easement on the north property line of 1012 Nebraska Street if the variance is approved.
Mr. Muehrer explained according to building code (for fire protection) there needs to be at least 6 feet
between the structures on each individual lot. Each structure has to be 3 feet away from the property line. By
requiring the 6' no build easement, the setback is established and it saves the petitioner another
administrative process to appeal the building code.
Mr. Herrman stated that he is fine with the condition.
Motion by Carpenter to approve the request for variances to permit one principal structure to have a
0.3' side yard setback and another principal structure to have a 3.6' side yard setback with the
following condition:
1. A 6' wide no-build easement along the north property line of 1012 Nebraska Street shall be
recorded with the Register of Deeds.
Seconded by Cornell. Motion carried S-0.
Finding of Facts:
Best solution to a unique situation.
No harm to public interest.
DISCUSSION OF BOA PROCEDURES
Mr. Penney knows someone who is interested in the vacant board member position. This person is on
vacation for three weeks and will have an answer upon his return, hopefully by the next Board of Appeals
Meeting.
