STREET RIGHT -OF -WAY / JACKSON STREET AND MURDOCK
AVENUE INTERSECTION IMPROVEMENT PROJECT
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, it is in the best interests of the citizens of the City of Oshkosh to
acquire certain land for right -of -way purposes to improve traffic and pedestrian safety at
the Jackson Street and Murdock Avenue intersection; and
WHEREAS, the Common Council previously approved entering into an
agreement, as amended, with the Wisconsin Dept. of Transportation (DOT) for
improvements to the Jackson Street and Murdock Avenue intersection.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached Revised Relocation Order for Jackson Street /Murdock
Avenue Intersection is hereby approved and the proper City officials are authorized and
directed to execute the Order for acquisition of property, including easements and
access rights, pursuant to authority granted under Sections 32.05, 32.06, 32.07 and
62.22, Wisconsin Statutes.
BE IT FURTHER RESOLVED that the Common Council certifies it is necessary
for the City to acquire portions of certain properties, and temporary and permanent
easements, as noted on the attached maps, as may be required for said project to be
implemented.
BE IT FURTHER RESOLVED that the City hereby accepts temporary and
permanent easements, as noted on the attached maps, for said project to be
implemented.
BE IT FURTHER RESOLVED that the City hereby dedicates for street right -of-
way purposes those portions of land as may be required for right -of -way purposes.
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to execute any and all documents necessary for purposes of same.

To effect this change, pursuant to authority granted under Section 66.22, Wisconsin Statutes, the City of Oshkosh orders that:
1. The said road is laid out and established to the lines and widths as shown on the plat
2. The required lands or interests in lands as shown on the plat shall be acquired by the City of Oshkosh.
3. This order supersedes and amends any previous order issued by the City of Oshkosh.

Project Plan (Plan Commission Recommends Approval)
BACKGROUND
The Common Council previously approved an agreement with the Wisconsin Department of
Transportation for reconstruction of the intersection of Jackson Street and W. Murdock Avenue
affecting 21 properties within the project area. The proposed project will convert the intersection
from a traditional signal - controlled intersection to a two -lane roundabout.
ANALYSIS
It is the City's responsibility to acquire the real estate interests required for this project including
temporary easements, access rights and purchases of portions of properties in the project area to
allow for installation of handicap ramps at intersections. The Transportation Project Plat is a
revision to the original plan modifying the locations of easements and proposed dedications
which was approved by the Common Council in February of 2008 authorizing the City to accept
easements, acquire property and dedicate right -of -way. In September of 2007, the Common
Council authorized the purchase of 1805 Jackson Street to allow for right -of -way dedication for
this project.
FISCAL IMPACT
This revision to the right -of -way plat has no change to the dollar amounts previously approved
by the Common Council for land acquisitions.
RECOMMENDATION
The Plan Commission approved of this request at its December 2, 2008 meeting.

ITEM: APPROVE TRANSPORTATION PROJECT PLAT FOR THE
RECONSTRUCTION OF THE INTERSECTION OF WEST MURDOCK
AVENUE AND JACKSON STREET

GENERAL INFORMATION

Action Requested:
Approve Transportation Project Plat needed for reconstruction of the intersection of Jackson Street and
W. Murdock Avenue.
Applicable Ordinance Provisions:

Property Location and Type:
The affected area involves W. Murdock Avenue from approximately 400 feet west of Jackson Street to
540 feet east of Jackson Street and Jackson Street from approximately 490 feet north of West Murdock
Avenue to 330 feet south of West Murdock Avenue. The Plat affects 21 properties within the project
area.
ANALYSIS
The Common Council previously approved an agreement with the Wisconsin Department of
Transportation for reconstruction of the intersection of Jackson Street and W. Murdock Avenue. The
proposed project will convert the intersection from a traditional signal - controlled intersection to a two -

In February of 2008, the Plan Commission and Common Council approved authorization for the City
to accept easements, acquire property and dedicate right -of -way. The Transportation Project Plat is a
revision to the original plan. During the preparation of construction plans, modifications of the
locations of easements and proposed dedications were required and now reflected on the Project Plat.
It should be noted that in September of 2007, the Common Council authorized the purchase of 1805
Jackson Street (Kentucky Fried Chicken) to allow for right -of -way dedication for this project.
RECOMMENDATION /CONDITIONS
The Department of Community Develoment recommends approval of the Transportation Project Plat
for the reconstruction of the intersection of Jackson Street and West Murdock Avenue as requested.
The Plan Commission approved of the Transportation Project Plat as requested. The following is the
Plan Commission's discussion on this item.
Mr. Buck presented the item and explained that the Transportation Project Plat is a revision to the
original plan which was approved by the Common Council in February of 2008. During the
preparation of construction plans, modifications of the locations of easements and proposed
dedications were required and now reflected on the Project Plat.
Commission members discussed some of the areas where the right -of -way would be increased and a
question was raised regarding if the new development approved at the prior meeting on the northeast
corner of Jackson Street and West Murdock Avenue would be affected. It was determined that the
increased right -of -way in that area would only be temporary and should not have any negative impact
on this development.
Ms. Mattox questioned why the reconstruction of the intersection would affect 21 properties and if this
was what was causing the delay in the construction until 2010.
Steve Gohde, Assistant Director of Public Works, responded that the number of properties affected is
common in all WisDOT projects as easements are required to be obtained for any property which may
be accessed during the construction process, even if it is only temporary. At this time, the relocation of
Kentucky Fried Chicken is responsible for the delay in the project.
Commission members discussed the impact on traffic traveling north and south in 2010 if both Main
Street and this intersection were scheduled to be under construction concurrently. Mr. Gohde stated
that City staff and the WisDOT are currently discussing these issues.
Mr. Esslinger requested that the Transportation Project Plat be removed from the consent agenda to be
considered in a separate vote.
Motion by Lowry to approve the Transportation Project Plat for the reconstruction of the
intersection of W. Murdock Avenue and Jackson Street.
Seconded by Borsuk. Motion carried 6 -1. Ayes- Borsuk/ Bowen /Fojtik/Lowry/Propp /Mattox.

Addition -Town of Omro (Plan Commission Recommends Approval)
BACKGROUND
The property is located in a developing residential area in the Town of Omro approximately
15,000 feet from the nearest City boundaries in the Oakwood Road area. The lots in this area are
being served by individual sewer and water service and the proposed extraterritorial final plat
includes 21 lots.
ANALYSIS
The extraterritorial plat is in the City's 3 -mile plat jurisdiction area, therefore, physical design
requirements do not apply and the plat needs to be reviewed on the basis of being consistent with
the City's Comprehensive Plan only. It is located in an area that the City identifies as
appropriate for residential use and therefore would be consistent with said plan.
FISCAL IMPACT
None anticipated as this is not in the City.
RECOMMENDATION
The Plan Commission approved of this request at its December 2, 2008 meeting.

Addition located in the Town of Omro as requested.
Seconded by Mattox. Motion carried 7 -0.
