Roskom, Principal Planner; Patricia Wendorf, Recording Secretary Vice Chairman Krueger called the meeting to order. Roll call was taken and a quorum declared present. Motion by Husman for approval of the November 9, 1994 minutes as distributed; Seconded by Roehlig. Motion carried 4 -0. Vice Chairman Krueger stated that 4 affirmative votes are required to approve a variance; if 3 affirmative votes, the item will be laid over; Tess than 3 affirmative votes, the item is denied. He also explained the process for obtaining building permits. if tb riance is approved, or the appeal process, if the variance is denied. I: 345 SARATOGA AVENUE eff Gropp, owner; Mary Boss, applicant The owner applicant are requesting a variance to convert a single family dwelling into a two family dwelling with a 14± ft front yard setback; whereas Section 30 -16(B) Standards of the R -2 Two Family Residence Section of the City of Oshkosh Zoning Ordinance requires a 25 ft. minimum front yard setback for two family dwellings. Mary Boss wished to correct the record and stated that the above referenced property is not for sale. Mr. Roskom stated the reference in the staff report as to the property being for sale was in error. He then reiterated statements made in the staff report as to the history of the structure. Ms. Boss stated that the property does not meet the front yard setback, but does meet the all other zoning /setback requirements. She also stated the neighborhood has mixed uses, but a good portion is utilized as two family residences. She then distributed pictures of adjacent properties (said pictures not made a part of these minutes) and noted that the east property is actually closer to the street than the site in question. She also distributed a zoning matrix of the surrounding residences (said matrix not made a part of these minutes). She stated the property owner needs to fix a couple of things in order to meed the Code, i.e. building a stairway to the second story, removing electrical service, etc. Mr. Roehlig stated that this request fits in with the character of the whole neighborhood and both sides of the street. Motion by Roehlig for approval of a variance to convert a single family dwelling into a two family dwelling with a 14± ft. front yard setback. Seconded by Husman. Motion carried 4 -0. As to the Findings of Fact, Mr. Roehlig stated that the building is in keeping with the character of the neighborhood. There would be no adverse effects on surrounding properties and the hardship was not self- created. Mr. Krueger added that the present owner bought the structure under the guise that it was a duplex. II: 821 EVANS STREET Lee Di- Salvo, owner; Marshall G. Johnson, applicant The applicant is requesting a variance to construct an addition to a single family dwelling with a 21± ft front yard setback; whereas Section 30 -16(B) Standards of the R -2 Two Family Residence Section of the City of Oshkosh Zoning Ordinance requires a 25 ft. minimum front yard setback for dwellings. Mr. Johnson gave a brief history of the property in question and reiterated the variance request. He stated at present there is no landing available for the owner to maneuver or turn around on and if the stairs go directly to the door, which is a safety hazard. The owner has an arthritic condition and cannot use the door as it is presently. The owner would prefer to have the stairs come off to the side of the residence. There are a number of shrubs and trees that will have to be removed if the deck is constructed off to the side. The deck itself is not an issue, it is the stairs that exceed the dimensions as to setback. Mr. Johnson discussed the proposed project with the adjacent
