PURPOSE: AUTHORIZE JURISDICTIONAL OFFERS FOR THE JACKSON
STREET / MURDOCK AVENUE INTERSECTION IMPROVEMENT
PROJECT IN THE AMOUNT OF $41,400.00
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Common Council of the City of Oshkosh has determined it is
necessary to acquire certain land for right -of -way purposes and to obtain temporary
easements for the improvement of the intersection of Jackson Street and Murdock Avenue
pursuant to the authority granted under sections 32.05, 32.06, 32.07 and 62.22 of the
Wisconsin Statutes.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to issue
Jurisdictional Offers in the amount shown to each property owner for the following
properties:
Parcel 2: $26,100.00 ; Laser Investments, LLC, and First National
Bank — Fox Valley, and First State Bank; fee & temporary easement
Parcel 18: $6,150.00 ; Nathan C. Mecklenberg and Miranda M.
Mecklenberg, and Universal Mortgage Corporation ; fee & temporary
easement
Parcel 23: $9,125.00 ; 215 W. Murdock Ave, LLC, and Associated
Bank National Association, and US Bank National Association ; fee &
temporary easement
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Approval of Jurisdictional Offers for the Jackson Street/Murdock Avenue Intersection
Improvement Project
BACKGROUND
The Wisconsin Department of Transportation (WisDOT) has scheduled the reconstruction of the Jackson
Street/Murdock Avenue intersection as a roundabout in 2010. This project required the acquisition of the KFC
Restaurant and it also requires the acquisition of small areas for new strip right -of -way (ROW) or temporary
easements (which facilitate the reconstruction of the public sidewalk or private driveways) at eighteen locations.
ANALYSIS
Our ROW acquisition consultant has reached agreements with twelve of the property owners and he anticipates
obtaining agreements with three additional owners. The owners of the remaining three parcels have indicated
that they are not willing to agree to sell the required land or easement rights. The following information pertains
to these properties:

FISCAL IMPACT
The State /Municipal Agreement for this project established allocation of costs as 75% WisDOT /25% City for the
ROW acquisitions. Funding for the City portion is included in the Capital Improvement Program and the total
costs for all acquisitions are within the budget limits.
RECOMMENDATION
I recommend approval of the jurisdictional offers. This will allow for the acquisition of the required ROW to meet
the bid schedule of the WisDOT.
