PURPOSE: APPROVE GRANTING UTILITY EASEMENT TO WISCONSIN
PUBLIC SERVICE ETAL ON NORTH SIDE OF MARION ROAD,
WEST OF JACKSON STREET WITHIN THE MARION ROAD/
PEARL AVENUE REDEVELOPMENT PROJECT AREA

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to grant a utility easement to
Wisconsin Public Service, etal, on the north side of Marion Road, west of Jackson
Street, per the attached, and to execute any and all documents necessary for purposes
of same.

BACKGROUND /SUBJECT PROPERTY
The proposed easement is to be located along the north right -of -way line of Marion Road
approximately 315 to 430 feet west of Jackson Street. This easement will be filling a void where
plans originally depicted a street separating parcels H and I. There are no longer any plans for
development of a street internal to the redevelopment area north of Marion Road between
Jackson Street and River Drive.
The easement will be ten feet wide and will accommodate service providers such as Time
Warner Cable, AT &T and Wisconsin Public Service.
ANALYSIS
The proposed utility easement is needed to accommodate undergrounding utilities in the
redevelopment district which has been a goal in various city plans and is done as a beautification
effort where possible. The Department of Public Works has reviewed the proposed easement
and does not have any concerns with this request.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its July 21, 2009 meeting.

GENERAL INFORMATION

Action Requested:
City Administration requests the Plan Commission grant a public utility easement in the Marion Road/Pearl
Avenue Redevelopment Area. The easement is needed to accommodate the undergrounding of utilities for
redevelopment parcels H and I.
Applicable Ordinance Provisions: N/A
Property Location and Type /Analysis:
The proposed easement is to be located along the north right -of -way line of Marion Road approximately
315 to 430 feet west of Jackson Street. This easement will be filling a void where plans originally depicted
a street separating parcels H and I. The easement will be ten feet wide and will accommodate service
providers such as Time Warner Cable, AT &T and Wisconsin Public Service.
The proposed utility easement is needed to accommodate undergrounding utilities in the redevelopment
district. Undergrounding of utilities has been a recommended goal in various city plans and reports
primarily as a beautification measure. The easement is being created along the street edges of
redevelopment parcels in the district and is not inconsistent with City redevelopment plans for the area.
The Department of Public Works has reviewed the proposed easement and does not have any concerns with
this request.
After review by the Plan Commission and approval by the Common Council, the easement will be recorded
at the Winnebago County Register of Deeds.
RECOMMENDATION /CONDITION S
The Department of Community Development recommends approval of granting the proposed utility
easement as requested.
The Plan Commission approved of the utility easement as requested. The following is the Plan
Commission's discussion on this item.
There was no discussion on this item.
Motion by Nollenberger to approve the utility easement for the undergrounding of utilities for
property located on parcels H and I in the Marion Road/Pearl Avenue redevelopment area as
requested.
Seconded by Propp. Motion carried 6 -0.
