PURPOSE: APPROVE GRANTING PRIVILEGE IN STREET TO KEE
ARCHITECTURE AND UW- OSHKOSH TO INSTALL
GEOTHERMAL LINES UNDER WEST LINCOLN AVENUE,
NEAR MCKINLEY STREET

PLAN COMMISSION RECOMMENDATION: Approved w /conditions
WHEREAS, KEE Architecture requests the Common Council grant a privilege in
street to UW- Oshkosh and KEE Architecture, general contractor and other
subcontractors as may be required for the installation of geothermal lines within the
right -of -way of West Lincoln Avenue, near McKinley Street, per the attached; and
WHEREAS, upon final installation of the geothermal lines, UW- Oshkosh will
assume liability for said lines; and
WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege
in a right -of -way; and
WHEREAS, the Plan Commission has approved of this request with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to grant UW-
Oshkosh and KEE Architecture, general contractor and other subcontractors as may be
required, the privilege of installing geothermal lines within the right -of -way of West
Lincoln Avenue, near McKinley Street, per the attached, and upon completion of said
installation, UW- Oshkosh will assume liability for said lines within the right -of -way. Said
privilege is contingent upon the following:
1) The geothermal lines be installed in a manner that is approved by the
Department of Public Works with no modifications or changes in construction
procedure without prior approval by the Department of Public Works.
2) If no longer needed, the geothermal lines be properly abandoned and removed in
accordance with City standards and under the direction of Department of Public
Works.

3) Any problem which may arise as a result of the placement of the geothermal
lines be the responsibility of the petitioner, contractors and owner to correct in
coordination with Department of Public Works.
4) All appropriate permits be obtained prior to start of placement of the geothermal
lines.
5) The geothermal lines be modified or removed immediately upon the request of
the City.
6) The facility be part of and documented with Digger's Hotline system.
7) The petitioner and contractor(s) secure and submit to the City Clerk a separate
insurance policy which names the City as an additional insured with a minimum
coverage of $200,000 per person and $500,000 in general aggregate.
8) It is the responsibility of the petitioner /owner to file in a timely manner a new
insurance certificate with the City Clerk upon expiration of an existing certificate.
Failure to do so will result in the revocation of the privilege in street upon 10 days
notice.
9) The petitioner /owner and contractors execute hold harmless agreements with the
City.

BACKGROUND /SUBJECT PROPERTY
The property is a 5 acre parcel encompassing the entire block bounded by West Lincoln Avenue
on the north, Cherry Street on the east, West Irving Avenue on the south and Elmwood Avenue
on the west all of which are located within the University of Wisconsin - Oshkosh campus. The
parcel is currently developed with multiple institutional uses including two student residence
halls and the Elmwood Center office building which is proposed to be expanded and remodeled.
ANALYSIS
The petitioner is requesting installation of private geothermal lines across West Lincoln Avenue
near McKinley Street as part of the expansion project located at 759 Elmwood Avenue. Private
6 -inch geothermal lines will be installed under existing city right -of -way. The Department of
Public Works has reviewed the request and recommends approval of the privilege in the street as
requested with the condition that the location be approved.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its April 21, 2009 meeting.

ITEM: GRANT PRIVILEGE IN THE STREET FOR PLACEMENT OF
GEOTHERMAL PIPING NEAR THE INTERSECTION OF WEST
LINCOLN AVENUE AND MCKINLEY STREET
Plan Commission meeting of April 21, 2009
GENERAL INFORMATION
Petitioner: University of Wisconsin - Oshkosh

Action Requested:
The petitioner is requesting installation of private geothermal lines across West Lincoln Avenue
near McKinley Street. This construction is part of the University's plan for the expansion and
remodeling of the Elmwood Center Building located at 759 Elmwood Avenue.
Applicable Ordinance Provisions:
N/A but an) location of a non -city or private utility use in city right -of -way requires issuance of a
privilege in street permit.
Property Location and Type /Analysis:
Private 6 -inch geothermal lines will be installed under existing city right -of -way per the attached
illustrations.
The Department of Public Works has reviewed the requests and recommends approval of the
privilege as requested with the conditions that locations be approved and that the facility be part of
and documented with Digger's Hotline system.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the privilege in the right -
of -way for the installation of private geothermal lines as requested with the following conditions:
1) The private geothermal lines be installed in a manner that is approved by the Dept. of Public
Works with no modifications or changes in construction procedure without prior approval by
the Dept. of Public Works.
2) If no longer needed, the private geothermal lines be properly abandoned and removed in
accordance with City standards and under the direction of the Dept. of Public Works.
3) Any, problem which may arise as a result of the placement of the private geothermal lines be
the responsibility of the petitioner, contractors and owner to correct in coordination with the
Dept. of Public Works.

The Plan Commission approved of the privilege in street as requested with conditions noted. The
following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and explained that the geothermal lines would connect with
geothermal wells that the University would be installing on the site adjacent to the Elmwood
Center. He also commented that the conditions in the staff report referred to fiber optic conduit
which should have been geothermal lines.
Tom Sonnleitner, representative for the University, 800 Algoma Boulevard, explained the details
of the new geothermal heat field system being installed as part of the renovation of the Elmwood
Center. He further stated that this was the first building of its kind in the state and that he also had
members of the design team present if any Commission members had further questions regarding
the matter.
Motion by Esslinger to approve the privilege in the street for placement of geothermal
piping near the intersection of West Lincoln Avenue and McKinley Street as requested with
the following conditions:
1) The geothermal piping be installed in a manner that is approved by the Dept. of Public
Works with no modifications or changes in construction procedure without prior approval
by the Dept. of Public Works.
2) If no longer needed, the geothermal piping be properly abandoned and removed in
accordance with City standards and under the direction of the Dept. of Public Works.
3) Any problem which may arise as a result of the placement of the geothermal piping be the
responsibility of the petitioner, contractors and owner to correct in coordination with the

The following is general overview and description for a proposed Privilege in Street for work in
conjunction with remodeling of and an addition to the Elmwood Center Building, located at 759
Elmwood Avenue on the University of Wisconsin campus in the city of Oshkosh.
Note that this request is being made in conjunction with a Base Standard Modification (BSM)
application, submitted simultaneously. Refer to BSM application for additional project information.
Proposed Privilege in Street:
This request is for a utility crossing of West Lincoln Avenue to serve a remote geothermal bore field
in Parking Lot #34, north of the Elmwood Center. Detailed engineering plans for the (2) 6 -inch
diameter lines will be prepared and submitted for review and approval by the city of Oshkosh prior to
commencing any work in the right -of -way. (See Site Plan M101, attached.)
