PURPOSE: APPROVE ACCEPTING SANITARY SEWER EASEMENT AT
1945 WEST SNELL ROAD FOR U.S. HIGHWAY 41 UTILITY
RELOCATIONS

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to accept a sanitary sewer
easement from DCR Properties, Inc. at 1945 West Snell Road, per the attached, and to
execute any and all documents necessary for purposes of same.

BACKGROUND /SUBJECT PROPERTY
The subject property is located on the east frontage road of US Highway 41 and is currently
undeveloped. The general area contains a mix of light industrial uses to the south and east and
Highway 41 right -of -way to the north and west. Along the north side of the property is an ANR
gas pipeline /easement.
ANALYSIS
The purpose of the easement request is for the realignment of a city sanitary force main crossing
US Highway 41. The City has the option of locating the force main entirely within public right -
of -way but would require the crossing of the existing gas main two times which is undesirable.
The proposed easement is 30 feet wide with a northwest bearing located at the north portion of
the subject property and will allow the new force main to run parallel to the existing ANR
pipeline easement. The easement is a necessary part of the preliminary work for the Highway 41
expansion project and after review by the Plan Commission and approval by the Common
Council the easement will be recorded at the Winnebago County Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its February 17, 2009 meeting.

ITEM: ACCEPT SANITARY SEWER EASEMENT FOR PROPERTY LOCATED
AT 1945 WEST SNELL ROAD IN THE TOWN OF OSHKOSH

GENERAL INFORMATION

Action Requested:
The Department of Public Works is requesting acceptance of a sanitary sewer easement located at
the north section of the subject property
Applicable Ordinance Provisions: N/A
Property Location and Type /Analysis:
The subject property is located on the east frontage road of US Highway 41, and is currently
undeveloped. The general area contains a mix of light industrial uses to the south and east and
Highway 41 right -of -way to the north and west. On the north side of the property lays an ANR gas
pipeline /easement with a northwest orientation.
The purpose of the easement request is for the realignment of a city sanitary force main crossing
US Highway 41. The City has the option of locating the force main entirely within public right -of
way but would require the crossing of the existing gas main two times which is undesirable. The
proposed easement will allow the new force main to run parallel to the existing ANR pipeline
easement and will prevent the city from having to cross the gas main. The easement is 30 feet
wide with a northwest bearing located at the north portion of the subject property.
The easement is a necessary part of the preliminary work for the Highway 41 expansion project
and staff does not have any issues or concerns with this request.
The Department of Public Works will work with the property owner to have appropriate easement
documents signed. After review by the Plan Commission and approval by the Common Council,
the easement will be recorded at the Winnebago County Register of Deeds.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the acceptance of the
proposed sanitary sewer easement as requested.
The Plan Commission approved of the proposed easement as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item, displayed the area where the easement would be located, and
explained that the easement was related to the preliminary work necessary for the Highway 41
expansion project.
Mr. Thoms questioned how close the sanitary sewer would be from the ANR gas main.
Mr. Gohde responded that the sanitary sewer would be approximately 12 -15 feet minimum and 25-
30 feet maximum from the gas main. It ranges 6 -8 feet in depth.
Motion by Propp to approve the easement for property located at 1945 W. Snell Road as
requested.
Seconded by Esslinger. Motion carried 7 -0.

20 -foot Easement on N. Koeller Street

We need to obtain this easement due to the re- alignment of the sanitary sewer near
sawyer creek. The box culvert that currently runs underneath USH 41 needs to be
extended and that is causing the sanitary sewer alignment to be moved in order to get
around the box culvert.

We need to obtain this easement due the re- alignment of the sanitary force main that runs
underneath USH 41. We do not want to have to cross the ANR gas line twice with the
new re- alignment. We want to parallel the ANR easement and stay on the south side of
the existing gas mains.
