BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for a mixed commercial /residential use at 436 North Main Street,
per the attached, is hereby approved.

BACKGROUND /SUBJECT PROPERTY
The subject property is a 2,400 square foot parcel of land and is located mid -block of the 400
block of North Main Street. The two -story building was built in 1875 and is a contributing
structure within the North Main Street Historic District and is eligible for the National Register
as a local historic building. It has most recently been used as commercial space on the first floor
and office space on the second.
ANALYSIS
The petitioner proposes to convert the existing office space into a 1,500 square foot living unit
on the second floor of the building which is currently vacant. The space will be completely
renovated into a two bedroom living space with numerous amenities. The conversion will not
alter the external appearance of the structure with the exception of a patio for the residential unit
on the east side /rear of the building. The proposed upper floor residential project is consistent
with the goals of the Comprehensive Plan that call for the creation of such units in the downtown
and central city area and aids in stabilization of these business districts.
FISCAL IMPACT
None anticipated other than the potential for an additional overnight parking permit in the
adjacent City parking lot which will add revenue to the Parking Utility.
RECOMMENDATION
The Plan Commission approved of this request at its January 6, 2009 meeting.

GENERAL INFORMATION

Action(s) Requested:
The applicant is requesting a conditional use permit to create a residential living unit on the second
floor above the commercial space at 436 North Main Street.
Applicable Ordinance Provisions:
Mixed commercial /residential use development is permitted only through the approval of a
conditional use permit within the C -3 Central Commercial Zoning District. The Zoning Ordinance
establishes criteria and guidelines for the establishment and /or amendment of a Conditional Use
Permit in Section 30 -11 (D).

ANALYSIS
The petitioner proposes to convert the existing office space into a 1,500 square foot living unit on
the second floor of the former Camera Casino building, which is currently vacant. The space will
be completely renovated and the two bedroom living space will contain such amenities as multiple
skylights, gas fireplace, washer /dryer /dishwasher, ample closet /pantry space and a rooftop patio.
The conversion will not alter the external appearance of the structure with the exception of a patio
for use by the residential unit on the east side /rear of the building.
A City owned parking lot abuts the subject property to the rear and Chris Strong, Director of
Transportation has indicated that parking is available within to supply the two parking stalls
required for the apartment unit.
The proposed upper floor residential renovation project is consistent with the goals of the
Comprehensive Plan that call for the creation of such residential units in the downtown and central
city area and aids in stabilization of these business districts. The unit itself appears to be of
exceptional quality and staff believes will a positive addition to the downtown.
RECOMMENDATION /CONDITIONS
The Department of Community Development recommends a finding that the proposed conditional
use permit request is consistent with Sections 30 -11(D) of the Zoning Ordinance and be approved.
The Plan Commission approved of the conditional use permit as requested. The following is the
Plan Commission's discussion on this item.
Ms. Mattox questioned if the first floor of the building would be considered for the facade
improvement plans being implemented in the near future in the downtown area.
Todd Cummings, 2691 Edgewood Lane, stated that a commercial use has been re- established in
the first floor space and that he would be open to being involved in the facade improvement
program if funding was available.
Mr. Thoms inquired if the public parking lot behind this site would be utilized for parking for the
tenants of the proposed residential unit.
Mr. Burich replied that the Director of Transportation has indicated that spaces were available in
the lot and overnight parking permits could be issued for the two parking stalls required for the
residents of the upper floor residential unit.
Motion by Esslinger to approve the conditional use permit for a mixed use development
including upper floor residential use for property located 436 North Main Street as
requested.
Seconded by Lowry. Motion carried 8 -0.

RE: Second floor alteration located at 436 N Main Street
Dear Sir or Madam:
This proposed project is to alter and existing second floor office space that included 5
offices and a toilet room into a single apartment. The plan calls for the entire interior space to be
completely removed and reconstructed. The new 1518 square foot apartment will have new
energy efficient appliances and heating equipment Low water use fixtures and natural day
lighting via the use of skylights. This unit will fit in well with the surrounding other buildings since
it will match the uses of the buildings to the north and the south. The exterior of the building will
be unchanged except for the patio are on the existing roof to the east. This project should have
a positive impact on the surrounding area by reducing the use of public utilities and parking
demand by reducing the number of occupants from 5 to 2.
