JUNE 23, 2009 09 -230 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE GRANTING AN EASEMENT TO AMERICAN TRANSMISSION COMPANY ON THE LAKESHORE MUNICIPAL GOLF COURSE PROPERTY ALONG USH 41 TO RELOCATE A TRANSMISSION LINE IN CONJUNCTION WITH THE USH 41 RECONSTRUCTION PROJECT INITIATED BY: AMERICAN TRANSMISSION COMPANY, PETITIONER PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant an electric transmission line easement to American Transmission Company LLC along USH 41 on the Lakeshore Municipal Golf Course property, per the attached, and to execute any and all documents necessary for purposes of same. 0 QIHKOlH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Jackson Ki ey = Director of Co nity Development DATE: June 18, 2009 RE: Approve Granting an Easement to American Transmission Company on the Lakeshore Municipal Golf Course Property along USH 41 to Relocate a Transmission Line in Conjunction with the USH 41 Reconstruction Project (Plan Commission Recommends Approval) BACKGROUND /SUBJECT PROPERTY The subject site is located along the west edge of Lakeshore Municipal Golf Course adjacent to the U.S. Highway 41 right -of -way. The request for the easement is to allow installation of an overhead transmission line as part of the U.S. Highway 41 expansion project. ANALYSIS The purpose of the easement request is for the relocation of ATC's existing transmission line. The proposed easement varies in width but averages about 40 feet wide with the transmission line to be located on the easement centerline. The easement will enable ATC to construct, operate and maintain the proposed transmission line. The Parks Board unanimously approved the easement request and does not have concerns that the proposed transmission line will interfere with the functionality of the golf course. The Department of Public Works has also reviewed and approved the proposed easement. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its June 16, 2009 meeting. Approved, City Manager ITEM: GRANT EASEMENT FOR ELECTRICAL TRANSMISSION LINES ON CITY -OWNED PROPERTY LOCATED AT 2175 PUNHOQUA STREET (LAKESHORE MUNICIPAL GOLF COURSE) Plan Commission meeting of June 16, 2009 GENERAL INFORMATION Petitioner: American Transmission Company, ILLC (ATC) Owner: City of Oshkosh Action Requested: American Transmission Company is requesting an electric transmission line easement for the installation of an overhead transmission line to be located at the west side of the subject property along U.S. Highway 41. Applicable Ordinance Provisions: N/A Property Location and Type /Analysis: The subject site is located along the west edge of Lakeshore Municipal Golf Course adjacent to the U.S. Highway 41 right -of -way. The purpose of the easement request is for the relocation of ATC's existing transmission line as part of the U.S. Highway 41 expansion project. The proposed easement varies in width but averages about 40 feet wide with the transmission line to be located on the easement centerline per the submitted site plan. The easement will enable ATC to construct, operate and maintain the proposed transmission line. The Department of Public Works has reviewed the proposed easement and does not have any concerns with this request. The Parks Board unanimously approved the easement request at its May 11 ` meeting and does not have concerns that the proposed transmission line will interfere with functionality of the golf course. After review by the Plan Commission and approval by the Common Council, the easement will be recorded at the Winnebago County Register of Deeds. RECOMMENDATION /CONDITIONS The Department of Community Development recommends approval of the granting of the proposed electric transmission line easement as requested. The Plan Commission approved of the easement as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the easement area and the location of the transmission line. He explained that both the Department of Public Works and the Parks Board had reviewed and approved of this request. Ben Hock, American Transmission Company, DePere, Wisconsin, stated that he was present if any commissioners had any questions regarding this request. Ms. Propp asked if the easement would interfere in any way with the golf course green. Mr. Hock replied that it would not and that the transmission line already existed on the site; however they were rebuilding the line and re- designing the layout which was based on input from the golf course. Motion by Propp to approve the easement for electrical transmission lines on Lakeshore Municipal Golf Course as requested. Seconded by Monte. Motion carried 9 -0.
