And 9th Street Road. 0 QfHKOlH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Jackson Kinne Director of Com ity Development DATE: March 19, 2009 RE: Approve Zone Change from A -2 General Agricultural Extraterritorial Zoning to C -1 Neighborhood Business Extraterritorial Zoning, Southeast Corner of Clairville Road and 9th Street Road, Town of Algoma (Extraterritorial Zoning Committee Recommends Approval) BACKGROUND /SUBJECT PROPERTY The subject site is a five acre undeveloped parcel located at the southeast corner of 9th Street Road and Clairville Road, approximately 1 /4 of a mile west of Oshkosh city limits within the Town of Algoma -City of Oshkosh Boundary Agreement area. The property has been used most recently for agricultural purposes. ANALYSIS The petitioner is requesting rezoning of the parcel from A -2ETZ to C -lETZ to allow for the development of a 14,000 square foot wellness center at this location. Prior to any consideration on a rezoning, the proposed use must be determined to be consistent with the City's residential land -use recommendation of our Comprehensive Plan which was approved in November of 2008 by the Plan Commission. In January of 2009, the Plan Commission also approved a four -lot land division which included the creation of the subject five acre parcel involved in this rezoning request. The rezoning appears appropriate since it is at the intersection of two collector streets which is an ideal location for a commercial business and the creation of such a neighborhood business district is consistent with the City's Comprehensive Plan. FISCAL IMPACT None anticipated as the property will be serviced by the Town and County. RECOMMENDATION The Extraterritorial Zoning Committee approved of this request at its March 3, 2009 meeting. Approved, City Manager ITEM: EXTRATERRITORIAL REZONING FRO AGRICULTURAL DISTRICT TO C -IETZ NEIGHBORHOOD BUSINESS DISTRICT FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF 9 TH STREET ROAD AND CLAIRVILLE ROAD IN THE TOWN OF ALGOMA (CITY OF OSHKOSH EXPANSION AREA) Extraterritorial Zoning Committee meeting of March 3, 2009 GENERAL INFORMATION Petitioner: Source Investments, LLC Owner: Ray Jones Action Requested: Rezoning of a parcel from A -2ETZ to C -lETZ located at the southeast corner of 9 Street Road and Clairville Road within the Town of Algoma (City of Oshkosh Expansion Area). Applicable Ordinance Provisions: The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning but relies on the Comprehensive Plan, redevelopment plans and good planning principles. In order to establish and operate the wellness center /personal service business, the zoning of this property must be changed from the existing A -2ETZ General Agricultural Extraterritorial District to a commercial zone. City staff has informed the applicant that the uses proposed are not permitted in the A -2ETZ General Agricultural Extraterritorial District and that the appropriate zoning for the type of uses proposed within a predominately residential area is the C -lETZ Neighborhood Business Extraterritorial District. Prior to any consideration on a rezoning, the proposed use must be determined to be consistent with the City's residential land -use recommendation of our Comprehensive Plan and the City Plan Commission must determine consistency in order for any future rezoning request to receive a positive recommendation by staff to the Oshkosh- Algoma Joint Plan Commission. On November 4, 2008, the Plan Commission found the proposed use to be consistent with the Comprehensive Plan, allowing the petitioner to proceed with this rezoning request. On January 6, 2009, the Plan Commission approved a four -lot land division which included the creation of the subject 5 acre parcel involved in the rezoning request. Staff is supportive of this rezoning as this location is at the intersection of two collector streets and an ideal location for a light commercial business. This rezoning will enable development of the proposed wellness center and will not have a negative impact on the surrounding area. RECOMMENDATION /CONDITIONS The Department of Community Development recommends approval of the extraterritorial rezoning from A -2ETZ to C -IETZ as requested. The Extraterritorial Zoning Committee approved of the rezoning as requested. The following is the Extraterritorial Zoning Committee's discussion on this item. Mr. Nau presented the item and reviewed the previously approved Comprehensive Plan land use consistency and the land division for this area which both required approval prior to the rezoning petition coming forward. Mr. Burich added that the C -1 Neighborhood Business District zoning classification being proposed is the least intensive business district classification. He further stated that although this area was recommended as residential in the Comprehensive Plan, it allows for commercial nodes at intersections such as 9th Street Road and Clairville Road. Mr. Nadolske questioned where the drive accesses to the site would be located. Mr. Nau responded that the Plan Commission restricted access to 9th Street Road with the approval of the land division; therefore the drive accesses would be located on Clairville Road. Mr. Thoms added that the access restriction on 9th Street Road was due to the higher traffic volume, greater speeds, and more pedestrian traffic on this road. He also stated that a stop sign for this intersection was also discussed. Mr. Spanbauer commented that the County may also wish to restrict access to this site. Mr. Burich stated that the restriction on 9th Street Road was already recorded on the certified survey map. Mr. Nadolske questioned if the owner was petitioning to annex the land into the city now. Item - Rezoning- Clairville Rd/9th St Mr. Burich responded that City services have not extended out to this area at this time. Presently, City sanitary service is approximately a quarter mile to the east. Commission members briefly discussed the Town of Algoma protected area. Mr. Nadolske commented that if the area was remaining in the Town of Algoma, the Town has a commercial site plan ordinance they have adopted. The landscaping, lighting, etc. would have to adhere to their ordinance which is rather restrictive. Commission members discussed details of the Town's commercial site plan ordinance. Motion by Borsuk to approve the extraterritorial rezoning from A -2ETZ General Agricultural District to C- IETZNeighborhood Business District for property located at the southeast corner of 9th Street Road and Clairville Road in the Town of Algoma. The petitioner or owner should be present at both the Plan Commission and Common Council meetings to discuss and answer questions regarding the request. Neighborhood opinion is an important factor in the decision - making process. For complex or controversial proposals, it is recommended that the petitioner conduct a neighborhood meeting to solicit public input prior to action by the Plan Commission and City Council. Planning Services staff is available to offer assistance in compiling a mailing list for the neighborhood meeting. Please note that a meeting notice will be mailed to all abutting property owners regarding your request. The application package is reviewed by Planning Services staff to determine conformance with adopted city plans, zoning requirements and development standards. A staff recommendation is prepared for consideration by the Plan Commission and Common Council. The petitioner will be provided with a copy of the staff report and meeting notice several days prior to the Plan Commission meeting. No notice is sent to the petitioner or owner regarding the Common Council's consideration of the request. Wisconsin State Statutes require a zone change to be published as Class II notice in the local newspaper, the City takes care of this publication requirement prior to' the Council meeting.
