HomeMy WebLinkAbout08-491DECEMBER 9, 2008 08 -491 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT WITH WISCONSIN DEPARTMENT OF TRANSPORTATION FOR LIGHTING / MAIN STREET BRIDGE INITIATED BY: CITY ADMINISTRATION BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement between the City of Oshkosh and Wisconsin Department of Transportation for lighting the Main Street Bridge is hereby approved with the following conditions: 1) The City enter into an agreement with Progress Oshkosh or another entity to provide for the payment of operational and maintenance costs, including electrical costs, for the lighting and control units. 2) The final mounting and adjustment mechanism for the lights be approved by the Department of Public Works and the Transportation Department prior to installation. BE IT FURTHER RESOLVED that upon compliance with the conditions above, the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. The authority for the Municipality to enter into this agreement with the State is provided by Section 86.25(1), (2), and (3) of the Statutes. NEEDS AND ESTIMATE SUMMARY: Existing Facility (describe and give reason for request): The Municipality in cooperation with Progress Oshkosh, a non profit organization, wish to install profile lighting on the side of the Main St. bridge. Proposed Improvement (nature of work): The proposal is to install 12 LED color changing lights, 6 on each side of the bridge to illuminate the structure. The work will include controllers and conduit. Describe non - participating work included in the project contract: The City will pay for all installation, electric, maintenance and removal costs. This request is subject to the terms and conditions that follow and is made by the undersigned under proper authority to make such a request for the designated Municipality and upon acceptance by the State shall constitute agreement between the Municipality and the State. Signed for and in behalf of Name Title Municipality Date TERMS AND CONDITIONS: 1. The Municipality understands the lights can not interfere with the Bridge Operators ability to operate the bridge. The City will adjustiremove the lights to avoid conflicts with the operators cameras or vision. 2. The Municipality will remove and replace the lights as needed for State bridge maintenance. The State shall provide the City with at least 2 week notice unless under emergency. 3. The Municipality will be responsible for all costs associated with the installation and maintenance. 4. Gohde, Assistant Director of Public Works December 5, 2008 Approval of Agreement with Wisconsin Department of Transportation for Lighting the Main Street Bridge BACKGROUND Progress Oshkosh has been seeking private donations to place decorative lighting on three bridges across the Fox River. The groups is seeking to first light the Main Street bridge and then light the Congress Ave. and Jackson St. bridges over the Fox River in the future. The Wisconsin DOT requires an agreement with the Municipality to allow for the installation of lights on a DOT bridge. City staff has worked to review the fixtures and drafted an agreement with the State Department of Transportation to allow for the installation of the lights. The DOT has approved the agreement to allow the lights to be installed. The Department of Public Works and Transportation Department have reviewed the proposed installation and have concerns about the mounting method. The light manufacture is working to resolve the mounting issue. The original proposal for Progress Oshkosh was to pay for the installation and all operating and maintenance costs. As the attached letter from Jeremy Monnett of Progress Oshkosh indicates, the group is now asking that the City fund all operating (i.e. power) and maintenance costs and assume all responsibility for the lights once they are installed. The attached information estimates a range for the current annual power costs from $286 to $756 annually, depending on how long the lights are on. The City would also be responsible for repairs and replacement of the lights, unless otherwise provided for by Progress Oshkosh. To date an agreement with Progress Oshkosh or another group has not been approved. ANALYSIS This agreement is only the first step in allowing the lights to be installed and does not require the City to install the lights. The agreement with the DOT would obligate the City to perform any required maintenance on the lights. FISCAL IMPACT In the absence of an agreement with an outside group to fund power costs and /or maintenance costs, the City's cost would be $286 to $756 annually, not including ongoing maintenance and repairs. As the Progress Oshkosh group raises additional funds for the Jackson and Congress bridges, we can assume that we will also incur these costs for each bridge. The costs to install the lights on the Main Street bridge are entirely borne by the Progress Oshkosh group. Progress Oshkosh has raised over $52,000 to fund the installation.
