This letter sets forth a synopsis of the terms and conditions of that Agreement pursuant to the meeting we had with you and Jackson Kinney on January 8, 2009. The Agreement contains the same terms and conditions as the Agreement which is currently in effect, with the following exceptions: 1. The date has been changed so the Agreement expires on January 31, 2011. 2. The signatories have been changed to reflect the names of the new heads of our respective organizations. 3. In Attachment A, we have removed some very old language regarding the development targets for industrial park land. We may revisit these targets this coming year in conjunction with updating the Industrial Park Covenants. 4. In Attachment B, we have kept land prices at the same level, given the current economic climate, but we have included an option for prices to be reviewed prior to January 31, 2011 to determine if prices should be increased, should market conditions so dictate, upon consultation between the City and Chamco and approval by the City Council. Please let me know if you have questions or further comments. Thank you.
