Engineering Services during Construction CH2M HILL will provide professional services, including managing site activities, administering the contract for construction, monitoring the contractor's performance, responding to technical submittals, and closing out the contract for construction. The additional construction phase services are described below and summarized in Table 2 -1. Project Management and Documentation To assist the City, CH2M HILL will retain subconsultants STS /AECOM (558 North Main Street, Oshkosh, WI 54901) and Kaempfer & Associates, Inc. (650 East Jackson Street, Oconto Falls, WI 54154) to deliver the Services during Construction scope of services. CH2M HILL will manage the subconsultants and provide monthly progress reports on engineering activities, schedule, and budget to the City. CH2M HILL will establish and maintain, with the City, a system for managing, tracking, and storing relevant documents produced during construction and project closeout between the Contractor, the City, and CH2M HILL. CH2M HILL will implement logging and tracking procedures for all relevant correspondence and documents for the City's reference during construction. The construction information needed for compliance with the Safe Drinking Water Loan Program (SDWLP) will be included in the project documentation. The services required to prepare the construction documentation for submission to the SDWLP are not included in this scope of work. Following closeout of the, construction contract, CH2M HILL will provide the City with an organized set of project documents and records. Resident Project Representative Services CH2M HILL will retain STS /AECOM to provide Resident Project Representative (RPR) services on behalf of the Owner (the City of Oshkosh) during the construction of the Water Filtration Plant Modifications and Demolition Project. The responsibilities, authority, and limitations of the RPR are limited to those set forth in the Contract Documents and as described below. ATTACHMENT 1- SCOPE OF SERVICES AMENDMENT NO.3 CITY OF OSHKOSH WATER FILTRATION PLANT MODIFICATIONS AND DEMOLITION PROJECT Schedules The RPR will review and monitor the progress schedule, schedule of submittals, and schedule of values prepared and updated by the Contractor and consult with the Engineer concerning acceptability. Meetings The RPR will conduct or attend meetings with the Contractor, such as preconstruction conferences, progress meetings, work conferences, and other project- related meetings. The RPR will post the project file meeting minutes prepared by the Contractor, per the Contract Document, and meeting minutes prepared by the RPR. Liaison The RPR will provide liaison between the Engineer (CH2M HILL /Kaempfer) and the Contractor, working principally with the Contractor's superintendent to clarify the intent of the Contract Documents. The RPR will assist the Contractor when (1) the Contractor's operations affect the Owner's onsite operations and (2) additional details or information must be obtained from the Owner or the Engineer for proper execution of the Work. Submittals The RPR will receive the Contractor's submittals and forward them to the Engineer for examination. Attachment 2 is a detailed list of submittals to be reviewed by the RPR. Review of Work, Rejection of Defective Work, Inspections, and Tests The RPR will conduct onsite observations of the Work in progress to assist the Engineer in determining if the Work is in accordance with the Contract Documents. The RPR will inform the Engineer and the Contractor when the RPR believes that any Work is defective. The RPR will also advise the Engineer when the RPR believes that any of the following has occurred: • The Work will not produce a completed Project that conforms to the Contract Documents. • The Work will prejudice the integrity of the design concept of the completed Project as a functioning whole as indicated in the Contract Documents. • The RPR believes the Work should be uncovered for observation. • The Work requires special testing, inspection, or approval. The RPR will monitor that tests, equipment and systems startups, and operating and maintenance training are conducted in the presence of appropriate personnel, and that the Contractor maintains adequate records thereof. The RPR will observe, record, and report the appropriate details relative to the test procedures and startups to the Engineer. The RPR will accompany visiting inspectors representing the Engineer, the Owner, and public or other agencies having jurisdiction over the Project, and record the results of these inspections. ATTACHMENT 1 - SCOPE OF SERVICES AMENDMENT NO.3 CITY OF OSHKOSH WATER FILTRATION PLANT MODIFICATIONS AND DEMOLITION PROJECT Interpretation of Contract Documents The RPR will transmit Requests for Information (RFIs) or requested clarifications of the Contract Documents from the Contractor to the Engineer. The RPR will transmit the Engineer's clarifications and responses to RFIs to the Contractor. Modifications The RPR will consider and evaluate the Contractor's suggestions for modifications to Drawings or Specifications and provide recommendations to the Engineer. The RPR will transmit the Engineer's decisions to the Contractor. Records The RPR will maintain files for correspondence; conference records; submittals, including shop drawings and samples; reproductions of original Contract Documents, including all addendums, signed agreements, work change directives, change orders, field orders, additional drawings issued after the Effective Date of the Agreement, the Engineer's written s clarification and interpretations, progress reports, and other project- related documents. The RPR will keep a log recording pertinent site conditions, activities, decisions, and events. Reports The RPR will provide the Engineer with periodic progress reports of the Work and the Contractor's compliance with the Progress Schedule and Schedule of Submittals. The RPR will consult with the Engineer before scheduled tests and inspections or at the start of important phases of the Work. The RPR will also assist in drafting proposed change orders, work change directives, and field orders. Payment Requests RPR will review applications for payment with the Contractor for compliance and forward applications with recommendations to the Engineer, noting particularly the relationship of the payment requested to the schedule of values, work completed, and materials and equipment delivered at the site but not incorporated in the Work. Record Documents During the course of the Work, the RPR will monitor that redline drawings and other site documentation, critical to preparing representative record drawings at construction completion, are maintained by the Contractor. The RPR and the Engineer will review these documents before the Owner makes the final payment to the Contractor. Completion Milestones The RPR will submit a list of items requiring completion or correction at substantial completion to the Engineer and the Owner. The RPR will conduct a final inspection with the Engineer, the Owner, and the Contractor and notify the Contractor in writing of all Work found to be incomplete or defective. ATTACHMENT 1 - SCOPE OF SERVICES AMENDMENT NO.3 CITY OF OSHKOSH WATER FILTRATION PLANT MODIFICATIONS AND DEMOLITION PROJECT Exclusions to Resident Project Representative Services The RPR will not: • Have authority to approve any deviation from the Contract Documents or substitution of materials or equipment, unless authorized by the Engineer • Undertake any responsibilities of the Contractor, the Subcontractors, or the Contractor's superintendent • Accept submittals from anyone other than the Contractor • Authorize the Owner to occupy the Project in whole or in part • Participate in specialized field or laboratory tests or inspections conducted by others, except as specifically authorized by the Engineer Construction Meetings In addition to the site visits included in the existing scope of work, CH2M HILL will participate in the following. City and City's Agents Team Chartering Meeting Before the preconstruction meeting, CH2M HILL will facilitate a team chartering meeting with the subcontractors and City staff. The purpose of the meeting is to discuss the procedures for communication, coordination, and documentation during construction and explain the roles and responsibilities of team members. The team will review the engineer's project- specific Health and Safety Plan, standard forms, and record keeping processes. Preconstruction Meeting CH2M HILL will coordinate and attend one preconstruction meeting with the Contractor to review the project communication, coordination, and other procedures and discuss the Contractor's general work plan and requirements for the project. Representatives of CH2M HILL and the subcontractors will attend the preconstruction meeting. CH2M HILL will take minutes or otherwise record the results of the meeting. Construction Site Progress Meetings CH2M HILL will attend 12 monthly meetings with the Contractor and the City to monitor progress and address issues in a timely manner. Representatives of CH2M HILL and the subcontractors will attend the monthly progress meetings. Construction progress meetings will be facilitated and documented by the Contractor. Additional Inspection of Work Additional specialty inspection of the Work will be conducted by CH2M HILL design leads for quality control purposes. The total estimated level of effort during construction for each Services During Construction task, including work already under contract, is shown in Table 2 -4. The terms and conditions of the contract executed by both parties April 20, 2007, and amended by both parties September 26, 2007 and April 22, 2008, are incorporated herein by reference.
