PURPOSE: APPROVE ACCEPTING SANITARY SEWER EASEMENT AT
700 NORTH KOELLER STREET FOR U.S. HIGHWAY 41 UTILITY
RELOCATIONS

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to accept a sanitary sewer
easement from Victor Cortez, etal, at 700 North Koeller Street, per the attached, and to
execute any and all documents necessary for purposes of same.

BACKGROUND /SUBJECT PROPERTY
The subject property is located on the east frontage road of US Highway 41 within the Highway
41 Corridor and is occupied by Sangria's Mexican Grill. The general area contains a mix of uses
including retail to the north, multiple - family to the east, a restaurant to the south and Highway 41
to the west. To the immediate north is Sawyer Creek which crosses below the highway within a
box culvert.
ANALYSIS
The purpose of the easement request is for the realignment of a city sanitary sewer crossing US
Highway 41. The existing sanitary sewer lies alongside the Sawyer Creek box culvert beneath
the highway and as part of the Highway 41 expansion project, the box culvert will be expanded
requiring the relocation of the sanitary sewer. The proposed easement is 20 feet wide with a
northwest bearing located at the northwest corner of the subject property. The easement is a
necessary part of the preliminary work for the Highway 41 expansion project and after review by
the Plan Commission and approval by the Common Council the easement will be recorded at
the Winnebago County Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its February 17, 2009 meeting.

GENERAL INFORMATION

Action Requested:
The Department of Public Works is requesting acceptance of a sanitary sewer easement located at
the northwest section of the subject property
Applicable Ordinance Provisions: N/A
Property Location and Type /Analysis:
The subject property is located on the east frontage road of US Highway 41, located within the
Highway 41 Corridor and is occupied by Sangria's Mexican Grill. The general area contains a
mix of uses including retail to the north, multiple - family to the east, a restaurant to the south and
Highway 41 to the west. To the immediate north is Sawyer Creek which crosses below the
highway within a box culvert.
The purpose of the easement request is for the realignment of a city sanitary sewer crossing US

The easement is a necessary part of the preliminary work for the Highway 41 expansion project
and staff does not have any issues or concerns with this request.
The Department of Public Works will work with the property owner to have appropriate easement
documents signed. After review by the Plan Commission and approval by the Common Council,
the easement will be recorded at the Winnebago County Register of Deeds.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the acceptance of the
proposed sanitary sewer easement as requested.
The Plan Commission approved of the proposed easement as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item, displayed the area where the easement would be located, and
explained that the easement was also related to the preliminary work necessary for the Highway 41
expansion project.
There was no discussion on this item.
Motion by Propp to approve the easement for property located at 700 N. Koeller Street as
requested.
Seconded by Esslinger. Motion carried 7 -0.

We need to obtain this easement due to the re- alignment of the sanitary sewer near
sawyer creek. The box culvert that currently runs underneath USH 41 needs to be
extended and that is causing the sanitary sewer alignment to be moved in order to get
around the box culvert.
30 -foot Easement on Snell Road
We need to obtain this easement due the re- alignment of the sanitary force main that runs
underneath USH 41. We do not want to have to cross the ANR gas line twice with the
new re- alignment. We want to parallel the ANR easement and stay on the south side of
the existing gas mains.
