The lots in this area are being served by individual sewer and water service and the proposed extraterritorial final plat includes 21 lots. ANALYSIS The extraterritorial plat is in the City's 3 -mile plat jurisdiction area, therefore, physical design requirements do not apply and the plat needs to be reviewed on the basis of being consistent with the City's Comprehensive Plan only. It is located in an area that the City identifies as appropriate for residential use and therefore would be consistent with said plan. FISCAL IMPACT None anticipated as this is not in the City. RECOMMENDATION The Plan Commission approved of this request at its December 2, 2008 meeting. Approved, City Manager ITEM: EXTRATERRITORIAL FINAL PLAT FOR ORMAND BEACH HEIGHTS FIRST ADDITION LOCATED IN THE TOWN OF OMRO Plan Commission meeting of December 2, 2008 GENERAL INFORMATION Petitioner: R. A. Smith National Owner: Judith A. Jones Action Requested: Approval of a 21 -lot extraterritorial plat in the Town of Omro. Applicable Ordinance Provisions: Requirements governing platting are located within Section 30 -72 of the City of Oshkosh Subdivision Regulations. Property Location and Type: The property is located in a residential area in the Town of Omro approximately 15,000 feet from the nearest City boundaries in the Oakwood Road area. It is located in a developing residential area in both the Towns of Omro and Algoma. The residential lots in this area are served by individual sewer and water service. Because the plat is extraterritorial, the City's Subdivision Regulations pertaining to physical design requirements do not apply and the plat needs to be reviewed on the basis of being consistent with the City's Comprehensive Plan. In this case, the plat is located in an area that the City's land use plan identifies as appropriate for residential use. The plat is located in an urbanizing area of the Towns that based on existing development patterns and boundary agreements, the City will not in all likelihood grow into. Additionally, urban services (i.e. sewer, water, police, fire, etc.) are available and will service the lots in the subdivision. RECOMMENDATION /CONDITIONS The Department of Community Development recommends a finding that the proposed extraterritorial final plat is consistent with the City's Comprehensive Plan and be approved. The Plan Commission approved of the extraterritorial final plat as requested. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and stated that since it is an extraterritorial plat, the City's Subdivision Regulations pertaining to physical design requirements do not apply and the plat needs to be reviewed on the basis of being consistent with the City's Comprehensive Plan only. Ms. Mattox questioned if stormwater management issues have been addressed. Mr. Burich responded that an engineering review would be completed by either Winnebago County or the Town or Omro since this area is not in the City of Oshkosh. Motion by Lowry to approve the extraterritorial final plat for Ormand Beach Heights First Addition located in the Town of Omro as requested. Seconded by Mattox. Motion carried 7 -0.
