HomeMy WebLinkAbout09-75FEBRUARY 24, 2009 MARCH 10, 2009 09 -59 09 -75 ORDINANCE FIRST READING SECOND READING (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVAL OF PARKING REGULATIONS CHANGES ON COURT STREET, OTTER AVENUE, WASHINGTON AVENUE AND WAUGOO AVENUE INITIATED BY: TRANSPORTATION DEPARTMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27 -1, 27- 23(A -3) and 27- 23(A -11) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO DEFINITIONS, PARKING METER REGULATIONS, AND PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27 -1 of the Oshkosh Municipal Code is hereby created as follows: SECTION 27 -1 DEFINITIONS For the purposes of this chapter, the following definitions are used. (1) Holidays: Includes New Years Day (January 1), Memorial Day (the last Monday in May), Independence Day (July 4), Labor Day (the first Monday in September), Thanksgiving Day (the fourth Thursday in November), and Christmas Day (December 25) SECTION 2. That Section 27- 23(A -3) of the Oshkosh Municipal Code pertaining to parking meter regulations is hereby amended as follows A-3 PARKING METER REGULATIONS (B) Two hour metered streets. Delete Therefrom Court Street, east side, from 184 feet north of Waugoo Avenue to Washington Avenue. Delete Therefrom Delete Therefrom Court Street, west side, from Washington Avenue to Waugoo Avenue. Otter Avenue, north side, from State Street to Court Street. That Section 27- 23(A -11) of the Oshkosh Municipal Code pertaining to parking regulations on designated streets and alleys is hereby amended as follows A-11 PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS COURT STREET Delete Therefrom Angle parking, east side, from Waugoo Avenue to Washington Avenue. Add Thereto 2 -hour parking, west side, from Waugoo Avenue to Washington Avenue between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. Add Thereto 4 -hour angle parking, east side, from Washington Avenue to Waugoo Avenue. OTTER AVENUE Add Thereto 2 -hour parking, south side, from 244 feet east of State Street to Court Street between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. Add Thereto 2 -hour parking, north side, from 129 feet east of State Street to 191 feet east of State Street between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. WASHINGTON AVENUE Delete Therefrom 2 -hour parking, south side, from 100 ft. east of State St. to 208 ft. east. Add Thereto 2 -hour parking, south side, from 100 feet east of State Street to 55 feet west of Court Street between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. WAUGOO AVENUE Delete Therefrom 2 -hour parking, south side, from State Street to 104 feet east of State Street between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. Add Thereto 2 -hour parking, south side, from State Street to 130 feet west of Court Street between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. SECTION 4. This ordinance shall be in full force and effect from and after its passage, publication, and placement of the appropriate signage. SECTION 5. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #09 -75 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27 -1, 27- 23(A -3) AND 27- 23(A -11) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO DEFINITIONS, PARKING METER REGULATIONS, AND PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, on March 10, 2009. The ordinance pertains to parking regulations changes on Court Street, Otter Avenue, Washington Avenue and Waugoo Avenue. Rohloff, City Manager FROM: Christopher Strong, Transportation Director DATE: February 18, 2009 RE: Items Defeated by the Traffic Review Board at their February 10, 2009 Meeting A REQUEST FOR THE INTERSECTION OF BENT AVENUE AND WISCONSIN STREET TO BE DESIGNATED AS A FOUR -WAY STOP. (CURRENT CONDITION: TWO -WAY STOP SIGN CONTROL ON BENT AVENUE.) This was considered by the Traffic Review Advisory Board at its September 2008 meeting, but was laid over due to a request for additional data. This request is from a citizen. There is concern that vehicles are traveling at high speeds on Wisconsin Street which, when compounded with concerns over visibility, may introduce some safety challenges. The following warrants are used when considering all -way stop control: a) Five or more reported crashes in a 12 -month period that are susceptible to correction by an all -way stop installation. b) Traffic exceeds 300 vehicles per hour for at least eight (8) hours for the major street approaches, traffic exceeds 200 vehicles per hour for at least eight (8) hours on the minor street approaches, and traffic volumes are relatively equal in distribution. c) Locations with limited ability to see conflicting traffic I examined the crash history of this intersection (see Table 1 for summary statistics). Of the crashes that occurred between 2006 and 2008, three were cases where a vehicle on Bent Avenue ignored the stop sign, one involved a driver who assumed that Wisconsin Street also had a stop sign, and one involved two vehicles traveling the same direction on Bent Avenue. None of the crashes indicated any problems with sight distance at the intersection. My field investigation confirmed that, due in part to current restrictions on on -street parking, the sight distance is adequate. Table 1: Crash History at the Intersection of Bent Avenue and Wisconsin Street Year 2002 2003 2004 2005 2006 2007 2008" Number of Crashes 2 3 1 0 1 3 1 * - Through mid - November 2008 Regarding the traffic volume warrant, traffic volumes on Wisconsin Street exceeded 300 vehicles per hour for three hours during the day, while the highest traffic volume on Bent Avenue was 83 vehicles in an hour. Consequently, the intersection failed to meet the traffic volume warrant. Speed data that we collected show that there is a speeding problem at the intersection. We found that average speeds are about 5 -6 mph in excess of the posted speed limit. The 85 percentile speed — the speed at which 85 percent of the vehicles travel slower — is about 9 -10 mph in excess of the speed limit. However, the City has historically avoided the use of stop signs for traffic calming purposes, since we believe that this tends to undermine the respect of stop signs at locations where they are truly needed for safety reasons. SECTION 2: SECTION 27 -23 (A -3) As a result the Parking Utilization Study, the Parking Utility Commission recommended the elimination of meters where parking utilization is low. SECTION 3: SECTION 27 -23 (A -11) — PARKING REGULATIONS A REQUEST FOR 2 -HOUR PARKING ON THE WEST SIDE OF COURT STREET FROM WAUGOO AVENUE TO WASHINGTON AVENUE BETWEEN THE HOURS OF 9:00 A.M. AND 6:00 P.M. DAILY EXCEPT SUNDAYS AND NEW YEAR'S DAY, MEMORIAL DAY, FOURTH OF JULY, LABOR DAY, THANKSGIVING DAY AND CHRISTMAS DAY. (CURRENT CONDITION: METERED PARKING.) This is a Transportation Department request. The Parking Utility Commission has recommended removal of the on- street parking meters on this section of roadway. These are 2 -hour meters. The request would keep the parking on a 2 -hour time limit. If approved, this ordinance change would create a 2 -hour parking zone on the west side of Court Street from 90 feet north of Ceape Avenue to Washington Avenue. The time limits would be consistent with much on- street parking within the Business Improvement District (BID). PASSED BY TRAFFIC REVIEW BOARD (6 -0) A REQUEST FOR 4 -HOUR ANGLE PARKING ON THE EAST SIDE OF COURT STREET BETWEEN WASHINGTON AVENUE AND WAUGOO AVENUE. (CURRENT CONDITION: ANGLE PARKING WITH METERS.) This is a Transportation Department request. The Parking Utility Commission has recommended removal of the on- street parking meters on this section of roadway. These angled stalls are regulated by a mixture of 2 -hour and 10 -hour meters. A recent utilization study conducted for the Parking Utility Commission showed that the Page 2 of 3 2 -18 -09 stalls are relatively underutilized, regardless of parking duration. Having 4 -hour parking would match the time duration of the angled parking on the east side of Court Street between Otter Avenue and Ceape Avenue. PASSED BY TRAFFIC REVIEW BOARD (6 -0) A REQUEST FOR 2 -HOUR PARKING ON THE SOUTH SIDE OF OTTER AVENUE FROM 244 FEET EAST OF STATE STREET TO COURT STREET BETWEEN THE HOURS OF 9:00 A.M. AND 6:00 P.M. DAILY EXCEPT SUNDAYS AND NEW YEAR'S DAY, MEMORIAL DAY, FOURTH OF JULY, LABOR DAY, THANKSGIVING DAY AND CHRISTMAS DAY. (CURRENT CONDITION: METERED PARKING.) This is a Transportation Department request. The Parking Utility Commission has recommended removal of the on- street parking meters on this section of roadway. This area is currently regulated by 10 -hour meters. A recent utilization study conducted for the Parking Utility Commission showed that the stalls are relatively underutilized. Since these parking areas are within the BID boundaries, it would make sense to have two -hour parking to promote consistency in on -street parking regulations. The recent utilization study indicated that there is adequate capacity in the Otter East lot (on the south side of Otter Avenue between State Street and Court Street) to handle long -term parking demand as needed. AND 6:00 P.M. DAILY EXCEPT SUNDAYS AND NEW YEAR'S DAY, MEMORIAL DAY, FOURTH OF JULY, LABOR DAY, THANKSGIVING DAY AND CHRISTMAS DAY. (CURRENT CONDITION: METERED PARKING.) This is a Transportation Department request. The Parking Utility Commission has recommended removal of the on -street parking meters on this section of roadway. This area is currently regulated by 2 -hour meters, so the proposed change would not affect the duration of parking in this area. The existing ordinance currently prohibits parking from 191 feet east of State Street to 260 feet east of State Street. I believe this is due to a combination of existing parking stall markings and the presence of a driveway on the north side of the street. It may make sense to preserve that parking prohibition since we have no plans to move the stall markings in the near future. AND 6:00 P.M. DAILY EXCEPT SUNDAYS AND NEW YEAR'S DAY, MEMORIAL DAY, FOURTH OF JULY, LABOR DAY, THANKSGIVING DAY AND CHRISTMAS DAY. (CURRENT CONDITION: METERED PARKING.) This is a Transportation Department request. The Parking Utility Commission has recommended removal of the on -street parking meters on this section of roadway. These are 2 -hour meters, and the proposal would keep the parking on a 2- hour time limit. If approved, this ordinance change would create a 2 -hour parking zone on the south side of Washington Avenue from 100 feet east of State Street to 55 feet west of Court Street. The wording of the request would create a consistent 2 -hour parking zone (between 9 a.m. and 6 p.m. except Sundays and holidays) on the south side of Waugoo Avenue between Main Street and 130 feet west of Court Street (with the exception of a small section west of State Street).
