PURPOSE: APPROVAL OF DEFERRED COMPENSATION PLAN FOR THE
CITY MANAGER IN COMPLIANCE WITH CITY COUNCIL
APPROVED EMPLOYMENT AGREEMENT
INITIATED BY: CITY ADMINISTRATION
WHEREAS, the City of Oshkosh has employee rendering valuable services; and
WHEREAS, the establishment of a money purchase retirement plan benefits
employee by providing funds for retirement and funds for beneficiaries in the event of
death; and
WHEREAS, the City of Oshkosh desires that its money purchase retirement plan be
administered by ICMA -RC and that the funds held in such plan be invested in the
VantageTrust, a trust established by public employers for the collective investment of
funds held under their retirement and deferred compensation plans:
NOW THEREFORE BE IT RESOLVED that the Employer hereby establishes or has
established a money purchase retirement plan (the "Plan ") in the form of The ICMA
Retirement Corporation Governmental Money Purchase Plan & Trust, pursuant to the
specific provisions of the Adoption Agreement.
The plan shall be maintained for the exclusive benefit of eligible employee and his
beneficiaries; and
BE IT FURTHER RESOLVED that the Employer hereby executes the Declaration of
Trust of VantageTrust, and attached hereto as Appendix B, intending this execution to be
operative with respect to any retirement or deferred compensation plan subsequently
established by the Employer, if the assets of the plan are to be invested in the
VantageTrust.
BE IT FURTHER RESOLVED that the Employer hereby agrees to serve as trustee
under the Plan and to invest funds held under the Plan in the VantageTrust; and
BE IT FURTHER RESOLVED that the Director of Finance shall be the coordinator
for the Plan; shall receive reports, notices, etc., from the ICMA Retirement Corporation or
the VantageTrust; shall cast, on behalf of the Employer, any required votes under the
VantageTrust; and may delegate any administrative duties relating to the Plan to
appropriate departments; and
BE IT FURTHER RESOLVED that the Employer hereby authorizes Director of
Finance to execute all necessary agreements with the ICMA Retirement Corporation
incidental to the administration of the Plan.

RE: Approval of Deferred Compensation Plan for City Manager in Coordination with
Existing Council Approved Employment Agreement
BACKGROUND
In June of 2008, upon hiring the new City Manager, the Council executed an employment agreement
tD
with the new City Manager. As part of that agreement, the Council agreed to deposit $300 per month
into a deferred compensation plan, in addition to the normal retirement program, for the benefit of the
City Manager.
ANALYSIS
In researching the implementation of the deferred compensation piece of the employment agreement, it
was discovered that the City needs to add a variation to its already existing 457 plan in order to execute
this item. In addition, the implementation needs to happen in the calendar year 2008 in order to fund this
year's obligation.
FISCAL IMPACT
- There is no fiscal impact in proceeding with this authorization.
RECOMMENDATION
Staff recommends that Council adopt this resolution.

RE: Award of Glatz Creek Strom Water Management Plan Engineering Services Contract
Engineering staff requested proposals from five engineering consulting firms to perform a detailed watershed -
wide Storm Water Management Plan for the Glatz Creek Watershed. Each firm submitted a proposal. Staff
reviewed the proposals and chose one based upon how well that one demonstrated an understanding of the
city's needs and the scope of services included with the proposal request. Staff then reviewed the experience
and qualifications of that consultant's proposed project team. Cost of the services was then reviewed. Attached
is a summary of the firms' proposals broken down by hours and cost.
Based upon the review process, McMahon Associates of Neenah will provide the best value to the city in terms
of hours of service and cost, represented by average cost per hour of work.
Section 12- 10(D)(5) of the Municipal Code provides that professional services of a specialized nature, including
engineering services, may be approved by the City Manager without the use of formal, sealed quotes. In
accordance with 12 -10(E) of the Code, I am hereby submitting this report regarding this contract award. Funds
for these services are budgeted in the Storm Water Utility.
