09 -68 RESOLUTION

PURPOSE: APPROVE LAND DONATION FROM OSHKOSH
COMMUNITY CREDIT UNION, PORTION OF 250 PEARL
AVENUE TO PROVIDE CONTINUED ACCESS TO THE
REAR OF PROPERTIES FRONTING ON HIGH AVENUE
THROUGH THE HIGH AVENUE PARKING LOT
INITIATED BY: CITY ADMINISTRATION
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, Oshkosh Community Credit Union proposes to make improvements
to their property at 250 Pearl Avenue; and
WHEREAS, the Credit Union desires to donate a portion of their property to the
City in order to provide continued access to the rear of the adjacent properties fronting
on High Avenue through the High Avenue Parking Lot.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the City hereby accepts said conveyance of land, per the attached, and
the proper City officials are hereby authorized and directed to execute any and all
documents necessary for purposes of same.

Recommends Approval)
BACKGROUND /SUBJECT PROPERTY
The Oshkosh Community Credit Union (CCU) is located at the corner of Division Street and
Pearl Avenue in a predominantly commercial area. The area to be donated is an approximately
898 square foot portion of CCU's parking lot which will be incorporated into the High Avenue
Parking Lot property.
ANALYSIS
This request is being made to provide access to the rear of two properties along High Avenue
(139 and 141 High Avenue). Currently the owners along High Avenue must cross the CCU
property in order to access the rear of their property. With the approval of this land donation,
access will be possible entirely on public land. The Department of Public Works and the Transit
Department have reviewed and recommended approval of this request.
FISCAL IMPACT
None, other than some minor initial costs associated with installing the paved driveway access,
which costs will be special assessed to the adjacent properties. Ongoing maintenance for such a
small area is expected to be minimal and will be done in association with the High Avenue
parking lot.
RECOMMENDATION
The Plan Commission approved of this request at its March 3, 2009 meeting.

Mr. Nau presented the item and explained that the request was to provide access to the rear of two
properties along High Avenue (139 and 141 High Avenue) on public land.
Mr. Nollenberger questioned if there was a need to also provide access to the adjacent property at
145/147/149 High Avenue.
Mr. Nau responded that this property was accessible from Division Street.
Ms. Mattox asked if there would be parking provided in this area.
Mr. Burich replied that the area would not be utilized for parking. It was to be for access purposes
only.
Motion by Nollenberger to approve the land acceptance of a portion of 250 Pearl Avenue as
requested.
Seconded by Thoms. Motion carried 6 -0.
