RE: Approval to Grant Cross Access Easements in the High Avenue Parking Lot for
Access to the Rear or Properties at 135 -141 High Avenue (Plan Commission
Recommends Approval)
BACKGROUND
This item is related to the land disposition involving city -owned property adjacent to the High
Avenue Parking Lot that is being disposed of to the owners of the Community Credit Union
(CCU) property for parking and greenspace improvements, which affects access to the subject
properties.
ANALYSIS
The owners of 135 -141 High Avenue currently access the back of their properties through the
CCU parking lot and the proposed parking lot landscape improvements will eliminate this
accessibility, requiring a new access through the High Avenue Parking Lot. To remedy this, the
owners of the CCU property are proposing to dispose of a portion of their property to the owners
of 139 and 141 High Avenue to allow a new access way to those properties through the High
Avenue Parking Lot. The cross access will result in the loss of four parking stalls. The Parking
Utility Board reviewed and approved of this easement.
FISCAL IMPACT
All physical improvements associated with providing the access through the High Avenue
Parking Lot will be the responsibility of the owners of the Community Credit Union (CCU)
property. Fiscal impact related to the loss of four parking stalls within the lot will occur but is
negligible.
RECOMMENDATION
The Plan Commission approved of this request at its November 18, 2008 meeting.
Approved,
City Manager

BACKGROUND /ANALYSIS
This item is related to the previous land disposition involving a portion of the High Avenue Parking
Lot that is being disposed to the owners of the Community Credit Union (CCU) property for parking
and greenspace improvements, which affects access to the subject properties. The owners of 135 -141
High Avenue currently access the back of their properties through the CCU parking lot and the
proposed parking landscaping improvements will eliminate this accessibility, requiring the new access
through the High Avenue Parking Lot. To remedy this, the owners of the CCU property are proposing
to dispose of a portion of their property to the owner of 139 and 141 High Avenue to allow a new
access to those properties through the High Avenue Parking Lot. The cross access will result in the
loss of four parking stalls in the lot.
The Parking Utility reviewed and approved the provision of the cross access easement and the land
disposition. The easement will be prepared by the City Attorney and will ensure that access be
provided for all impacted properties.
RECOMMENDATION
The Department of Community Development recommends approval of the cross access easement.
The Plan Commission approved of the cross access easement as requested. The following is the Plan
Commission's discussion on this item.

Avenue.
