PURPOSE: REPEALING CURRENT PROVISIONS RELATED TO PERMIT
PARKING FEES AND PROVIDING FOR ESTABLISHMENT OF
PARKING PERMIT RATE SCHEDULE

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND
RECREATING SECTIONS 27 -49 AND 27 -51 OF THE OSHKOSH MUNICIPAL CODE
PERTAINING TO LEASED PARKING STALLS AND WEST TENTH AVENUE PARKING
LOT.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 27 -49 of the Oshkosh Municipal Code pertaining to
monthly parking lot be repealed and recreated to read as follows:
SECTION 27 -49 LEASED PARKING STALLS
(A) Residential Permits within the BID district The following described parking
areas are designated for vehicles with a valid residential parking permit and
holders of such a permit shall be entitled to lease a designated stall.
Enforcement of the residential parking stalls shall be all days 24 hours.
Residential parking permits shall be issued to residents within the BID
district boundaries.
(1) Division Street Lot: the 8 most northerly stalls bordering Division
Street.
(2) Jefferson Lot: the 4 most northerly stalls bordering Jefferson Street.
(3) North Main Street /400 Block West Parking Lot; the fourth, fifth and
sixth stalls north of Algoma Boulevard in the far west north /south row
located adjacent to Algoma Boulevard.
(4) Riverside Lot: The 20 stalls located in the northwest section, bordering
the Convention Center property and Ceape Avenue.

(B) Residential Permits outside the BID district The following described parking
areas are designated for vehicles with a valid residential parking permit and
holders of such a permit shall be entitled to lease a designated stall.
Enforcement of the residential parking stalls shall be all days 24 hours.
(1) West 8th Avenue Lot: the two most northerly stalls on the west side of
the middle row.
(C) Daytime Permits The following described parking areas are designated and
established as parking areas to be leased on a monthly basis. Enforcement
of the monthly parking stalls shall be between 7:00 a.m. and 6:00 p.m.
except as otherwise provided herein.
(1) Algoma Boulevard Lot; the westerly row of the second aisle and those
stalls facing Brown Street.
(2) North Main Street /400 Block West Parking Lot; the stalls on the
perimeter of the lot bordering Division Street except the four (4) most
southerly stalls and the stalls on the perimeter of lot bordering Algoma
Boulevard and the second east /west aisle south of Church Avenue.
(3) Recreational Gym Lot, between 7:00 a.m. and 4:00 p.m., except for the
reserved spaces on the south end of the Lot.
(4) State Street Lot; the most southerly row and the southern row of the
center aisle adjacent to State Street. The northern most row is
reserved.
(5) West 9th Avenue Lot; the northerly most stall of the southerly most
section on the east side, and the four most northerly stalls in the
western row.
(6) West 8th Avenue Lot; the three easternmost rows of stalls.
(D) Discounted Daytime Permits The following described parking areas are
designated and established as parking areas to be leased on a monthly
basis.
(1) High Avenue Lot, the east /west center row and the 23 stalls adjacent
to Pearl Avenue.

(E) Leased Space Fees. The Common Council shall establish leased space
fees for parking spaces leased under this section annually by March 1. These prices
shall be valid until the last day of February of the following year.
SECTION 2. That Section 27 -51 of the Oshkosh Municipal Code be repealed and
recreated as follows.
SECTION 27 -51 WEST TENTH AVENUE PARKING LOT
The Tenth Avenue Lot shall be four (4) hour parking, Monday through Friday
between 7:00 a.m. and 6:00 p.m. except for the western row of the center aisle.
(A) The western row of the center aisle of this lot shall be monthly
parking by permit between 7:00 a.m. and 6:00 p.m. The Common Council
shall establish permit fees for these spaces annually by March 1. These
prices shall be valid until the last day of February of the following year.
SECTION 3. This ordinance shall be in full force and effect from and after its
passage, publication, and placement of the appropriate signage.
SECTION 4. Publication Notice. Please take notice that the City of Oshkosh enacted
ordinance #09 -347 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
REPEALING AND RECREATING SECTIONS 27 -49 AND 27 -51 OF THE OSHKOSH
MUNICIPAL CODE PERTAINING TO LEASED PARKING STALLS AND WEST TENTH
AVENUE PARKING LOT on August 25, 2009. The ordinance repeals the current
provisions related to permit and leased parking fees and provides for the establishment
of a parking permit rate schedule annually by the Common Council.

RE: EXPLANATION OF REPEAL OF CURRENT PROVISIONS RELATED
TO PERMIT PARKING FEES AND PROVIDING FOR
ESTABLISHMENT OF PARKING PERMIT RATE SCHEDULE
The Common Council, at its July 14, 2009 meeting, approved recreation of Section 27 -46 of the
municipal code. Section 27 -46(C) states that.the Council will approve a schedule for parking
fees:
"Permit prices The Common Council shall establish permit prices annually by
March 1. These prices shall be valid until the last day of February of the following
year."
Such a parking permit rate schedule would be adopted by resolution. The purpose of this
ordinance is to change the other parking permit and leased space programs so that their rates are
established in a similar manner. This ordinance does not change any specific fees for parking
spaces.
A resolution with a rate schedule will be presented to the Common Council at its August 25;
2009 meeting. The forthcoming rate schedule will match the rates currently in the municipal
code.
Section 1: Section 27 -49 Leased Parking Stalls
This section recreates Section 27 -49 of the municipal code. The entirety of this section of code is
included in the ordinance for clarity; however, the changes are relatively minor. The primary
changes involve removing every clause that refers to specific rates for various leased spaces..
These changes are as follows:
• The removal of "at the rate of Thirty Dollars ($30.00) per month" from subsection (A).
• The removal of "at the rate of Thirty Dollars ($30.00) per month" from subsection (B).
• The removal of "at the rate of Twenty Dollars ($20.00) per month" from subsection (C).
• The removal of "Each monthly permit shall cost $20.00 per month, or fraction thereof, for

Explanation of Repeal of Current Provisions Related to Permit Parking Fees
and Providing for Establishment of Parking Permit Rate Schedule
1 -20 permits purchased. For greater than 20 permits purchased by a single source, each
permit after the twentieth shall cost $14.00 per month or fraction thereof. Each annual
permit shall cost $210.00 per year for 1 -20 permits purchased. For greater than 20 permits
purchased by a single source, each permit after the twentieth shall cost $150.00 per year."

A new subsection (E) is created which copies the provisions of Section 27- 46(C), whereby the
Common Council establishes parking rates on an annual basis, to go into effect on March 1
through the last day of February of the following year.
Section 2: Section 27 -51 West 10 Avenue Parkiniz Lot
This section of the ordinance recreates Section 27 -51. The primary change is to incorporate
similar language from Section 27- 46(C), whereby the Common Council establishes parking rates
on an annual basis, to go into effect on March 1 through the last day of February of the following
year.
