HomeMy WebLinkAbout08-428NOVEMBER 25, 2008 08 -428 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVAL TO GRANT CROSS ACCESS EASEMENTS IN THE HIGH AVENUE PARKING LOT FOR ACCESS TO THE REAR OF PROPERTIES AT 135 -141 HIGH AVENUE INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant an access easement in the High Avenue Parking Lot to the owners of property at 135 High Avenue and 139- 141 High Avenue to provide access to the rear of the properties at 135 — 141 High Avenue, and the proper City officials are hereby authorized and directed to execute any and all documents necessary for purposes of same. 1'HK 1 H ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Jackson Ki e Director of Co unity Development DATE: November 20, 2008 RE: Approval to Grant Cross Access Easements in the High Avenue Parking Lot for Access to the Rear or Properties at 135 -141 High Avenue (Plan Commission Recommends Approval) BACKGROUND This item is related to the land disposition involving city -owned property adjacent to the High Avenue Parking Lot that is being disposed of to the owners of the Community Credit Union (CCU) property for parking and greenspace improvements, which affects access to the subject properties. ANALYSIS The owners of 135 -141 High Avenue currently access the back of their properties through the CCU parking lot and the proposed parking lot landscape improvements will eliminate this accessibility, requiring a new access through the High Avenue Parking Lot. To remedy this, the owners of the CCU property are proposing to dispose of a portion of their property to the owners of 139 and 141 High Avenue to allow a new access way to those properties through the High Avenue Parking Lot. The cross access will result in the loss of four parking stalls. The Parking Utility Board reviewed and approved of this easement. FISCAL IMPACT All physical improvements associated with providing the access through the High Avenue Parking Lot will be the responsibility of the owners of the Community Credit Union (CCU) property. Fiscal impact related to the loss of four parking stalls within the lot will occur but is negligible. RECOMMENDATION The Plan Commission approved of this request at its November 18, 2008 meeting. RECOMMENDATION The Department of Community Development recommends approval of the cross access easement. The Plan Commission approved of the cross access easement as requested. The following is the Plan Commission's discussion on this item. Mr. Burich presented the item and stated that the provision of cross access would be to allow access currently located within the credit unions existing parking lot for three properties located on High Avenue.
