HomeMy WebLinkAboutRaze or Repair Request - 12/4/08Raze or Repair Request Name: Keith B/Jackie M Damato 27 W 11 ~' Ave Oshkosh, WI 54902 Address of violation: 546 Ceape Ave Problem/Violation: No active utilities and numerous Minimum Housing and Property Maintenance Code violations. Brief history review: The owner of the property, Keith Damato, contacted me on November 24, 2008 regarding problems he was having with his property located at 546 Ceape Ave. This is a two-unit apartment with addresses of 546 Ceape Ave and 105 Bay St. Mr. Damato purchased the property on May 23, 2008 through a foreclosure. The property had an open Correction Notice that was issued to the former owner for several Minimum Housing and Property Maintenance Code violations. Mr. Damato was made aware of the need to make the necessary corrections. Mr. Damato did obtain a building permit to remodel both units and had gutted the unit at 546 Ceape Ave. At some point he had decided that the project was going to be too much for him to finish and he decided to stop all work. Mr. Damato had a co-signer on the home loan, Norman Bock, who took it upon himself to rent out the unit at 105 Bay St. without Mr. Damato's permission. It was at that point that Mr. Damato contacted me to make an inspection of the premises. The conditions noted at inspection have led to both dwelling units being posted "Unfit for Human Habitation". Enclosed are copies of e-mails, photos taken at the inspection as well as a copy of the Correction Notices that have been issued. City Ordinance and State Statutes state that if a building is old, dilapidated or out of repair and- consequently dangerous, unsafe, unsanitary or otherwise unfit for human habitation and unreasonable to repair, order the owner of the building to raze the building or, if the building can be made safe by reasonable repairs, order the owner to either make the building safe and sanitary or to raze the building, at the owner's option. Unfit for Human Habitation 1. Per WPS the gas and electricity have been turned off. 2. The water has been turned off at the curb as of November 26 per the Water Department. 3. Without heat, water or electricity the dwelling cannot be used for habitation. Out of Repair: 1. The unit at 546 Ceape Ave remains gutted. Plumbing, electrical and building updates are required to meet current codes. 2. Water was found running through the uncapped plumbing supplies. Floors in the bathroom and kitchen were water damaged as a result. The water was draining through the floors into the basement. Some structural damage may have occurred to the floor framing. 3. Windows with broken panes of glass, and missing screens. 4. Appropriate fire separation needs to be provided between units. 5. Roof is in poor condition. 6. The following violations were noted: 1 ■ Item # 1 Code 16- 33A(3) Compliance No Compliance Date 12/10/2008 IMMEDIATELY Description Every required kitchen sink, lavatory basin, bathtub and shower shall be properly connected with both hot and cold potable water, and every flush water closet shall be properly connected to a supply of water adequate in volume and pressure for flushing purposes. At inspection water 12/03/2008 was found to be running into the 546 Ceape Ave unit due to the water being tumed on for a person living at the adjoining 105 Bay St unit. Plumbing was not capped. Damage done to floor in bathroom/kitchen. Gas has been 12/03 /2008 turned off per WPS as of 12/3/08. Due to the numerous areas to repair, a raze or repair request will also be submitted to address the noted violations. Violations must be corrected and approved within 30 days unless otherwise noted. Call for reinspections prior to concealment and /or occupancy. Upon completing the corrections, the owner /contractor /agent must sign and date at the bottom of this notice and return it to the Inspection Services Division by the Compliance Date of 12/10/2008 Office hours for obtaining permits are Monday through Friday 7:30 -8:30 a.m. and 12:30 -1:30 p.m. or by appointment. When I quit working on in a few months back, it was not ready to be rented. I gave Norm a set of Keys so he could show the place to potential buyers and because at that time, there was the possibility of him taking over the property and taking my name of the deed. I do not have the money to fight him through the legal system and I am sure that he knows that. My wife and I just moved out of the house we were renting from Norm, like I said, we want to cut all ties with him. My wife called the power company to transfer our service to out new house and to have the power shut off at 105 Bay. The power company said that they can not shut off the power because someone is living there. I drove by there on Saturday and sure enough, some one is living there. And right now, my wife and I are paying for the power there. This is insane, how can something like this happen? did not want to rent out the property, I did not feel comfortable renting it out, and right now, my wife is out of work on medical leave so money is very tight. Norm has really put us into a bind! Is there anyone that I can go to for help in this matter? I had told you before that I thought that Norm was going to try and rent it out, I just did not think that he would do it while I technically still own the building. I spoke with him on Saturday and it just turned into an argument. He had no intention of having the people leave the building. What can I do, if something happens over there it is on me, I really do not know what my rights are in a matter like this. I have never been in this kind of situation! Keith, We could certainly set up an inspection to check on your progress for the permit that you took out for interior remodeling. The property is in your name and if there is someone in there I am assuming that there must be a lease involved. I am a little confused how someone who does not own the property or have it in his name can rent it out to someone. This sounds like a legal problem but if there are people in there and the dwelling unit does not comply with the minimum standards that is a problem. Please let me know if we can do the progress inspection to check on the situation. Importance: High Good Morning Andrew, I wanted to make sure that you got the message that I left you on Saturday night regarding Norm Bock, renting out the duplex on 105 Bay St. I did not give permission for this. I do not know what he thinks that he can bend the rules to suit him. He in making money off a property that he does not even own, he is just the cosigner. I have given him the chance to own the property out right and he has not taken it. I guess he figures why buy it, when he can collect the money off renting it any way. When I drove by there on Saturday, there was a bike on the porch and a white car in the driveway. Last I knew, there was not even hot water for the building. Please let me know if you need anything. I really hope this does not fall back on me! I have been trying to cut all ties with Norm for reason like this. I do not like the way he does business and do not want to be associated with him. What I intend to do is put together a new Correction Notice for the noted issues from the inspection. I will also be submitting a Raze or Repair Request to make sure that all the required repairs are made. The notice will also state that both dwelling units have been posted uninhabitable and shall remain vacant until all repairs are made and a re- inspection is passed. Randy Cruz, who is the person living in the 105 Bay St unit, called me today and stated that he has found a different place and is in the process of moving out. He said that the only times he will be at 105 would be when he is getting his belongings out. He asked me to convey a request that the doors not be padlocked until his belongings are out. I told him that we (the City) would not secure a property in such a manner but that it was your prerogative to secure your own property if you felt the need. He will be calling me when he is done getting his stuff. I can let you know and if you want it would be appropriate to secure the premises at that time. Have you contacted WPS and the Water Dept. to have the utilities shut off? According to Randy both the electric and gas have been turned off. Subject: 105 Bay status. Good morning Andrew, I am afraid to ask, but can you give me an update on what is happening with the 105 Bay property. My wife just called and said that when she was taking the boys to school she noticed that there were signs posted saying the property can not be used. As we discussed before, I am absolutely fine with that, I was just curious as to what all was happening with it. Also, I wanted to know if it was possible for you to send me copies of the pictures that you took of the water damage the day we walked though. If this is going to continue to be a battle between Norm and myself, then I will be going after him to pay for the damage that the water leak caused due to his maintenance personal. I am sure by now that you are already tired of hearing about this property, I apologize the problems that this has caused. Hopefully it will get resolved in the near future. I have enclosed the most recent copies for your review. Per your schedule that you submitted, the repairs at 825 Otter were to be completed by 3/31/07 and the repairs to 546 Ceape were to be completed by 5/30/07. Re- inspections are necessary at both properties to verify compliance with the issued Correction Notices. Your property at 221 Oxford Ave was recently reviewed by the Planning Division as part of the Near East Neighborhood. Letters were sent to you indicating the repairs that are required to be made as a part of that assessment. Since you did not make contact with the Planning Division, the violations were forwarded to Inspection Services. A Correction Notice is enclosed with a Compliance Date of 11/22/07. Also, there has been no schedule submitted to address the Correction Notices issued for 418 Merritt Ave. and 512 514 Grand St. The notice for Merritt Ave is past it's compliance date and the compliance date for Grand St. is tomorrow (October 24, 2007). The re- inspections need to be arranged for Otter and Ceape and a schedule of repairs has to be submitted for Merritt and Grand no later than November 2, 2007 in order to avoid further enforcement action.
