HomeMy WebLinkAbout09-375SEPTEMBER 22, 2009 09 -375 ORDINANCE FIRST READING (CARRIED, LOST LAID OVER WITHDRAWN PURPOSE: APPROVAL OF CHANGES TO PERMIT AND LEASED PARKING AREAS IN THE JEFFERSON, HIGH AVENUE AND 400 BLOCK WEST PARKING LOTS INITIATED BY: PARKING UTILITY COMMISSION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27- 23(A -11), 27 -48 AND 27 -49 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, PERMIT PARKING AND LEASED PARKING STALLS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27- 23(A -11) of the Oshkosh Municipal Code pertaining to parking regulations on designated streets and alleys is hereby amended as follows A-11 PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS JEFFERSON LOT Remove Therefrom 90- minute parking, the western section of the middle row, and the southern section of the most western row except the two most southerly stalls. Add Thereto 90- minute parking, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays, for the portion of the lot west of the pedestrian mall, the northern and southern rows of stalls, and the eastern row of stalls next to the western driving aisle. MAIN STREET LOT Remove Therefrom 90- minute parking, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day. SEPTEMBER 22, 2009 09 -375 ORDINANCE FIRST READING CONT'D SECTION 2. That Section 27 -48 of the Oshkosh Municipal Code pertaining to permit parking is hereby amended as follows: (A) City -Owned Parking Lots Remove Therefrom (1) North Main Street/400 Block West Parking Lot; the perimeter stalls bordering Church Avenue, the four (4) most southerly stalls on the perimeter of the lot bordering Division Street, the two (2) most easterly stalls in the fourth east/west aisle south of Church Avenue, the four (4) most northwesterly stalls in the north /south aisle, and the five (5) stalls in the southeast corner facing towards Main Street, and the three (3) most southern stalls in the far west north /south row located adjacent to Algoma Boulevard. Remove Therefrom (3) Jefferson Lot, the twenty (20) most southerly stalls bordering Jefferson Street, the east section of the middle aisle and the northern section of the most western row. Remove Therefrom (8) High Avenue Lot, except the east/west center row and the twenty -three (23) stalls adjacent to Pearl Avenue. Add Thereto (1) North Main Street/400 Block West Parking Lot; the perimeter stalls bordering Church Avenue, the four (4) most southerly stalls on the perimeter of the lot bordering Division Street, the two (2) most easterly stalls in the fourth east/west aisle south of Church Avenue, the four (4) most northwesterly stalls in the north /south aisle, and the five (5) stalls in the southeast corner facing towards Main Street, and the six (6) most southern stalls in the far west north /south row located adjacent to Algoma Boulevard. Add Thereto (3) Jefferson Lot, the north -south row of stalls on the western side of the eastern driving aisle and the stalls between and including the fourth northernmost and seventh southernmost stalls bordering Jefferson Street on the eastern edge of the parking lot. SEPTEMBER 22, 2009 09 -375 ORDINANCE FIRST READING CONT'D Add Thereto (8) High Avenue Lot, except the east/west center row and the eastern row of stalls in the section of the lot adjacent to Pearl Avenue. SECTION 3. That Section 27 -49(A) of the Oshkosh Municipal Code pertaining to leased parking stalls is hereby repealed and recreated as follows: (A) Residential Permits within the BID district The following described parking areas are designated for vehicles with a valid residential parking permit and holders of such a permit shall be entitled to lease a designated stall. Enforcement of the residential parking stalls shall be all days 24 hours. Residential parking permits shall be issued to residents within the BID district boundaries. (1) Division Street Lot: the 8 most northerly stalls bordering Division Street. (2) Riverside Lot: The 20 stalls located in the northwest section, bordering the Convention Center property and Ceape Avenue. SECTION 4. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate signage except for the Jefferson Lot and Main Street Lot, which will be signed after the parking lot improvements have been completed. SECTION 5. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #09 -XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27- 23(A -11), 27 -48 AND 27 -49 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, PERMIT PARKING AND LEASED PARKING STALLS, on October 13, 2009. The ordinance pertains to changes in permit and leased parking areas in the Jefferson, Main Street, and 400 Block West municipal off street parking lots. Before it was closed for reconstruction, the 400 Block East lot contained the Jefferson Lot and the Main Street lot. Together, these two lots had 106 spaces. The reconstructed lot will have 91 spaces. Since the new lot layout results in a reduction of spaces from the current condition, it is necessary to develop a new distribution of parking spaces. The following table summarizes the number of spaces before construction by type of parking; and the proposed number of spaces after construction. Type of Parking Before After Handicapped parking spaces 6 4 Loading zone 2 0 90- minute free parking 44 34 10 -hour metered parking 50 0 Permit parking 0 44 Leased parking 4 0 Restricted parking 0 9 Total 106 91 For the new lot arrangement, we have nine (9) spaces that are attached to specific properties by virtue of agreements between property owners and the City. These properties are: 420, 422, 424, 428, 430, 438/440, 452, 454 and 456 North Main Street. These agreements, reviewed by the Utility and subsequently approved by the Common Council in July, resulted in property owners voluntarily exchanging the right to park behind their building in return for improvements on their property and a free space in the 400 Block East lot for the next several years. As there is no condition on where these spaces are located, it makes sense to locate these spaces on the east side of the lot, preserving the nearer spaces for customers. The number of handicapped spaces in the lot is the minimum requirement for a lot with this capacity. These have been located in locations relatively close to the buildings. Instead of metered parking, there will be permit parking, which may be used by vehicles with monthly stickers or daily permits. Before construction, there were leased parking spaces and two spaces designated as loading zones. These will no longer be provided as they were underutilized. The remaining question for allocation of spaces is to determine the proper mix of free (90- minute) parking and permit parking spaces. The 2008 utilization study showed 47 percent utilization of the metered spaces, and 36 percent utilization of the 90- minute spaces. Assuming the same demand for parking continues, the proposed allocation of spaces would result in 53 percent utilization of the permit spaces, and 47 percent utilization of the 90- minute spaces. With the practical capacity of parking lots being 85 percent utilization, this seems to be a reasonable mixture of spaces at this time. The attached lot schematic lists numbers for each of the spaces. The following table lists the type of parking associated with each stall. PASSED BY PARKING UTILITY COMMISSION (4 -0) SECTION 27 -49(A) LEASED PARKING STALLS CONVERSION OF THREE LEASED SPACES TO PERMIT PARKING IN 400 BLOCK WEST LOT There are three stalls available for lease in the southwest corner of the 400 Block West parking lot; the current lease rate is $30 per month. These stalls are described in the municipal code as: "the fourth, fifth and sixth stalls north of Algoma Boulevard in the far west north /south row located adjacent to Algoma Boulevard The stalls have not been leased for several months. The Police Department and Collections Division have received complaints about there being a lack of permit parking in this lot, while these underutilized spaces are not being leased. It is unclear why these spaces are not currently being used. Nonetheless, since no lease revenue is being generated from these spaces, it makes sense to open these up to permit parking, if it provides a chance for revenue.
