Such barrier, wall or wire fence will remain in position until removal is approved by the Building Inspector. S L: L,"7- H :• "� • • w ... a ., WEDNESDAY, OCTOBER 20, 1982 MEMBERS PRESENT: Elaine Cartwright (alternate), Daniel Goldthwaite, Tom King, James Larson (alternate), Harry Luebke, Norman Miller STAFF PRESENT: Phil Rosenquist, Associate Planner Darlene Matulle, Recording Secretary The meeting was called to order and the minutes of October 6, 1982 were ap- proved as recorded. I. Appeal of Dorothy Schroeder, owner of the property at 920 W. 9th _ Avenue (R -2 Zone), proposes to erect a carport addition to an exist- ing house. The carport supports would be 1' 9" from the side pro- perty line, whereas 4.75' reduced side yard setback is required. Mr. Rosenquist stated that the appellant is proposing to construct a carport. He continued that the carport would be attached to the home and requires principal building setbacks. As per the appellant's site plan, a 1'9" side yard setback is proposed whereas a 4.75' reduced side yard setback, or 10% of the lot width, is required. Mr. Rosenquist stated that a variance was unanimously granted for a carport in 1979 but the construction did not take place within the six month period so the variance is being requested again. Mr. George Reischl, 801 W. 7th Avenue, who is a nephew of Ms. Dorothy Schroeder, owner of the property at 920 W. 9th Avenue, stated that Ms. Schroeder would like to purchase a carport from. Sears. He stated that the approximate size of the carport is 10 x 20 and is 60 lbs. per square foot. Mrs. Cartwright inquired if the carport were enclosed? Mr. Reischl stated that just the back side would be enclosed for storage purposes. Mrs. Cartwright inquired into a discrepency in the 1979 variance request and the present request. She stated that a 2' sideyard setback was requested in 1979 and now a 1' 9" side yard setback was being requested. Why the difference? Mr. Reischl stated that he was under the assumption that the figures were the same. Mrs. Cartwright inquired if the carport would be constructed within the six month period? i Mr. Reischl replied yes. Ms. Schroeder stated that there were some family problems that did not allow them to start after the granting of the variance in 1979. Mr. King inquired if the house was constructed prior to 1965? �Mr. Reischl replied yes. Mr. King inquired if the carport would cause any detriment to any other neigh- bors? Mr. Reischl stated that he had spoken with the neighbors and they had no objec- tions. Dan Goldthwaite made a motion to approve the variance as requested. Motion seconded by Tom King. Motion approved 5 -0. II. Discussion and Adoption of Procedures and Regulations for the Board of Zoning Appeals. Chairman Miller opened the floor for discussion on the Procedures and Regula- tions for the Board of Zoning Appeals. Discussion ensued on various items contained in the proposed procedures and regulations. Concern was expressed regarding Article II, paragraph 1 on alter- nate members voting in the absence of a regular member or when a regular member refuses to vote because of interest. Mr. Rosenquist stated that when the situa- tion arises, which is not too often, that member usually contacts the office and an alternate member is then contacted. Article II does not appear to indicate that an alternate be present at all times. Considerable discussion ensued regarding Article VII Guides and Standards for a Zoning Variance. Mr. King pointed out that these proposed procedures and regulations are intended as a guideline for the granting of a variance. He referred to Section 30 -24 The Powers of the Board of Appeals, of the City of Oshkosh Zoning Ordinance. Tom King made a motion to change the word "shall" to "should" in Article VII, paragraph 1, sentence 1. Motion seconded by Dan Goldthwaite. Motion approved 6 -0. Article VII, paragraph 1, sentence 1 shall read as follows: 111. A variance from the terms of this Ordinance should not be granted by the Board unless and until it is determined that such a variance will not be contrary to the public inter- est and where, owing to special conditions, a literal enforcement of the provi- sions of this Ordinance would result in practical difficulty or unnecessary hardship." The remaining sections of Article VII shall remain the same. Considerable discussion followed regarding the number of times that an appeal may be brought before the Board. It was the consensus of the Board to retain the number of times that an appeal may be brought before the Board, that being three times in any 12 month period. Dan Goldthwaite made a motion to approve the Procedures and Regulations for the Board of Zoning Appeals as amended. Motion seconded by Tom King. Motion approved 6-0.
