ZILLGES, ETAL

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to accept storm sewer and
roadway easements from Timothy Zillges, etal, at 1423 -1425 Rainbow Drive, per the
attached, and to execute any and all documents necessary for purposes of same.

BACKGROUND /SUBJECT PROPERTY
The subject property is located in a predominantly low- density residential neighborhood. The
Department of Public Works reconstructed the public alley north of Oshkosh Avenue including
storm sewer, grading and asphalt paving work.
ANALYSIS
Permanent easements are required at this location for the installation of storm sewer and the
placement of new roadway on private property. The proposed easement is triangular in shape
and located at the northwest corner of a public alley and Rainbow Drive. The Department of
Public Works has met with the property owner and the appropriate easement documents will or
has been signed.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its January 20, 2009 meeting.

LOCATED AT 1423 -25 RAINBOW DRIVE

GENERAL INFORMATION
Petitioner City of Oshkosh, Department of Public Works
Owner: Timothy and Anne Zillges
Action Requested:
The Department of Public Works is requesting acceptance of a storm sewer and roadway easement for the
installation of storm sewer and placement of new roadway at the southeast corner of the subject property.
Applicable Ordinance Provisions: N/A
Property Location and Type /Analysis:
The subject property is located in a predominantly low- density residential neighborhood. The proposed
easement is triangular in shape located at the northwest corner of a public alley and Rainbow Drive.
The Department of Public Works reconstructed the public alleys north of Oshkosh Avenue as part of
Contract 08 -14. The reconstruction included storm sewer, grading and asphalt paving work. Permanent
easements are required at this location for the installation of storm sewer and the placement of new roadway
on private property.
The Department of Public Works has met with the property owner and the appropriate easement documents
will or has been signed. After review by the Plan Commission and approval by the Common Council, the
easement will be recorded at the Winnebago County Register of Deeds.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends approval of the acceptance of the proposed
easements as requested.
The Plan Commission approved of the proposed easements as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented both of the items relating to the easements at one time as they were essentially the same
request for both addresses resulting from the reconstruction of the public alleys north of Oshkosh Avenue
including storm sewer, grading, and asphalt paving work. He commented that the property owners had
been contacted and did not have any issues with the proposed easements.
Mr. Thorns inquired if property owners were contacted in advance regarding the placement of easements on
their land.
Mr. Gohde responded that the Department of Public Works contacts the property owner prior to placement
of easements to receive their approval and the documents are prepared and signed after an agreement is
reached.
Motion by Borsuk to approve the acceptance of the proposed easements as requested.
Seconded by Mattox. Motion carried 7 -0.
