VERNON STREET AND IN VARIOUS MUNICIPAL PARKING AREAS INITIATED BY: TRANSPORTATION DEPARTMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27- 23(A-3), 27- 23(A -11), 27 -45 AND 27 -48 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING METER REGULATIONS, PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, TWO HOUR METERED CITY OWNED PARKING LOTS, AND TEN HOUR METERED CITY OWNED PARKING LOTS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27- 23(A -3)(D) of the Oshkosh Municipal Code pertaining to ten hour metered streets is hereby repealed. SECTION 2. That Section 27- 23(A -3)(E) of the Oshkosh Municipal Code pertaining to thirty minute meters is hereby repealed. SECTION 3. That Section 27- 23(A -3)(F) of the Oshkosh Municipal Code pertaining to fifteen minute meters is hereby repealed. SECTION 4. That Section 27- 23(A -11) of the Oshkosh Municipal Code pertaining to parking regulations on designated streets and alleys is hereby amended as follows: A -11 PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS ALGOMA BOULEVARD Add Thereto 15- minute parking, east side, from 588 feet north of Elmwood Avenue to 646 feet north of Elmwood Avenue. Add Thereto 15- minute parking, east side, from 1,187 feet north of Elmwood Avenue to 1,251 feet north of Elmwood Avenue. Add Thereto 15- minute parking, east side, from 715 feet south of Woodland Avenue to 839 feet south of Woodland Avenue. AUGUST 11, 2009 09 -317 ORDINANCE FIRST READING CONT'D BROWN STREET Add Thereto 2 -hour parking, east side, from Algoma Boulevard to High Avenue. ELMWOOD AVENUE Add Thereto 30- minute parking, east side, from Irving Avenue to 207 feet north of Irving Avenue. IRVING AVENUE Add Thereto 30- minute parking, south side, from 132 feet east of Elmwood Avenue to 216 feet east of Elmwood Avenue. LIBRARY LOT Delete Therefrom 90- minute parking except the northerly and easterly row of metered stalls, between the hours of 9:00 a.m. to 6:00 p.m. daily, except on Sundays and New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day. Add Thereto 90- minute parking except the perimeter stalls on the northern and eastern edges of the lot, between the hours of 9:00 a.m. to 6:00 p.m. daily, except on Sundays and holidays. OTTER EAST PARKING LOT Add Thereto 90- minute parking, the four (4) most northwesterly stalls, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. WEST 9TH AVENUE PARKING LOT Add Thereto 90- minute parking, except the northerly most stall of the southern section of the east side, and the four most northerly stalls in the western row, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. AUGUST 11, 2009 09 -317 ORDINANCE FIRST READING CONT'D SECTION 5. That Section 27 -45 of the Oshkosh Municipal Code pertaining to two (2) hour metered city owned parking lot be repealed. SECTION 6. That Section 27 -48 of the Oshkosh Municipal Code pertaining to ten hour metered city owned parking lots be repealed and recreated as follows: SECTION 27 -48 PERMIT PARKING AREAS The following areas are reserved for permit parking, as defined in Section 27 -46, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. (A) City -Owned Parking Lots (1) North Main Street /400 Block West Parking Lot; the perimeter stalls bordering Church Avenue, the four (4) most southerly stalls on the perimeter of the lot bordering Division Street, the two (2) most easterly stalls in the fourth east/west aisle south of Church Avenue, the four (4) most northwesterly stalls in the north /south aisle, and the five (5) stalls in the southeast corner facing towards Main Street, and the three (3) most southern stalls in the far west north /south row located adjacent to Algoma Boulevard. (2) State Street Parking Lot, the four rows north of Waugoo Avenue in the eastern section of the lot, and the northern row of the center aisle adjacent to State Street. (3) Jefferson Lot, the twenty (20) most southerly stalls bordering Jefferson Street, the east section of the middle aisle and the northern section of the most western row. (4) Ceape Lot. (5) Otter East Lot, excepting therefrom the two most southwesterly stalls, and the four (4) most northwesterly stalls. (6) The Public Library Lot; the perimeter stalls on the northern edge of the lot, and the thirteen (13) most northerly stalls on the perimeter of the lot bordering Mt. Vernon Street. (7) The Pearl Avenue Lot, except the easterly row of stalls. (8) High Avenue Lot, except the east /west center row and the twenty - three (23) stalls adjacent to Pearl Avenue. Vernon Street, west side, from 215 feet north of Washington Avenue to 235 feet north of Washington Avenue Mt. Vernon Street, west side, from 304 feet north of Washington Avenue to 425 feet north of Washington Avenue SECTION 7. This ordinance shall be in full force and effect from and after its passage, publication, and placement of the appropriate signage. SECTION 8. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #09 -XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27- 23(A -3), 27- 23(A -11), 27 -45 AND 27 -48 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING METER REGULATIONS, PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, TWO HOUR METERED CITY OWNED PARKING LOTS, AND TEN HOUR METERED CITY OWNED PARKING LOTS), on August 25, 2009. The ordinance pertains to parking regulations changes on Algoma Boulevard, Brown Street, Elmwood Avenue, Irving Avenue, Jefferson Street, Mt. Vernon Street, and in various municipal parking areas. Section l: Section 27- 23(A -3)(D) Ten Hour Metered Streets This item is following up on the Commission's resolution at its April 8 meeting, subsequently affirmed by the Common Council at its April 14 meeting, supporting the removal of parking meters. Brown Street between Aroma Boulevard and High Avenue This section of street has currently eighteen (18) 10 -hour meters with relatively little usage. (PASSED BY PARKING UTILITY COMMISSION 3 -0) Jefferson Avenue, east side, from Washington Avenue to Merritt Avenue Currently, there are six (6) 10 -hour parking meters, which are heavily used (most likely by monthly permit holders). These spaces are kitty - corner from the Washington Avenue lot, which is designated exclusively as 90- minute parking. Replacing the meters with a permit parking designation should meet the needs of long -term parking without sacrificing the availability of short-term parking needs in the area. Vernon Street, west side, from Washington Avenue to Merritt Avenue Currently, there are six (6) 10 -hour parking meters, which are heavily used primarily by Library employees. Because of parking constraints in the Library lot, it makes sense to continue to support the use of these meters by employees, by designating these spaces for permit parking. (PASSED BY PARKING UTILITY COMMISSION 4 -0) City of Oshkosh — Department of Transportation Explanation of Parking Regulations Changes Section 2: Section 27- 23(A -3)(E) Thirty minute meters This item is following up on the Commission's resolution at its April 8 meeting, subsequently affirmed by the Common Council at its April 14 meeting, supporting the removal of parking meters. This item includes removal of a total of 12 short-term meters in the University area and four (4) meters in the Otter East Lot. Elmwood Avenue, east side, from Irving Avenue to 207 feet north of Irving Avenue (eight [81 30- minute meters) and Irving Avenue, south side, from 132 feet east of Elmwood Avenue to 216 feet east of Elmwood Avenue (four [4] 30- minute meters) These metered areas are most directly related to activities at the University. University officials have expressed their support for removal of these meters, provided that the parking can be time - limited in a similar fashion with signage and supporting ordinances. These meters are the most lucrative of the City's parking meters, accounting for 34 percent of the meter revenue for the parking utility in 2008 ($5,642 out of $16,375). This is due to the high demand for parking in the University area, and the lack of ability to use permits at such spaces. However, keeping any parking meters will result in certain costs associated with meter maintenance and operation. In addition, I believe that parking in these areas can be managed effectively without meters. (PASSED BY PARKING UTILITY COMMISSION 3 -0) Otter East, the four (4) most northwesterly stalls The 30- minute meters are seldom used. The existing 30- minute meters are the only off - street spaces of this type in the downtown area. For consistency, I recommend that these spaces be converted to 90- minute stalls. (PASSED BY PARKING UTILITY COMMISSION 4 -0) Section 3: Section 27- 23(A -3)(F) Fifteen minute meters This item is following up on the Commission's resolution at its April 8 meeting, subsequently affirmed by the Common Council at its April 14 meeting, supporting the removal of parking meters. This item includes removal of a total of 10 short-term meters in the University area on various portions of Algoma Boulevard: Algoma Boulevard, east side, from 588 feet north of Elmwood Avenue to 646 feet north of Elmwood Avenue (three [3] 15- minute meters). Algoma Boulevard, 15- minute parking east side from 715 feet south of Woodland Avenue to 839 feet south of Woodland Avenue. Elmwood Avenue, 30- minute parking, east side from Irving Avenue to 207 feet north of Irving Avenue. Irving Avenue, 30- minute parking, south side from 132 feet east of Elmwood Avenue to 216 feet east of Elmwood Avenue. Sections 2 and 3 of the ordinance would remove meters from these streets. In the event that meters are removed, it is necessary to have alternate on- street parking regulations in place. This section establishes time - restricted parking consistent with the meters. I have talked with University officials and they support this request. While the proposed parking time limits in these areas are short, they are not unprecedented. There is currently a 5- minute parking zone on High Avenue 10- minute parking zones on Algoma Boulevard, Nebraska Street and Washington Avenue, at least four 15- minute parking zones and over a dozen 30- minute on- street parking zones elsewhere in the city. (PASSED BY TRAFFIC REVIEW ADVISORY BOARD 6 -0) Brown Street, 2 -hour parkin:;, east side, from Algoma Boulevard to High Avenue Section 1 of the ordinance would remove meters from both sides of Brown Street. To be consistent with other on- street parking in the, Business Improvement District, it is recommended that these spaces be converted to 2 -hour parking. Library Lot, 90- minute parking designations Otter East Lot, 90- minute parking designations If the Council passes this ordinance, parking meters will no longer be present in these lots. These changes would alter the ordinance language so that meters are no longer referred to. The location and number of 90- minute spaces within each lot is preserved. City of Oshkosh — Department of Transportation Explanation of Parking Regulations Changes West 9th Avenue Lot, 90- minute parking designations This item is following up on the Commission's resolution at its April 8 meeting, subsequently affirmed by the Common Council at its April 14 meeting, supporting the removal of parking meters. The current 2 -hour meters cannot be used by monthly permit holders. Therefore, conversion of these spaces to 90- minute non - metered use would have no effect on employees or residents who need longer -term parking. The, utilization rate for these spaces (as measured in last year's utilization study) is around 20 percent. I propose that these spaces be converted to 90- minute unmetered parking. This would be consistent with the 90- minute parking designation that is normally used for short-term parking in the City's other municipal parking lots. Currently, there is 2 -hour free on- street parking on the west side of Oregon Street in this area. The duration of this parking will not change. (PASSED BY PARKING UTILITY COMMISSION 4 -0) Section 5: Section 27 -45 Two (2) Hour Metered City Owned Parking Lots This item is following up on the Commission's resolution at its April 8 meeting, subsequently affirmed by the Common Council at its April 14 meeting, supporting the removal of parking meters. Section 4 of the ordinance would remove the 2 -hour meters from the West 9 1h Avenue parking lot. As these are the only 2 -hour meters under the City's control, there is no longer any need for this section in the municipal code. Section 6: Section 27 -48 Permit Parking Areas This item is following up on the Commission's resolution at its April 8 meeting, subsequently affirmed by the Common Council at its April 14 meeting, supporting the removal of parking meters. Section 27 -48 of the municipal code currently defines specific stalls and parking lots where parking is governed through 10 -hour meters. The proposed recreation of this section of the municipal code would take those areas governed by meters and stipulate that they would be designated as permit parking. Per a Common Council ordinance passed at its July 14 meeting, annual, monthly or daily parking permits could be used in these spaces. (A) City -Owned Parking Lots The sections of text under this sub -head essentially replicate sections from the existing ordinance. (1) North Main Street 1400 Block West Parking Lot; the perimeter stalls bordering Church Avenue, the four (4) most southerly stalls on .the perimeter of the lot bordering Division Street, the two (2) most easterly stalls in the fourth east /west aisle south of Church Avenue, the four (4) most northwesterly stalls in the /south aisle, and the five (S) stalls in the southeast corner facing towards Main Street, and the three (3) most southern stalls in the far west north/south row located adjacent to Algoma Boulevard. This replicates existing Section 27- 48(A). (2) State Street Parking Lot, the four rows north of Waugoo Avenue in the eastern section of the lot, and the northern row of the center aisle adjacent to State Street. This replicates existing Section 27- 48(B). This is essentially the same as existing Section 27- 48(G), with some language being changed to reflect that there will no longer be metered spaces in this lot. (8) High Avenue Lot, except the east /west center row and the twenty -three (23) stalls adjacent to Pearl Avenue. This replicates existing Section 27- 48(I). (9) Otter Lot, the southern row. This replicates existing Section 27- 48(J). (B) Municipal Streets and Alleys Brown Street, west side, from 45 feet south of Algoma Boulevard to High Avenue This follows from Sections 1 and 3 of this ordinance, where the current metered parking would be replaced by permit parking on the west side of the street, and 2 -hour free parking on the east side of the street. Preserving permit parking on at least one side of the street seems appropriate given that there is some usage of the long -term meters on this street. Jefferson Street, east side, from 39 feet north of Washington Avenue to 163 feet north of Washington Avenue This follows from Section 1 of this ordinance, where 10 -hour on- street meters would be removed from this section of street. The heavy utilization of these meters by permit- holders makes it logical to convert these to permit parking. (PASSED BY PARKING UTILITY COMMISSION 4 -0) Mt.
