This permit requires the City to comply with the following six minimum control measures (as mandated by the Federal Clean Water Act, and Environmental Protection Agency): 1. Public Information and Education Plan 2. Public Involvement and Participation Program 3. Illicit Discharge Detection and Elimination Program (including new or revised ordinances) 4. Construction Site Pollutant Control Program (including new or revised ordinances) 5. Post - Construction Storm Water Management Program (including new or revised ordinances) 6. Pollution Prevention Program (Prevent pollution from the daily operations of the City) The Storm Water Utility Committee reviewed the Annual Report and recommended approval, with revisions as discussed during the meeting, at their February 18, 2009 meeting. ANALYSIS An annual report was not required to be submitted for the first year of coverage, therefore, this first annual report covers the time period of January 2, 2007 through December 31, 2008. The report includes a summary output from the City's MS4 Permit Tracking Software (ASIST) and a completed DNR form. City staff has more details available for the DNR, should they be requested. FISCAL IMPACT There is no anticipated fiscal impact from the approval of this resolution. RECOMMENDATION Staff recommends approval of the resolution. An owner or operator of a municipal separate storm sewer system covered by the general permit under Chapter NR 216, Wis. Adm. Code, is required to submit an annual report to the Department of Natural Resources by March 31 of each year to report on activities for the previous calendar year. A municipality that received its initial permit coverage in 2006 needs only to report on activities undertaken in calendar year 2008. A municipality that received its initial permit coverage in 2007 needs to report on activities undertaken in both calendar years 2007 and 2008. Use of this specific form is optional. The Department of Natural Resources has created this form for the user's convenience and believes that the information requested on this form meets the reporting requirements for an owner or operator of a municipal separate storm sewer system covered by the general permit. Instructions: Complete each section of the form that follows. If additional space is needed to respond to a question, attach additional pages. Describe what efforts the municipality has undertaken to invite the municipal governing body, interest groups, and the general public to review and comment on the annual report. The annual report has been reviewed by the City of Oshkosh Storm Water Utility Committee. After the review and comments from the Committee were incorporated, the annual report was posted to the City of Oshkosh Storm Water Utility website, and contact information given for interested persons to submit comments on the report. The Common Council received the annual report with their meeting information packets, and Council Members have opportunities to ask staff questions before the Common Council Meeting, and during the meeting when the annual report is the active topic. b. Describe how elected and municipal officials and appropriate staff have been kept apprised of the municipal storm water discharge permit and its requirements. The Common Council is kept apprised of the storm water discharge permit and its requirements through Common Council Workshops. Workshops are periodically scheduled following the normal Common Council Meeting to provide staff with a dedicated time to present topics to the Council and for the Council to ask questions and learn more about the topics. c. Has the municipality prepared its own municipal -wide storm water management plan? ® Yes ❑ No If yes, title and date of storm water management plan: City of Oshkosh Citywide Stormwater Management Plan. d. Has the municipality entered into a written agreement with another municipality or a contract with another entity to perform one or more of the conditions of the general permit as provided under Section 2.10 of the general permit? ® Yes ❑ No If yes, describe these cooperative efforts: The City of Oshkosh has entered into a Memorandum of Understanding with the East Central Wisconsin Regional Plan Commission ( ECWRPC) for the implementation of a regional Phosphorus Education Campaign. ECWRPC has contracted with NEWSC for the implementation of this regional campaign. The City of Oshkosh began discussions with the University of Wisconsin - Oshkosh during this reporting period on the formation of a Memorandum of Understanding between the two agencies. This work continues into 2009 and is expected to be completed durign 2009. e. A Storm Water Utility Rate Study Analysis was performed in the second half of 2008. This rate study included the implementation costs of the flood control studies in addition to the numerous requirements of the MS4 Permit. This study recommended an increase in Storm Water Utility rates from $48.88 per ERU per year to $62.92 per ERU per year. Note: If an ordinance listed below has previously been submitted and has not been amended since that time, a copy does not need to be submitted again. If the ordinance was previously submitted, indicate such in the space provided. a. There are no current discharges that would contibute to this pollutant. Lake Butte.des Mortes: Listed for Mercury, PCBs, Sediment, and Phosphorus. Mercury is atmospheric deposition, which the City cannot implement a means to reduce. PCBs are no longer used in industrial processes along the river, and thus there are no longer discharges that would contribute to this polluntant. Sediment is being addressed on a City Wide basis, as required by the MS4 Permit. Phosphorus reductions will be associated with the reduction in sediment on a City Wide basis. Phosphorus is being addressed under the I &E plan to get residents to reduce the use of phosphorus. Until such time as a TMDL is prepared for the Upper Fox River Basin, it would be inappropriate to attempt to formulate a plan to reduce phosphorus. Description: Mr. Rabe and Mr. Bachhuber (Earth Tech) presented information on the necessary steps to comply with the DNR Municipal Storm Water Regulations. An outline of the MS4 Permit requirements was discussed, as well as where the City currently stands with its TSS Reduction requirements. Mr. Rabe then discussed the status of several flood control studies. Description: Mr. Rabe introduced Laura Gray and Kris Lyons as the Erosion Control Inspectors for the City of Oshkosh for this project. The City of Oshkosh will be performing the weekly and rainfall event inspections as required by the DNR Construction Site Permit. The primary contacts for the Contractor were identified. The City Inspectors will fax all inspection forms and maintenance orders to those contacts. Group watched the Excal Video "Ground Control ". Mr. Rabe then walked through the plans with the Contractors. The purpose of the plan walk through was to discuss the locations where erosion and sediment control practices are shown in the plans and what is expected by the City from the contractor. The Annual Home Owners Association Meeting was an ideal time for this interaction. Description: Mr. Rabe discussed the impact of Sawyer Creek flooding not only in the area of the Sawyer Creek Subdivision, but on the watershed as a whole. There was widespread flooding within the watershed. More specifically, within the area of the Sawyer Creek Subdivision not only was there storm water flooding, there were also numerous sanitary sewer back -ups reported. Mr. Rabe indicated that the Wastewater Utility was looking into concerns related to the back -ups, and may potentially work with the Building Inspection Services Division to inspect homes to ensure that sump pumps and down spouts are connected to the Storm Sewer Lateral, and not the Sanitary Sewer Lateral. Mr. Rabe explained that there is curerntly a detailed Planning Level Study being conducted on the Sawyer Creek watershed. Strand Associates (Madison, WI) is conducting this study. The plan development was partially funded by a Wisconsin Department of Natural Resources Urban Non -point Source Planning Grant. One aspect of this plan is the calulation of the "Base Pollutant Loading" for the City of Oshkosh Urban Area. The City of Oshkosh Pollutant Base Load has been calculated to be 1,693 tons of sediment per year. The next step in the Initial Pollution Reduction Analysis was to determine the level of reduction being achieved by current pollution reduction practices. Current practices employed within the City of Oshkosh include: Street Sweeping, Installation of Catch Basins with 18" deep sumps, existing public and private wet detention ponds, vegetated swales. That means removing 339 tons of sediment from the base load. The existing management practices removed 292 tons per year, so in order to achieve the 20% TSS reduction, and additional 47 tons per year must be removed. After evaluating alternatives, it was determined that an enhanced street sweeping program will achieve the 20% TSS reduction. The City's normal street sweeping program utilizes high - efficiency vacuum assisted street sweepers, and sweeps the downtown area once per week and the remainder of the City every other week. By implementing an enhanced program of sweeping the entire City once per week for the first six (6) weeks of the season, the City is able to remove an additional 62 tons of sediment per yet. In addition to the existing practices, implementing the enhanced street sweeping program will raise the Citv's TSS removal percentage to 20.9 %. After evaluating alternatives, it was determined that a multi - facility, multi - practice approach would be required in order to meeting the required 40% TSS reduction. Enhanced street sweeping was implemented in order to achieve the 20% TSS reduction, this practice will continue to be utilized in order to reach the 40% TSS reduction. Additional practices to reach the 40% TSS reduction may include: continued installation of catch basins with 18" deep sumps, construction of new regional wet detention basin facilities, conversion of existing vegetated swales to engineered swales, TSS reduction from planned redevelopment areas, and the construction of biofilters. In addition to the existing practices, and Phase 1 practices, the Phase 2 practices will raise the City of Oshkosh TSS Pollution Reduction to 40% of the Base Pollutant Load.
