EASEMENT AT 3524 WEST COUNTY ROAD K

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts a sanitary sewer and water main easement from William Brayton, etal,
per the attached, at 3524 West County Road K (West 20th Avenue) and the proper City
officials are hereby authorized and directed to execute any and all documents
necessary for purposes of same.

RE: Approve Accepting Sanitary Sewer & Watermain Easement at 3524 West County Road K
BACKGROUND
The Department of Pubic Works hired Earth Tech, Inc. in 2002 to prepare a Sanitary Sewer Study for the
future service area southwest of the City. The study provided recommendations on how to provide
sanitary sewer service for this area, including expansion areas of the Southwest Industrial Park. The
Study recommended the sanitary sewer interceptor pipe be extended parallel to Sawyer Creek from Fox
Tail L. to Clairville Rd.
Water service will also be needed for the area to develop. Currently watermain extends west to serve the
YMCA property.
The Plan Commission approved acquisition of the easements at the October 2, 2007 meeting.
ANALYSIS
Acquiring the easement along the north side of County Rd. K (W. 20 Ave.) will allow the City to install
sanitary sewer and watermain outside of the existing four lane concrete roadway. Avoiding the pavement
reduces the costs to the City and minimizes the disruption to traffic by allowing the road to remain open
during construction. This work is part of City contract 09 -02 and is currently under construction.
FISCAL IMPACT
The value of the easement is approximately the same as the future connections charges for the lot. In
exchange for the easement the City will waive the connection charges. The City will pay $2,500 to the
owners to replace the landscaping and trees disturbed by the construction. Funds are available in the
2009 Capital Improvement Program.
RECOMMENDATIONS

ITEM: ACCEPT SANITARY SEWER & WATER MAIN EASEMENT FOR
PROPERTY LOCATED AT 3524 W. 20TH AVENUE
Plan Commission meeting of October 2, 2007
GENERAL INFORMATION
Petitioner: City of Oshkosh Department of Public Works
Owner: William S. & Roberta J. Brayton
Action Requested:
The Department of Public Works is requesting sanitary sewer and water main easement acceptance
for the installation of a sanitary sewer interceptor and water main.
Applicable Ordinance Provisions: N/A
Property Location and Type /Analysis:
The proposed easement location is on the north side of W. 20 Avenue just east of Clairville Road.
The property is located in the Town of Algoma but is in the City of Oshkosh expansion area as
identified by the Town of Algoma/City of Oshkosh Cooperative Agreement.
The city completed a study of the sanitary sewer system for the southwest side of Oshkosh in
2002. The study recommended a larger diameter interceptor sewer be extended for Fox Tail Lane
(west of S. Oakwood Road) along Sawyer Creek to the intersection of W. 20 Avenue and
Clairville Road. This interceptor will service a large portion of the area from STH 44 to north of
W. 20 Avenue and one mile west of Clairville Road. The 2007 Capital Improvements Program
includes funding for the construction of this interceptor. This easement is required to allow for the
sanitary sewer construction around the large storm water drainage culverts in the 20
Avenue / Clairville Road intersection.
PLAN COMMISSION RECOMMENDATION
The Department of Community Development recommends approval of the acceptance of the
easement.
The Plan Commission approved of the acceptance of the easement as requested. The following is
the Plan Commission's discussion on this item.
Mr. Burich commented that this action would allow the Department of Public Works to approach
the property owners to discuss this item. Common Council action would be delayed until the
property owners are contacted.
William Brayton, 3524 W. 20th Avenue, stated that he was the property owner and attended the
meeting to find out what was going on, as he had not yet been contacted.
Mr. Burich replied that City sanitary sewer and water was to be installed in this area and that Steve
Gohde, Assistant Director of Public Works, could discuss this project in more detail with him.
Mr. Brayton questioned what happens if they do not want this installation on their property.
Mr. Burich responded that they would have to discuss the matter with the Department of Public
Works and if they cannot come to an agreement regarding the easement, an option may be to
proceed with the condemnation process.
Motion by Fojtik to move approval of the acceptance of the easement as requested.
Seconded by Thorkildsen. Motion carried 7 -0.

Re: Authorization to Acquire Easement Needed for Construction of Sanitary Sewer
Interceptor along Sawyer Creek
Per our discussion, I am writing to explain the request to acquire an easement on 20'' Avenue at
Clairville Road. As you know, the City completed a study of the sanitary sewer system for the
southwest side of Oshkosh in 2002. This study proposed a larger diameter interceptor sewer be
extended from Fox Tail Lane (West of Oakwood Road) along Sawyer Creek to the intersection
of 20 Avenue and Clairville Road. This interceptor will ultimately service a large portion of the
area located from STH 44 to north of 20'' Avenue. This service area will also extend to one mile
west of Clairville Road. The current Capital. Improvement Program includes funding for the
construction of this sanitary sewer interceptor. This easement is required to allow for the
sanitary sewer construction around the large storm water drainage culverts in the 20
Avenue / Clairville Road intersection. After approval by the Plan Commission, this item will be
scheduled for Common Council consideration on October 9, 2007. Please contact me if you
