HomeMy WebLinkAbout09-41FEBRUARY 10, 2009 09 -41 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT NO. 3 TO AGREEMENT WITH MSA PROFESSIONAL SERVICES IN THE AMOUNT OF $60,889.36 FOR ADDITIONAL ENGINEERING AND SURVEY SERVICES FOR THE NORTH MAIN STREET RECONSTRUCTION PROJECT INITIATED BY: PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Amendment No. 3 to Agreement between the City of Oshkosh and MSA PROFESSIONAL SERVICES for additional engineering services and survey services for North Main Street project in the amount of $60,889.36 is hereby approved and the proper City officials are hereby authorized to execute and deliver the amendment to agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Gohde, Assistant Director of Public Works February 5, 2009 Approve Amendment No. 3 to MSA Professional Services, Inc. for Engineering Services for North Main Street (60,889.36) BACKGROUND In June of 2006 the City hired MSA to complete the design of North Main St. from Algoma Blvd. to Irving Ave., in conjunction with the DOT reconstruction of Hwy 45 (Main St. from the Fox River to Algoma Blvd.). Additional services beyond the original contract are needed to complete the project. The additional services included with this amendment are Phase 2 Environmental studies for contamination in the right - of -way, a Transportation Project Plat to allow for securing the necessary easements, additional storm sewer work to upsize the existing outlet pipe at the Fox River and additional meetings. ANALYSIS The amendment provides a break down of costs for each of the additional work items needed. Included are items to be subcontracted to other companies to complete. I have reviewed the costs and found them to be comparable to other projects of similar work. These items are for work on the City portion of the project, not the DOT portion. FISCAL IMPACT Funds are available in the Street Construction and Storm Sewer Construction sections of the Capital Improvement Budget. (MSA) is authorized to begin work on the following project amendment: Project Name: North Main Street (Algoma Blvd. to Irving Ave) The project scope has changed due to: -Phase 2 Hazardous Material investigations are necessary to determine if contaminated soils exist within the right -of -way -A transportation project plat is needed for various easements -The proposed storm sewer has been upsized and will now include reconstruction to the outlet at the Fox River. -Extra progress meetings are necessary to meet the project schedule The scope of the work authorized is: Section II.A.2 is deleted and replaced as follows to Section A.2.0 of Exhibit A -Basic Services and Related Matters 2. Perform a Phase 2 Environmental Sampling investigation in accordance with the Wisconsin Department of Transportation's Facilities Development Manual (FDM) for the following sites: -502 N. Main Street -547 N. Main Street -563 N. Main Street -609 N. Main Street -629 N. Main Street -694 N. Main Street Page 1 of 6 Section VI II.A.4.b is added as follows to Section A.2.0 of Exhibit A -Basic Services and Related Matters b. The storm sewer trunk line will be upsized to handle additional storm water flows. The OWNER will provide the ENGINEER with the storm sewer pipe size for the main trunk line to the outfall. Include replacement of the existing outfall at the Fox River. Coordination with the Wisconsin DNR is included. Section X.A.5 in Section A.2.0 of Exhibit A -Basic Services and Related Matters is modified as follows 5. Progress Meetings (8 Meetings) (2 additional meetings) Section XI. is added as follows to Section A.2.0 of Exhibit A -Basic Services and Related Matters Xl. TRANSPORTATION PROJECT PLATS A. Prepare a Transportation Project Plat for the PROJECT in accordance with Wisconsin Statute 84.095, Facilities Development Manual (FDM) Chapter 9 - Surveying, FDM Chapter 12 — Right -of -Way Plats, FDM Chapter 15 — Plan Preparation, and the WisDOT guide to Utility Coordination, as provided by the OWNER. 1. Each Transportation Project Plat sheet shall show coordinates on all section corners and on all main line and side road survey line /reference line PI's. 2. All coordinate information shall be referenced to the Winnebago County Coordinate System (English) NAD 1983, (2007) adjustment. 3. All recovered monuments shall be shown with size and kind noted as per FDM Chapter 12 guidelines. 4. Existing access control or access covenants from previous WisDOT projects, CSM's, or Subdivisions, as provided by the OWNER or that appear in a title report, shall be shown or noted on the plat. 5. Existing property lines along with CSM's, Subdivisions, Assessor Plats, County Plats, and Condominium Plats shall be noted on the plat. 6. A note or table shall be assigned to every Transportation Project Plat to include the historical basis for dimensioning the existing highway right -of -way, to also include intersecting roads. Page 2 of 5 7. Whenever the mainline reference line crosses a section line, the bearing and distance along the section line shall be shown to the adjacent quarter corner or section corner. The type and coordinates of the section corner shall be noted on the plat. 8. Provide a Cogo Printout of the exterior boundaries of the right -of- way, which specifies closure of the traverse. The ENGINEER shall bear sole responsibility for closure of the traverse shown on each recorded plat. 9. Upon final approval by the Region, the ENGINEER shall submit a final full size, 22" x 30 ", reproducible copy of the plat on bond paper, along with an electronic file in a Awg AutoCAD format, version 2005 on a read only CD to the OWNER. B. Title Searches /Updates 1. The ENGINEER shall obtain Title Searches, Title Updates, or Commitments necessary to determine property lines and current ownerships for the PROJECT. It is estimated that thirty (30) Title Searches are required. The ENGINEER shall contract with a title company to prepare the Title Searches, Title Updates, or Commitments. The ENGINEER shall provide a copy of the Title Searches, Title Updates, or Commitments to the OWNER, upon request. 2. Right -of -Way Descriptions shall be provided for all individual parcels of land and interests to be acquired as Right -of -Way for the PROJECT. Descriptions shall be in accordance with the provisions set forth in Wisconsin Statute 84.095 (7) and Chapter 12 of the Facilities Development Manual. 3. The ENGINEER shall prepare the descriptions using Microsoft Word, 7.0 software or software compatible with the OWNER, and provide a copy of the Descriptions, excluding the recording information, in hard copy and also in an electronic format to the OWNER. 4. The ENGINEER shall provide, upon request, ONE (1) survey efforts to field locate and temporarily mark the new right -of -way boundaries including all temporary and permanent easements in a manner which will facilitate the appraisal of all affected parcels and relocation of affected utilities. Staking activities shall be Page 3of5 coordinated with the OWNER to provide at least two weeks lead time for the OWNER to send letters to property owners. 5. The ENGINEER shall be responsible for all revisions to the Transportation Project Plat and Right -of -Way Descriptions, until the Transportation Project Plat is recorded with the County Register of Deeds Office, unless specifically excluded by the contract. All amendments or revisions to the recorded Transportation Project Plat shall be made in accordance with Wisconsin Statute 84.095, and the Transportation Project Plat Guidelines, as provided by the OWNER. 6. The ENGINEER shall forward the Transportation Project Plat to the OWNER for review and approval. The OWNER will be responsible for the recording of all Transportation Project Plats. The schedule to perform the work is: Approximate Start: 1/15/09 Approximate Completion: 8/1/09 The lump sum fee for the work is: Total MSA lump sum fee $10,615.29 (Phase 2 Environmental Analysis and Report) $28,913.72(Transportation Project Plat) $ 1,472.33(Storm sewer outfall design) � 4158.02(2 additional progress meetings) $ 45,159.36 The actual cost not to exceed sub contract fee for the work is: Total sub contract fees (actual cost not to exceed) TOTAL CONTRACT AMENDMENT $ 2,740.00 (Geoprobe borings, sublet to Soil Essentials, Ltd.) $ 4,490.00 (Soil lab work, sublet to CT Laboratories) $8,500.00 (Title searches, sublet to Evans Title Companies) $15,730.00 $60,889,36 Authorization for the work described above shall amend the Agreement between MSA and OWNER. Any attachments or exhibits referenced in this Amendment are made part of the Agreement. Payment for these services will be on a lump sum basis. Page 4 of 5 Approval: MSA shall commence work on this project in accordance with your written authorization. This authorization is acknowledged by signature of the authorized representatives of the parties to this Amendment. A copy of this Amendment signed by the authorized representatives shall be returned for our files. If a signed copy of this Authorization is not received by MSA within seven days from the date of issuance, MSA may stop work on the project.
