PURPOSE: APPROVE DISPOSITION OF PORTION OF LAKESHORE
MUNICIPAL GOLF COURSE TO WISCONSIN DEPARTMENT
OF TRANSPORTATION FOR RIGHT -OF -WAY PURPOSES
FOR THE U.S. HIGHWAY 41 AND RATH LANE EXPANSION
PROJECTS
INITIATED BY: WISCONSIN DEPARTMENT OF TRANSPORTATION
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, the Wisconsin Department of Transportation (DOT) has approached
the City regarding the acquisition of portions of the Lakeshore Municipal Golf Course,
per the attached, for right -of -way purposes in conjunction with the DOT's proposed USH
41 expansion project and the relocation /extension of Rath Lane.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the properties identified on the attached maps are hereby declared
surplus and the proper City officials are hereby authorized and directed to execute any
and all documents necessary to sell the properties to the Wisconsin Department of
Transportation.

BACKGROUND /SUBJECT PROPERTY
Over the next several years, the Wisconsin Department of Transportation (DOT) will be proceeding with
the expansion of US Highway 41 through Oshkosh which will require locations where land will need to
be acquired from public and private entities for right -of -way expansion. This request involves the
disposition of three portions of the City -owned Lakeshore Municipal Golf Course.
ANALYSIS
The first area for disposition involves a 35,855 square foot parcel located on the south side of the golf
course and is to be dedicated as right -of -way and part of the Rath Lane realignment/
reconstruction. The Common Council approved the proposed street configuration in 2006 and was aware
of this forthcoming disposition request. The second area involves a 3,653 square foot section of existing
Rath Lane located at the northern terminus of Rath Lane serving as an access to the golf course's
maintenance building. This area will be reutilized as part of the Rath Lane realignment /reconstruction.
The third area to be disposed of consists of a 235 square foot sliver of land located on the west side of the
golf course and will be dedicated as right -of -way for US Highway 41. This disposition will reduce
impacts on other privately owned parcels in the area and will not affect any greens, holes, or other
features and will not adversely affect the golf course's functionality.
FISCAL IMPACT
The City will receive approximately $110,000 for this right -of -way. Approximately $10,000 of this
amount will be needed to construct sloping and restore landscaping. The remainder will be used towards
reimbursing the general fund for prior golf course debt.
RECOMMENDATION
The Plan Commission approved of this request at its February 17, 2009 meeting.

BACKGROUND /ANALYSIS
Over the next several years, the Wisconsin Department of Transportation (DOT) will be proceeding
with the expansion of US Highway 41 through Oshkosh. During the planning and design phases for
the reconstruction, the DOT determined locations where land needed to be acquired from public and
private entities for right -of -way expansion. This request involves the disposition of three portions of
the City -owned Lakeshore Municipal Golf Course.
The first area for disposition involves an approximately 35,855 square foot parcel located on the south
side of the golf course. This portion of land is to be dedicated as right -of -way and part of the Rath
Lane realignment /reconstruction. In 2006, the City of Oshkosh Common Council approved the
proposed street configuration and was made aware of this forthcoming disposition request.
Disposition of this small segment of the golf course will reduce impacts on the other privately owned
parcels in the area and allow them to remain as viable current and future development sites. The
subject part of the golf course consists of undeveloped land and the proposed street will not affect any
greens, holes, or other features and will not adversely affect the golf course. The Parks Director,
General Manager of Lakeshore, and the Parks Board have approved the sale of the land as proposed.
The second area to be disposed involves a 50 -foot by 73 -foot 3,653 square foot section of existing Rath
Lane. The piece is located at the northern terminus of Rath Lane and serves as an access to the golf
course's maintenance buildings just to the north. This area will be reutilized as part of the Rath Lane
realignment /reconstruction and access to the maintenance building will remain.
The last area to be disposed consists of an approximately 235 square foot sliver of land located on the
west side of the golf course property. This portion of land will be dedicated as right -of way for US
Highway 41. Again, this disposition will not impact the functionality of the golf course.
The Department of Public Works has reviewed and approved the proposed land disposition.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the disposition as requested.
The Plan Commission approved of the disposition as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item and displayed the areas for the land dispositions as well as the conceptual
plan for the Rath Lane extension and the extension of Koeller Street to intersect with Rath Lane. He
explained that the disposition of this segment of the golf course would reduce the impacts on the other
privately owned parcels in the area.
Commission members discussed the width of the proposed extension of Rath Lane and if the width of
the street was appropriate.
Mr. Gohde stated that the 60 feet of right -of -way was necessary to provide sufficient area for a 32 foot
wide street with a cul de sac on both the east and west ends and the installation of sidewalks.
Commission members also discussed the accesses to the sites on Omro Road in this area and how they
would be affected as well as traffic control crossing Omro Road.
Mr. Burich stated that the Wisconsin DOT will be acquiring the accesses for the sites along Omro
Road as the grade change will not allow the current accesses to exist once the overpass is constructed. .
Koeller Street will be extended to Rath Lane which will act as a frontage road and the accesses to the
sites on Omro Road will be relocated to Rath Lane.
Mr. Gohde stated that traffic control crossing Omro Road from Koeller Street will initially be
controlled with a stop sign until the round -a -bout is installed.
Commission members further discussed the difficulty exiting the site of Robbins Restaurant as there is
a visibility issue on this curve and also the issue of semi - trucks having sufficient room to navigate the
corners on Koeller Street and Rath Lane to reach the businesses access points relocated from Omro
Road.
Mr. Gohde stated that the extension of Rath Lane would allow access from Robbins Restaurant parking
lot to alleviate the difficulty of exiting their site onto Omro Road where the current access drive exists.
He further stated that Koeller Street would be either 32 or 36 feet wide which should be sufficient to
accommodate the turning radius for truck traffic to maneuver to gain access to the businesses with
accesses off of Rath Lane. He commented that the reconstruction was being done to WisDOT's
standards and the right -of way being acquired should be adequate and the street layout should improve
the situation from what currently exists there.
Motion by Nollenberger to approve the land disposition of portions of Lakeshore Municipal
Golf Course for right -of -way purposes as requested.
Seconded by Esslinger. Motion carried 7 -0.
