PURPOSE: APPROVAL OF ACQUISITION OF INDUSTRIAL PARK LAND;
APPROVE FUND TRANSFER; APPROVE REIMBURSEMENT /
SOUTHWEST INDUSTRIAL PARK EXPANSION — CLARK HILL
FARM PROPERTIES
INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT
WHEREAS, the owners of property on the west side of Clairville Road, north of
STH 91, have offered to sell 80± acres of land to the City for expansion of the
Southwest Industrial Park at a purchase price of $14,000 per acre; and
WHEREAS, expenditures relating to this acquisition will be paid on or after the
passage of this resolution and the City reasonably expects to reimburse itself for these
expenditures, and associated closing costs, from a State Trust Fund loan; and
WHEREAS, it is necessary to transfer funds from General Fund Equity to finance
the purchase until such time as the Trust Fund loan is received; and
WHEREAS, this Resolution is a declaration of official intent under Treasury
Regulation Section 1.103 -18, or amendment thereto, and shall be made available for
public inspection pursuant to Chapter 19, of the Wisconsin Statutes.
The maximum principal amount of the obligation expected to be issued for this
project is One Million One Hundred Thirty -Five Thousand AND NO /100 DOLLARS
($1,135,000.00), which includes, but is not limited to, the sale price and applicable
closing related costs.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to purchase
80± acres of land on the west side of Clairville Road., north of STH 91, per the attached
map, for expansion of the Southwest Industrial Park, at a purchase price of $14,000 per
acre.
BE IT FURTHER RESOLVED that the proper City officials are authorized and
directed to transfer the sum of One Million One Hundred Thirty -Five Thousand AND
NO /100 DOLLARS ($1,135,000.00) from Account No. 100 - 0071 - 3460 -00000 General
Fund Equity to Account No. 515 - 1040 - 1702 -03953 Industrial Park Land Enterprise Fund
— Southwest Industrial Park.

Land Purchase
BACKGROUND
The Council is asked to approve a Resolution that will authorize the borrowing and purchase of
land for future industrial park development. The City submitted a conditioned offer (that was
subsequently accepted) on the acquisition of 80 acres of land on the west side of Clairville Road,
north of STH 91 for an expansion of the City's Southwest Industrial Park. The condition on the
offer was that it was subject to review and approval by the Council.
The property owners have agreed to the proposed purchase price of $14,000 an acre as long as
the transaction can be closed prior to December 31, 2008.
ANALYSIS
Prior to making the offer on the land the City retained the services of Foth & Van Dyke of Green
Bay to undertake an analysis of the development potential of the subject property. Attached to
this Memo are several concept plans showing potential street layouts and site scenarios as to how
industrial development can be undertaken in the area. Included in the concepts is the potential to
create a possible rail spur connection to the Wisconsin Southern Railroad line in this area.
Also attached to this Memorandum is an aerial showing the general location of the 80 acre site.
As the City has worked with Chamco on industrial park programming over the years, there has
been a continuing need to look at properties that offer logical locations for the expansion of the
City's industrial parks. Acquiring land to the west of Clairville Road would meet that criterion
and enable the City to increase the amount of land available for development in one of the City's
most successful industrial parks.
FISCAL IMPACT
City staff worked with City Assessor Steven Schwoerer in evaluating land prices on the south
and southwest sides of the City in the area west of Highway 41, and given that review it was felt
the $14,000 per acre price was reasonable.
The subject property is approximately 80 acres in size, which at $14,000 an acre, provides for a
purchase price of $1,120,000. The Resolution will include this acquisition price plus associated
closing costs.
According to Finance Director Peggy Steeno, funds for this purchase will be borrowed from the
State Trust Fund. In order to complete the purchase in a timely manner, Fund Balance may need
to be temporarily used to pay for the land. Then, once the borrowed funds are receipted, they
will be used to repay the General Fund to replenish the Fund Balance. Both transactions are
expected to be completed by the end of 2008 or the very beginning of 2009.
RECOMMENDATION
It's recommended that the Council authorize the purchase and borrowing of the Clark and Hill
property for the future expansion of the Southwest Industrial Park.
