HomeMy WebLinkAbout09-170MAY 12, 2009 09 -170 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: INITIAL RESOLUTION FOR SPECIAL ASSESSMENTS FOR CONSTRUCTION OF DRIVEWAY ENTRANCE AT: A) 135 High Avenue B) 139 High Avenue C) 141 High Avenue INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following named streets, said public improvement to include the following: Drivewav Entrance. includina asahalt aavina. concrete curb and autter. concrete driveway approach and lightin 135 High Avenue 139 High Avenue 141 High Avenue 2. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 3. The assessments against any parcel may be paid according to the provisions of Section 25 -83 thru 25 -89 of the Oshkosh Municipal Code. 4. The Board of Public Works is directed to prepare a report consisting of: (a) Preliminary or final plans and specifications for said improvements. (b) An estimate of the entire cost of the proposed work or improvements. (c) An estimate as to each parcel of property within the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. MAY 12, 2009 09 -170 RESOLUTION CONT'D (3) The net amount of benefits over damages or the net amount of damages over benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 5. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.0703(7) of the Wisconsin Statutes. The hearing shall be held before the Common Council in the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 66.0703(7) of the Wisconsin Statutes. 6. The Board of Public Works and the proper City officials shall do all things necessary so as to complete the installation of utilities in said streets prior to the improvements, if necessary. 7. The installation of said street improvements shall be accomplished according to the provisions of Section 25 -3 thru 25 -11 of the Oshkosh Municipal Code. Gohde, Assistant Director of Public Works DATE: May 7, 2009 RE: Initial Resolution / Construction of Driveway Entrance BACKGROUND This resolution is the initial resolution for allowing the City to assess benefitting property owners for improvements completed by the City. The work will involve the creation of a driveway access from the City owned parking lot located, adjacent to the Bus Transfer Station, to the parking areas behind properties at 135, 139 and 141 High Ave. This access is needed due to the Oshkosh Community Credit Union's plan to reconstruct their parking lot and not allow access through their property to the properties on High Ave. The Common Council approved a land donation for the Credit Union to the City on March 10, 2009. The land allows each parcel to have access from the parking lot. ANALYSIS The resolution allows City Staff to proceed with design and estimates for the projects including preparing assessments for the abutting properties. A public hearing and final resolution need to be approved by the Council prior the assessments being levied on the properties. FISCAL IMPACT All costs associated with installation of the driveway entrance will be assessed to the benefitting property owners. RECOMMENDATIONS Staff recommends approval of the initial resolution.
