Allyn, regarding your correction notice dated 4-29-02. We are currently working with
James Larson Architect to be able to submit plans to you. We had reviewed these plans
several months ago, and thought we had requested some changes, unfortunately Jim
Larson thought we were going to get back to him. We simply forgot to follow up with
each other. I have been in contact with him and due to his schedule, we are requesting a
submit date to you of June 22nd. I hope this will work. We will take care of this. If
possible I would like to speak to you regarding a possible variance on one of the
stairways. We currently have an I I y," tread and 7 '/," rise, which I understand is not in

The submittal described above has been reviewed for confonnance with applicable Wisconsin AdmÎIústrative Codes
and Wisconsin Statutes. The submittal has been CONDmONAlL Y APPROVED. The owner, as defined in
chapter 101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements.
The following conditions shall be met during constnictionor installation and prior to occupancy or use:

COMM 51.03(6)(a)2. The plans indicate the mezzanine structural framing is of combustible materials. This
construction class requires the combustible framework to retain a I-hour fife-resistive rating. All the bearing
walls with only Yz " sheetrock will have to have additional sheetrock thickness added to get the required I hour
fife rating.

COMM 50.12 This review does not include heating, ventilating or air conditiouing. The owner should be
reminded that HV AC plans, calculations, a completed SBD-118 application fonn and appropriate fees are
required to.be submitted for review and approval prior to installation.
A copy of the approved plans, specifications and this letter shall be on-site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. All permits
required by the state or the local municipality shall be obtained prior to commencement of
co nstructi 0 n!ins tallati on! opera ti on.
In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should
conditions arise making them necessary for code compliance. AJ; per state stats 101.12(2), nothing in this review
shall relieve the designer of the responsibility for designing a safe building, structure, or component.

CITATION REQUEST

7-8 conversion of open storage mezzanines to enclosed office mezzanines without first securing
the required Building Permit
7-34 Failure to provide compliance with Stamped State Approved Plans for the conversion of
these open storage mezzanines to enclosed office mezzanines.
Brief history review:
As the result of a plan review performed in 1999 for an office mezzanine to be added to this
facility, it was learned that 2 other office mezzanines existed, both containing only one exit each
(versus the required 2 exits for occupied office mezzanines.) A review ofthe property file
revealed these mezzanines were originally approved as open storage mezzanines, for which a
single exit is compliant.
The plan approval letter (dated 4-27-99) for the submitted office mezzanine included a
requirement to submit plans for approval for these 2 office mezzanines. An additional notice was
sent on 11-30-00.
In the meantime I have kept in contact with James Larson, Architect, on this situation to
determine if this company was proceeding with getting plans approved. After determining that
no progress or insufficient progress was being made, I sent one last notice on April 29, 2002,
As a resnlt of this notice, I received a letter from Tom Cook, Production Manager for Service
Litho Print on May 30, 2002. (Over 30 days after the notice was sent.) In this letter Mr. Cook
assures me that this issue will be resolved.
In July, 2002 I received a copy of a plan review letter from the State Division of Safety &
Buildings. This review letter appears to be for the 2 mezzanines in question.
Since receipt ofthis plan review letter, I have had no further contact from Service Litho Print
advising when the corrections will be made.
Almost 3 years that have passed and it does not appear the owners of this company are taking this
seriously. In the meantime, they continue to occupy these mezzanines with only one point of
exiting when 2 are required.
Taking into consideration the amount of time that has transpired, no permits have been obtained
to make corrections and no contact has been made indicating any type of schedule for
compliance, I suggest issuance of citations retroactive to April 27, 1999, the date this was first
brought to their attention. If work commences on compliance shortly after citation issuance, I
would amend each citation to one week each.
