HomeMy WebLinkAbout09-243.docJUNE 23, 2009 09 -243 ORDINANCE FIRST READING (CARRIED PURPOSE: INITIATED BY: LOST LAID OVER WITHDRAWN ) CHANGE HOURS OF ENFORCEMENT FOR MONTHLY PARKING SPACES TRANSPORTATION DEPARTMENT (APPROVED BY PARKING UTILITY COMMISSION, 3 -0) A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27 -49, 27 -50 AND 27 -51 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO LEASED PARKING STALLS, WEST 8TH AVENUE PARKING LOT AND WEST TENTH AVENUE PARKING LOT. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27 -49 of the Oshkosh Municipal Code pertaining to monthly parking lot be repealed and recreated to read as follows: SECTION 27 -49 LEASED PARKING STALLS (A) Residential Permits within the BID district The following described parking areas are designated for vehicles with a valid residential parking permit and holders of such a permit shall be entitled to lease a designated stall at the rate of Thirty Dollars ($30.00) per month. Enforcement of the residential parking stalls shall be all days 24 hours. Residential parking permits shall be issued to residents within the BID district boundaries. (1) Division Street Lot: the 8 most northerly stalls bordering Division Street. (2) Jefferson Lot: the 4 most northerly stalls bordering Jefferson Street. (3) North Main Street /400 Block West Parking Lot; the fourth, fifth and sixth stalls north of Algoma Boulevard in the far west north /south row located adjacent to Algoma Boulevard. (4) Riverside Lot: The 20 stalls located in the northwest section, bordering the Convention Center property and Ceape Avenue. JUNE 23, 2009 09 -243 ORDINANCE FIRST READING CONT'D (B) Residential Permits outside the BID district The following described parking areas are designated for vehicles with a valid residential parking permit and holders of such a permit shall be entitled to lease a designated stall at the rate of Thirty Dollars ($30.00) per month. Enforcement of the residential parking stalls shall be all days 24 hours. (1) West 8th Avenue Lot: the two most northerly stalls on the west side of the middle row. (C) Daytime Permits The following described parking areas are designated and established as parking areas to be leased on a monthly basis at the rate of Twenty Dollars ($20.00) per month. Enforcement of the monthly parking stalls shall be between 7:00 a.m. and 6:00 p.m. except as otherwise provided herein. (1) Algoma Boulevard Lot; the westerly row of the second aisle and those stalls facing Brown Street. (2) North Main Street /400 Block West Parking Lot; the stalls on the perimeter of the lot bordering Division Street except the four (4) most southerly stalls and the stalls on the perimeter of lot bordering Algoma Boulevard and the second east /west aisle south of Church Avenue. (3) Recreational Gym Lot, between 7:00 a.m. and 4:00 p.m., except for the reserved spaces on the south end of the Lot. (4) State Street Lot; the most southerly row and the southern row of the center aisle adjacent to State Street. The northern most row is reserved. (5) West 9th Avenue Lot; the northerly most stall of the southerly most section on the east side, and the four most northerly stalls in the western row. (6) West 8th Avenue Lot; the three easternmost rows of stalls. JUNE 23, 2009 09 -243 ORDINANCE FIRST READING CONT'D (D) Discounted Daytime Permits The following described parking areas are designated and established as parking areas to be leased on a monthly basis. Each monthly permit shall cost $20.00 per month, or fraction thereof, for 1 -20 permits purchased. For greater than 20 permits purchased by a single source, each permit after the twentieth shall cost $14.00 per month or fraction thereof. Each annual permit shall cost $210.00 per year for 1 -20 permits purchased. For greater than 20 permits purchased by a single source, each permit after the twentieth shall cost $150.00 per year. (1) High Avenue Lot, the east /west center row and the 23 stalls adjacent to Pearl Avenue. SECTION 2. That Section 27 -50(B) of the Oshkosh Municipal Code be repealed. SECTION 3. That Section 27 -51 of the Oshkosh Municipal Code be repealed and recreated as follows. SECTION 27 -51 WEST TENTH AVENUE PARKING LOT The Tenth Avenue Lot shall be four (4) hour parking, Monday through Friday between 7:00 a.m. and 6:00 p.m. except for the western row of the center aisle, which shall be monthly parking between 7:00 a.m. and 6:00 p.m. at a fee of $12.00 per month. SECTION 4. This ordinance shall be in full force and effect from and after its passage, publication, and placement of the appropriate signage. SECTION 5. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #09 -XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27 -46, 27 -48(H) AND 27 -50 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO LEASED PARKING STALLS, WEST 8TH AVENUE PARKING LOT AND WEST TENTH AVENUE PARKING LOT on July 14, 2009. The ordinance changes the hours of enforcement of monthly leased parking stalls in municipal parking lots. Rohloff, City Manager FROM: Christopher Strong, Transportation Director DATE: June 17, 2009 RE: Explanation of Monthly Parking Hours of Enforcement Ordinance Changes SECTIONS 27 -49 THROUGH 27 -59 — MUNICIPAL PARKING LOT PROPOSAL TO CHANGE HOURS OF ENFORCEMENT FOR MONTHLY PARKING SPACES This is a request from a Commission member. Sections 27 -49 through 27 -51 of the municipal code establishes areas where monthly parking is permitted. The code states that monthly parking stalls are enforced between 6 AM and 6 PM, allowing for them to be used at other times of day. The time break at 6 AM makes it difficult for residents who park in these spaces, while it is earlier than might be needed for many monthly parking space users. A later time break, such as 7 or 8 AM, would seem to accommodate residents while not inconveniencing commuters. To minimize the risk of unintended consequences, I recommend that the ordinance be changed to 7 AM. I have included as an attachment recommended ordinance language which would replace the existing Section 27 -49, Section 27 -50(B) and Section 27 -51. It changes every appearance of 6 AM to 7 AM. It defines enforcement for monthly parking in the West 8 th Avenue lot as between 7 AM and 6 PM, matching other parking lots. It also reorganizes the existing language in order to improve clarity. PASSED BY PARKING UTILITY COMMISSION (3 -0).
