Summary of July 1S 2009 Meeting

Meeting commenced at approximately 2:30 PM with a brief review of the previous meeting
Steve Gohde, Asst. Director of Public Works, attended to discuss the concept of requiring Sanitary Sewer
Laterals to be abandoned at the main when buildings are razed. Public Works has identified this topic as
a source of storm water infiltration into the sanitary sewer system and is seeking input on a potential
requirement to have sewer laterals of certain types of construction be abandoned at the main vs. at the
property line (which is the present requirement.) With some older materials (concrete, clay) and with
some older installations not being tapped in a water tight manner, Public Works has identified it may be
appropriate to require abandonment at the main to eliminate sources of storm water infiltration.
Discussion identified questions /concerns for Public Works to consider in developing this requirement. It
is planned to have a proposal on this topic for review and consideration at an upcoming committee
meeting.
The committee reviewed an updated summary of identified code issues to address.
The committee reviewed a summary of codes and approaches of other communities. It was identified all
communities except one adopt the state UDC to apply to additions and alterations to pre -UDC houses.
The summary also identified that the City of Oshkosh is the only community to adopt amendments and/or
exceptions to the state UDC to accommodate common pre- existing construction conditions that do not
mesh with the modern requirements of the UDC.
In his research, Allyn Dannhoff reported that most communities use inspector discretion to determine if
compliance with various provisions of the UDC will be required. Allyn explained this can lead to
inconsistent application and enforcement. Allyn further explained it is more desirable to promote
uniformity, which is an intent of any code. When situations are discovered where compliance with a code
provision is not readily attainable, this then becomes the role of the Board of Appeals to consider
proposed deviations from an adopted code. When variance situations are encountered, staff also then
reviews them for consideration for proposed code amendments, which is how the present exceptions were
created.
The committee was informed there would not be an August meeting to give staff a chance to work on the
Summary of Indentified Code Issues. The next meeting will be September 2 nd
