The original designed called for 5 inches of bearing, and it appears that the steel shims that were installed were 5 inches long, they just extended 3 inches past the brick, and now the wood ledger has been installed without making tight contact to the steel shims. I suppose it may be possible that the treated wood ledger has shrunk as it has dried, which brings me to question if perhaps treated lumber installed in this manner is a poor way of providing the additional bearing required. Perhaps a steel angle would have been better?? Let me know what you as the designer want to require to fix this. As you will probably recall, Mr. Jungwirth has been attempting to rectify the existing structure problems that he has at that property. By way of background, he purchased the property from Dan Dowling, the owner of Dowling Construction, Inc. As part of that purchase, Dowling Construction, Inc. contracted to remodel the building for use as a tavern. It is my understanding that the City's file related to this property contains abundant correspondence from Mr. Dowling and from Peter Van Dyke of Dowling Construction, Inc., promising to rectify the roof structure problems, and agreeing to follow through on demands by the City that the roof structure problems be rectified. I would appreciate it if you would provide me with a copy of the (.:.'ity's entire file related to 216 N. Main Street, including any related email correspondence. I would be happy to pay for the reasonable copying charges. In addition, I am wondering if the City has plans to compel Mr. Dowling and Dowling Construction, Inc. to rectify these roof structure problems. It is my understanding that Mr. Dowling removed roof rafter supporting walls in the second floor area prior to the sale to Mr. Jungwirth. It is my further understanding that Dowling Construction, Inc., took out the building permit for that property, obtained State approved plans for the remodeling project and reinstalled roof rafter supports that were not properly engineered or installed and which have now failed. Please understand that we consider Brett Jungwirth, the present owner, to be an innocent by-stander in all of this. All that Mr. Jungwirth wants is a building with a sound roof, which is what Mr. Dowling told him that he would be getting. I look forward to working with you to resolve these issues. In any event it is not fair to the owner that for over a year we have not been able to draw a conclusion to this issue. What else can I do to get this project done? While it seems ridiculous to issue citations it is even more ridiculous that I have made numerous calls and request to get this project completed for over a year now, and still when I spoke to Pete this week he thought I should send an email to both of you to try and get this done. Please let me know when I can expect this to be completed in a reasonable time frame in order to avoid me having no alternative but to issue citations. Submitted HVAC plans indicate a small office in the north-east comer of the building that has supply ductwork for heating the room Per the designer, the ductwork will NOT be extended to the space, now proposed to be "storage", thus smoke detection will NOT be required to be installed. The exception involving the air distribution system as incapable of spreading smoke beyond the enclosing walls, floor and ceiling would apply. The owner, contractor, and designer are informed that if the space is supplied with ventilation from the main ventilation system, a smoke detection system shall be installed if the space is capable of enclosure. IBC 707.2 The second floor spaces were discussed with Oshkosh Building Inspector Mr. Brian Noe. Per the "referenced" conversation, as long as the second floor is treated as an attic space, then a rated enclosure or fire/smoke dampers would not be required. With this in mind, the second floor shall be considered an attic space as long as its acceptable by the local jurisdiction, and thus may NOT be used for access by persons or utilized for any type of occupancy including storage. Compliance shall be monitored by the local jurisdiction, and should the conditions of approval NOT be met, the requirements for a rated shaft enclosure with appropriate smoke and fire dampers shall be required.
