PURPOSE: APPROVE CHANGE ORDER NO. 2 FOR PUBLIC WORKS
CONTRACT 08 -05 FOR MIRON CONSTRUCTION CO., INC.
FOR THE WATER FILTRATION PLANT MODIFICATIONS
AND DEMOLITION PROJECT ( +$295,124.52)

BE IT RESOLVED by the Common Council of the City of Oshkosh that the following
Change Order, a copy of which is attached, is hereby approved:

RE: Change Order #2 for Public Works Contract No. 08 -05;
Water Filtration Plant Modification and Demolition Project
BACKGROUND
Change Order #2 for Contract 08 -05 is scheduled for consideration by the Common Council at the
February 10th meeting. The contract was awarded to Miron Construction Co. Inc. of Neenah, WI. The bid
opening for this contract was April 2, 2008 with an anticipated award date of April 22, 2008. Due to the
issues surrounding the water tower the contract was not awarded until May 27, 2008. This delay along
with the work to remove unsuitable soils found after the initial basin demolition was completed delayed
the start of concrete replacement. The other changes are due to additional requirements of the
Department of Natural Resources that are not code related but part of departments internal decision
making process, and site conditions that have been found in the field to be different than, or not shown
on existing site plans. Whenever possible these prices reflect estimated time and material costs and will
be adjusted to reflect the actual cost of the work once it is completed. A final adjustment will be done at
the end of the contract on these items.
ANALYSIS
2a Cold Weather Placement- Payments for concrete blankets and heat during 7 day cure for portion
of concrete work affected by initial site conditions and permit delay. Contract times extended an
initial 61 days, without liquidated damages and without Contractor's General Conditions markups.
2b Hatches- Provide different model number hatches to satisfy WDNR review comment requirements
and additional hatch ladders and concrete sumps for greater operator accessibility.
2c General Conditions- Contractor General Conditions markups for City change order 1 h- replace 16
inch watermain.
2d South Clearwell- 24" Piping Changes- Provide additional pipe fittings to accommodate actual
buried piping locations.
2e Basin Overflow- Provide supplemental overflow to satisfy WDNR review comment.
2f Electrical Outlet- Provide exterior electrical outlet at High Lift Pump Station to accommodate
dewatering clearwells with portable pumps.
2g High Lift Station Sidewalk- Replace steps with ramp at pump station. Note- this revision does not
cause any change to the contract price.

2h GAC Electrical Ductbank- Provide replacement ductbank damaged and temporarily reinstalled as
result of actual buried conduit differing from record drawings and work performed in conjunction
with City's phase 1 demolition.
2i Electrical Disconnect Replacement- Replace hand switch with circuit breaker to facilitate
construction. Note- this revision does not cause any change to the original contract price.
2j Demolish Buried Well- Remove buried, previously abandoned in place well structure.
2k Wall Dowel Evaluation- Conduct structural analysis of alternative dowel placement. Note -this
revision is a deduction to the original contract price.
These changes were reviewed by CH2M Hill our consultant on the project and the costs related to these
changes were reasonable based on their experience with similar work.
FISCAL IMPACT
Funds are available in the 2008 Property Improvements Section (Water Utility Funds) of the Capital
Improvement Budget.
RECOMMENDATIONS
I recommend approval of Change Order # 2 to Contact No. 08 -05 in the amount of $295,124.52 to Miron
Construction Co. Inc.
