HomeMy WebLinkAbout09-359SEPTEMBER 8, 2009 09 -359 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: CHANGE PENALTIES FOR PARKING VIOLATIONS INITIATED BY: TRANSPORTATION DEPARTMENT (APPROVED BY PARKING UTILITY COMMISSION) A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING SECTION 27 -53 PERTAINING TO BASIC PENALTIES FOR VIOLATIONS UPON ISSUANCE OF PARKING TICKET. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27 -53 of the Oshkosh Municipal Code pertaining to basic penalties for violations upon issuance of parking ticket be repealed and recreated as follows: SECTION 27 -53 BASIC PENALTIES FOR VIOLATIONS UPON ISSUANCE OF PARKING TICKET (A) Parking Violations The basic penalty for violation of the listed parking violations shall be as follows: No parking 2 a.m. to 5. a. m ................. ............................... $15 Parked on private property ................. ............................... $15 Prohibited parking ( signed) ................. ............................... $15 Overtime parking / meter violation ...... ............................... $15 Failure to properly display permit ........ ............................... $15 Fraudulent use of parking permit ........ ............................... $30 Disabled parking violation ................... ............................... $50 Firelanes ........................................... ............................... $50 Other violations .................................. ............................... $15 (B) Pay and Display Violations in University Area Penalties for violations of pay and display stations owned by the University of Wisconsin- Oshkosh and installed on City streets are established by the University of Wisconsin- Oshkosh pursuant to the authority granted to the Board of Regents of the University of Wisconsin system under sections 20.285(1)(h), 36.11(8)(a) and 36.11(9)(b) Wis. Stats. and in turn granted by the Board of Regents to the chancellor. It is the intention of this ordinance to include by such reference all provisions in effect at the time of the adoption of this ordinance or future amendments, revisions or recodification effective upon adoption by the Board of Regents of the University of Wisconsin System. The ordinance changes the penalties for violations of various parking regulations. First, the existing ordinance on penalties for parking violations did not explicitly incorporate the .daily parking permit program recently authorized by the Common Council. Second, the parking violation penalties in the existing ordinance have not been updated for several years, and as such they might not be significant enough to encourage compliance with parking regulations. This ordinance makes the following changes'to the existing municipal code. • It creates new violation categories for improper display of permits ($15) and fraudulent use of permits ($30). • It increases the penalties for some types of parking violations: no parking from 2 a.m. to 5.a.m. (from $10 to $15), overtime parking and meter violations (from $5 or $10 to $15), and fire lanes (from $30 to $50). • It removes the section which gives the University of Wisconsin- Oshkosh the ability to ticket for on- street meters on streets in the vicinity of campus, since those meters are in the process of being removed. One benefit of this new schedule is that it simplifies enforcement. Most parking violation penalties would now be set at $15. Higher penalties will be assessed for fraudulent use of parking permits ($30), violation of disabled parking ($50) and parking in fire lanes ($50). At its August 5, 2009 meeting, the Parking Utility Commission endorsed the creation of the new violation categories and supported the increased penalties for various violations by a 3 -0 vote. The Commission recommended increasing the penalty for "other violations" (i.e. parking too close to a driveway or crosswalk) from $15 to $20.
