase, installation, and salvage). Net revenue is calculated on by subtracting recurring costs (operations, maintenance and monitoring) from the money received from people paying for parking. The agreement does not change how enforcement revenue is collected by either party. 2. The new agreement is designed to include both existing and future installation of pay and display stations by UWO. This will allow the agreement to be flexible as parking management requirements in the campus area change over time. As occurred . in the past, any requests for specific pay and display stations must be considered by the Traffic Review Advisory Board and approved by the Common Council. 3. Upon approval, the agreement would be valid through December 31, 2012, with renewal options extended the end date for another three years. We believe that our experience with the initial pay and display agreement has been positive, so a longer -term extension of this agreement is appropriate. Both parties reserve the right to opt out early, according to language preserved from the original agreement. Fiscal Impact and Recommendati The new agreement will result in less revenue going to the Parking Utility. Under the original agreement, the City received $4,057.61 from the University in 2008 as its share of parking revenue from the pay and display stations. Under the revised agreement, the City would have received $1,628.60 from the University, or a reduction in revenue of $2,429.01. The reduction is solely the result of a modification in how net revenue is calculated. Under the former agreement, the calculated net revenue did not include maintenance and monitoring fees, which have turned out to be significant expenses for these systems. While this agreement results in reduced revenues for the City in the short-term, we believe it provides benefits to the City in the long -term. First, the agreement sustains a continued cooperative approach between the City and the University in managing parking demand in and near campus, and is vital in mitigating the parking impacts of University activity on adjacent neighborhoods. Second, while the University may continue to add pay and display stations at no cost to the City, the revised agreement preserves the City's ability to receive parking revenue from any new stations that the University may deploy. The former agreement did not include this flexibility. We recommend approval of this agreement. City of Oshkosh — Department of Transportation
