PURPOSE: APPROVE AMENDMENT NO. 5 / CH2M HILL / ENGINEERING
SERVICES FOR WATER FILTRATION PLANT ($387,767)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached
Amendment No. 5 for Engineering Services for Water Filtration Plant between the City of
Oshkosh and CH2M HILL in the amount of $387,767.00 is hereby approved and the proper
City officials are hereby authorized to execute and deliver the Amendment in substantially
the same form as attached hereto, any changes in the execution copy being deemed
approved by their respective signatures, and said City officials are authorized and directed
to take those steps necessary to implement the terms and conditions of the Agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated

RE: Engineering Services Agreement CH2MHill Amendment #5 for 08 -05 Water Filtration Plant
CT Basin and Demolition Project
BACKGROUND
CH2MHill is providing design and construction management services for the Water Filtration Plant project
that includes a new basin for backup disinfection, new high lift pumping station, low lift pumping station,
demolition of the old Water Filtration Plant and all associated yard piping and electrical service work. The
construction management services include review and approval of all equipment and materials being
used by the contractor to ensure conformance with the contract specifications, field observation and
documentation of the physical construction and equipment installation, responding to questions by the
contractor, responding to unforeseen site conditions, and determining if changes are needed and the
requirements for any changes as specified in the contract documents. The project estimate in January
2008 was $9,005,950.00. The low bid by Miron Construction was $6,070,273.00. This amendment is the
estimated additional amount necessary for construction management services through the completion of
the project.
ANALYSIS
The time required for construction management services can vary depending on the complexity of the
project, site conditions and the contractors approach to the work. It has been necessary to increase the
site inspection services to ensure conformance with the contract documents, deal with unknown site
conditions based on site piping and buried structures left behind from previous projects, and winter
construction. This amendment is reasonable based on my experience with similar construction projects.
FISCAL IMPACT
With this engineering amendment and change orders to date we are at a total project cost of
$7,953,657.52. The final change order is estimated at $300,000.00. This will bring the project total to
$8,253,657.52 which is $752,292.48 under the project estimate. Funds are available in the Property
Improvements Section (Water Utility Funds) of the Capital Improvement Budget.
RECOMMENDATIONS
recommend approval of the Scope of Services Amendment No. 5 to CH2M Hill for $387,767.00.

AMENDMENT NO.5
This Amendment No. 5 is issued pursuant to the Standard Agreement for Professional Services
fully executed on April 20, 2007, Amendment No.1 fully executed September 26, 2007,
Amendment No. 2 fully executed April 22, 2008, and Amendment No. 3 fully executed June 20,
2008, and Amendment No. 4 fully executed October 3, 2008 which are incorporated herein by
this reference, with respect to Water Filtration Plant Modifications and Demolition Project.
Specific Services: As stated in Attachment 1, Amended Scope Services, incorporated herein by
reference.
Compensation Provisions: As stated in Attachment 1, Amended Scope Services, incorporated
herein by reference.
Work Schedule: March 1, 2009 through December 31, 2009.

MODIFICATIONS AND DEMOLITION PROJECT
Revised Professional Engineering Services
In addition to the original Design Scope of Services and subsequent Contract Amendments,
CH2M MILL, in collaboration with AECOM and Kaempfer & Associates, Inc., will provide to the
City additional assistance with inspection, construction management and engineering through
project completion December 31, 2009. The primary reasons for this contract amendment are as
follows:
• Expanded Resident Project Representative Services
• Additional Engineering Related to Unforeseen Site Conditions
Extended Duration of Construction Contract .Schedule
Expanded Resident Project Representative Services
Iri response to the needs of the construction team, CB7-M HILL increased the level of on -site
construction inspection to ensure quality control and assist the Contractor meet the intent of the
Contract Documents: The level of effort for Resident Project Representative (RPR) services was
increased from approximately '/�-time to full -time. This additional effort has resulted more
comprehensive quality assurance monitoring and improved communication between the
Contractor and the City.
Additional Engineering Related to Unforeseen Site Conditions
For over 120 years, the City has operated water supply, treatment and storage facilities at the
current Wafer Filtration Plant. Over the years, some buried piping, small facilities, other utilities,
and unsuitable soils have been abandoned in place. The City maintains very good
documentation of historic changes at the site, but the documentation, especially the oldest
information, is not 100 - percent accurate or complete. As a result, unplanned situations occur
during construction and additional engineering services are required to solve problems and
minimize the impact to the construction schedule. For example,
• Engineered solutions were needed to address undocumented site conditions (leaking
buried piping and valves, abandoned buried features (i.e., old well), or unsuitable soils).
• Design changes were required to adjust for incorrectly located buried utilities, as shown
on existing record drawings, so that connections could be made in this project.
• Design changes resulted in changes orders that required scoping, detailed review and
negotiation with the Contractor by engineering and RPR staff.
Extended Duration of Construction Contract
Due primarily to unforeseen site conditions, the Construction Contract Times has been
extended 90 days by change order. Consequently, the construction activities originally

scheduled for completion July 30, 2009 have a contract completion date of October 30, 2009.
In addition to this agreed extension to the Contract Times, the Contractor has proposed in
2009 schedule updates that the Contractor's anticipated construction completion is late
November 2009. Given this available information, we recommend the City on needing
engineering assistance through December 2009 for project closeout activities.
Revised Compensation
The terms and conditions of the contract executed by both parties April 20, 2007, and
amended by both parties September 26, 2007, April 22, 2008, June 3, 2008, and October 3,
2008 are incorporated herein by reference.
The compensation summaries for additional engineering services are presented in Table 1.
The final contract value is shown in Table 2.
Table 3 presents a detailed work plan for engineering and construction team through project
completion.
