PURPOSE: APPROVE AMENDMENT TO CONDITIONAL USE PERMIT TO
ALLOW CONSTRUCTION OF AN ADDITION TO AN UNMANNED
COMMUNICATIONS PUBLIC UTILITY STRUCTURE AT

PLAN COMMISSION RECOMMENDATION: Found to be consistent with Section 30 -11(D)
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
previously approved conditional use permit for an unmanned communications public
utility structure at 490 North Campbell Road is hereby amended to allow construction of
a 24 ft. x 24 ft. addition, per the attached.

BACKGROUND /SUBJECT PROPERTY
The subject 2.4 acre property is zoned C -1: Neighborhood Business District and is developed
with an open boat storage yard and a Time Warner utility building with associated parking area.
The existing open boat storage yard is a legal nonconforming use and the existing public utility
use was approved by conditional use permit in November 1999, and amended in 2002 to permit a
building expansion. The development is surrounded by a 6' high chain link fence with a gate at
the driveway along Campbell Road.
ANALYSIS
Time Warner Cable is currently leasing approximately a.28 acre area of land from Wisconsin
Public Service for an existing unmanned communications building. This CUP request is
proposing to construct a 24 foot by 24 foot expansion to the west side of the building which the
applicant has stated is necessary to expand Time Warner communication services in the
community. The proposed addition will match the existing building on the site and will facilitate
the relocation of the two - parking stall area used for service vehicles to the west. The existing
landscaping and vegetation currently on site will be relocated for affective screening for the
parking area relocation. As proposed, the building addition, parking facility relocation and
landscaping all meet code requirements.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its August 18, 2009 meeting.

The applicant is requesting to amend a conditional use permit to increase the size of an unmanned
communications building for Time Warner Utility Services at 490 North Campbell Road.
Applicable Ordinance Provisions:
Public utilities are permitted only through conditional use permits in the C -1 Neighborhood
Business Zoning District as regulated in Section 30 -24 (A)(20) of the Zoning Ordinance.
Standards imposed on Conditional Use Permits are located in Section 30 -11 (D) of the Zoning
Ordinance.

ANALYSIS
Time Warner Cable is currently leasing an approximate .28 acre area of land from WP for the
location of a 24 foot by 24 foot (576 square foot) unmanned communications building at 490 N.
Campbell Road. With this CUP expansion request, the petitioner is proposing to construct a 24
foot by 24 foot (576 square feet) expansion to the west side of the building, which the applicant
has stated is necessary to expand Time Warner communication services in the community. The
proposed addition will be constructed of precast insulated concrete panels that match the existing
building on the site and will include aluminum coping at the roofline and aluminum frame
windows and door. To facilitate the addition, it is necessary to relocate the two - parking stall
parking area used for service vehicles to the west. As proposed, both the parking facility
relocation and the building additions meet zoning code standards.
There is existing landscaping and vegetation that will remain on the site and the petitioner has
submitted a landscape plan that relocates the vegetative screening affected by the parking area
relocated. Plant amounts and locations meet code requirements. Additional screening to the site is
provided adjacent to the subject property on the property to the north in the form of a two foot
berm with multiple small trees and shrubs.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of an amendment to the CUP
allowing a public utility structure addition on the subject parcel as requested.
The Plan Commission approved of the amendment to the conditional use permit as requested. The
following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the proposed
site plan, landscaping, and elevations for the building addition.
Mr. Lowry questioned if there were required setbacks from the street.
Mr. Buck responded that there was a 25 foot setback from the street and a 10 foot setback on the
sides and that the proposed site plan met all setback requirements.
Motion by Lowry to approve the amendment to the conditional use permit to allow the
addition to the public utility structure at 490 North Campbell Road as requested.
Seconded by Borsuk. Motion carried 9 -0.

The site contains an existing unmanned communications building. Time Warner leases
the land from WPS for building. Time Warner would like to expand the building with
a 24'x24' expansion to the west side of the existing building, and a 24'x11' expansion to
the east side of the existing building. The building will be used to expand the utility
services for Time Warner Cable. The remainder of the existing site is used for boat and
RV storage.
Surrounding land uses include a marina to the north, a vacant lot to the south, the Fox
River to the east, and UW- Oshkosh Athletic facilities to the west.
The proposed building will remain unmanned and only be used to house additional
communications equipment. The building addition will not cause any changes to the
nature of the site, including noise, fumes, odor, vibrations, or hours of operation. In
addition, traffic on site will not change. All gates, driveways, and fences on site will
remain in their current state.
The total area of expansion is 840 square feet; however due to part of the expansion
being constructed on existing asphalt pavement, the overall added impervious is
approximately 300-square feet.
