HomeMy WebLinkAbout09-94MARCH 24, 2009 09 -94 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: REAUTHORIZATION OF SELF - INSURANCE FOR WORKER'S COMPENSATION INITIATED BY: CITY ADMINISTRATION WHEREAS, the City of Oshkosh is a qualified political subdivision of the State of Wisconsin; and WHEREAS, the Wisconsin Worker's Compensation Act (Act) provides that employers covered by the Act either insure their liability with worker's compensation insurance carriers authorized to do business in Wisconsin, or to be exempted (self - insured) from insuring liabilities with a carrier and thereby assuming the responsibility for its own worker's compensation risk and payment; and WHEREAS, the State and its political subdivisions may self- insure worker's compensation without a special order from the Department of Workforce Development (Department) if they agree to report faithfully all compensable injuries and agree to comply with the Act and rules of the Department; and NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Oshkosh does ordain as follows: (1) Provide for the continuation of a self- insured worker's compensation program that is currently in effect. (2) Authorize the City Clerk to forward certified copies of this resolution to the Worker's Compensation Division, Wisconsin Department of Workforce Development. @1 OYHK�.!'H ON THE WATER PO Box 1130, 215 Church Ave. Oshkosh WI 54902 -1130 TO: Mark Rohloff, City Manager FROM: Paul Greeninger, Safety & Risk Management Coordinator DATE: March 20, 2009 RE: Workers Compensation Resolution BACKGROUND Every three years each self- insured political subdivision must provide the Department of Workforce Development, Self- Insurance Section, with a resolution, passed by the governing body that states its intent and agreement to self insure, per Wisconsin Administrative Code DWD 80.60(3). ANALYSIS Workers Compensation claims are continuing to trend downward, leading to cost savings to the city due to self insuring. By making the switch to become self- insured in 2002, the city of Oshkosh has realized significant cost savings. FISCAL IMPACT A total Workers Compensation cost to the City of Oshkosh was $320,000 in 2008. If the city were not self- insured, the total cost in a fully insured program would have been $800,000. Therefore, in 2008 alone, the city saved about $480,000 by being self insured. RECOMMENDATION The council adopt the resolution to remain self - insured.
