PLAN COMMISSION RECOMMENDATION: Approved PARKS ADVISORY BOARD RECOMMENDATION: Approved WHEREAS, Midwest Real Estate Development Co., Inc. has generously offered to donate land to the City of Oshkosh on the east side of South Westhaven Drive, adjacent to Abbey Park, for park or recreational purposes; and WHEREAS, the City of Oshkosh expresses its utmost gratitude and appreciation to Midwest Real Estate Development co., Inc. for its generous donation. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts said land, per the attached, for park or recreational purposes, and the proper City officials are hereby authorized and directed to execute any and all documents necessary for purposes of same. BE IT FURTHER RESOLVED that said land is accepted and made part of Abbey Park. OfHOTH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Jackson Kinn I---- Director of Co unity Development DATE: July 23, 2009 RE: Approve Accepting Land on the East Side of South Westhaven Drive, South of 2485 Westhaven Court for Park Purposes BACKGROUND Midwest Real Estate Development Co. wishes to donate a 1.56 acre parcel on the east side of South Westhaven Drive to the City for park and recreational purposes. The lot is part of the Country Side Estates Subdivision, which was created in 1990. Since the subdivision's creation, the owner has been unsuccessful in their attempt to sell the lot for residential purposes and now would like to donate the lot to the City for park purposes. ANALYSIS The property is located adjacent to Abbey Park and is in the floodplain and floodway and contains significant areas of wetlands along Sawyer Creek making it difficult to develop. Accepting the lot for expansion of Abbey Park would not appear detrimental to the residential land uses in the immediate area. The Parks Director has reviewed this request and if approved, would recommend leaving the property in its natural state for the time being as a conservation area. FISCAL IMPACT If accepted by the City, the property would no longer be on the tax rolls. Based on an assessed value of $6,200, taxes are minimal at $150 which should not adversely affect the overall tax base of the City and there is increased benefit to the City of expanding existing park and recreational facilities which is a recommendation in the City's Comprehensive Plan. RECOMMENDATION Staff recommended approval and at its July 7, 2009 meeting, the Plan Commission approved accepting the property for park purposes. The Parks Advisory Board also unanimously approved of the land acceptance at its July 13, 2009 meeting. Approved, City Manager ITEM: ACCEPT LAND DEDICATION FOR 1.56 ACRE PARCEL OF LAND (LOT 16 COUNTRY SIDE ESTATES) LOCATED ALONG WESTHAVEN DRIVE SOUTH OF 2485 WESTHAVEN COURT Plan Commission meeting of July 7, 2009 GENERAL INFORMATION Applicant /Owner: Midwest Real Estate Development Co., Inc. Actions Requested: The applicant requests the City to accept the dedication of a 1.56 acre parcel of land located along Westhaven Drive. Property Location and Background Information: The subject property was created as part of the Country Side Estates subdivision that was approved in 1990. Country Side Estates contains 16 buildable lots lying on the east side of Westhaven Drive starting at Sawyer Creek in the south and ending at Witzel Avenue on the north. The 15 other lots have long been developed with single family homes. The subject property is entirely located in the floodplain (100 year and floodway) and contains significant areas of wetlands along Sawyer Creek. Midwest has consistently tried to sell the property since its creation, however, the presence of the floodplain and the difficulty of developing in the floodplain and ongoing insurance requirements, have not generated much interest and Midwest is proposing to "gift" the land to the City for park purposes. The subject property is located in residential area with single family uses to the north, south, and east and multiple family uses (apartment) to the west. Abbey Park, which is a neighborhood park, is located adjacent to the south across Sawyer Creek and contains approximately 9 acres located on both sides (5 on west, 4 on east) of Westhaven Drive. The Parks Director has looked at the land and feels that leaving it in a natural state for some type of future conservation area or part of a broader nature trail would be the best use of the land as there are improved park facilities to the south. Given the difficulties imposed by the natural conditions (floodplain and wetlands) and the fact that the land has not been developed since the subdivision creation in 1990, staff feels accepting the land for park purposes is appropriate. RECOMMENDATION /CONDITIONS The Department of Community Development recommends acceptance of the land as requested. The Plan Commission approved of the land acceptance as requested. The following is the Plan Commission's discussion on this item. Mr. Burich stated this lot was created in 1990 as part of the Country Side Estates Subdivision. The owner has not been able to sell the lot due to floodplain and wetland issues and now would like to donate the lot to the City for expansion of Abbey Park. Westhaven Drive. This is the last parcel remaining however, with the floodplain issues we have been unsuccessful in our attempt to develop or sell it. With our Country Park Apartments and the small city park located across the street from the lot we felt it could be better utilized by the city for an additional park. With that said, we seek the City's approval for accepting the lot as a donation from our company. I have enclosed an appraisal that I had done in March by Kargus Appraisals that shows a value of $90,000.00.
